I'm hoping it works. About three weeks ago, I received an order for a model kit, which was sent within 24 hours to the customer in NYC. Never received any feedback, or correspondence from the customer, then on 10-28 I received a notice from paypal that the customer filed a claim through his credit card citing that it was an unauthorized use of his card. Name on the card matches the customers name in both the paypal and ebay transaction, and the address that paypal has matches the address that ebay has. The item was shipped through the ebay label program, and there is confirmation of shipping, and also receipt on the buyers end. I called the customer on the phone number that was listed in the ebay transaction, but he will not return my call. I have provided paypal with all of the information that they are seeking, and now they are "looking into this". Any idea if I am protected in this case? From what I am reading, I think I am, but since the dispute generated from the credit card company that he used, I'm not 100% sure. Steve

Customer filed unauthorised use of his credit card through his credit card issuer is not the same as item not decribed or item not received.
His credit card issuer is asking Paypal for more information,Paypal can only present what it has,his registration with Paypal,the transaction detail,date time and dollar amount.
Did anyone sign for it at the confirmed address?
If he still insists it aint him making the charge,you are not covered under PAYPAL seller protection as it does not cover unauthorised use of credit card.
Someone else may shed more light on this,in the mean time,you can go back to your PAYPAL SELLER PROTECTION Policy and find out more about unauthorised use of credit card and seller protection.

There could be a charge back fee you may have to pay if you lose,the only recourse is file complaint with FBI,USPS fraud dept etc

I dont think insuring the shipment helps either,as insurance only cover loss or damage of the item,not fraudulent payment

Reading deeper through the seller protection page makes me think that I will be covered. I guess I just have to kick back and wait for the results... A hunski is on the line

The CC company will do a charge back to the buyer and buyer protection refunds the seller. The buyer gets something for nothing. I like the old days when if a buyer didn't like the item or felt someone used his card without permission he / she sent it back for a refund this getting stuff for free is bad business!

if the buyer whose card has been used fraudulently does not have the merchandise,he has nothing to return!
Paypal and Ebay are not telling us,they may have some information to show the owner of the credit card is using his card to make purchase,not someone else.
Say he is signed on to Ebay and made numerous purchases and paid via paypal in the same time period when he bought the item from you and now he is filing dispute just on one item,and kept the others,that does not go well with his argument that someone used his card?
to go from Ebay to Paypal to make payments,both sites could have audit trails of his IP address,time and date,the IP address would show where he is coming from.
Ebay used to catch shill bidding and suspended members who open new account by using a cookie data base,say you have 2 Ebay Ids,you sign onto Ebay with one id,EBAY throw a cookie on your PC,then you sign off and signback on with another Ebay Id,Ebay throw another cookie on the same PC,now this is how it knows these two IDs belong to the same person since they found both cookies on one pc.
Well,then you said I will clear my cache and remove old cookies,but too late Ebay has already stored your old cookies on a cookie database!
Then it gets worse,you went to see your brother in law and logged on to Ebay using his pc and now Ebay throws your cookie on his PC,and so your brother in law is suspended because Ebay thinks your and your brother in law is one person,then your brother in law went to his sister and use her pc,you know the rest!

Poeple use to write books on how to start anew on Ebay after being suspended?or buy my good Ebay ID from me and then you can sell again?
But then they cant understand why it does not work,since it works at one time?
It will work,if you use a different address,open a new bank account under a new name,buy a VISA/MC under that name and change your internet service provider and last but not least-THROW YOUR OLD PC OUT THE WINDOW !
Just kidding about the last sentence !

The CC company does not Do a chargeback to the buyer.
Get the facts straight,
The buyer reviewed his cc statement and filed a dispute with his credit card issuer ,the credit card issuer will then file a chargeback with the merchant account provider of Paypal against Paypal.(Paypal given its size has more than one merchant accounts).
The merchant account provider (bank) will then notify Paypal a chargeback has been filed ,Paypal then notify the Ebay seller to gather all the necessary documents so it can forward them to its bank.
The bank will then present all these documents to the buyer 's credit card issuer which will review the case,it is a he said /she said situation.
The buyer credit card issuer will decide which side is right,the bias tends to favor the buyer ,its customer.
Whoever loses the case will pay the chargeback fee ranging anywhere from 10-125 dollars,in Paypal case,the fee I believe is $15,used to be lower !
If the transaction is with a buyer using a credit card issued by a foreign bank,it will take longer to resolve the case.
Paypal seller protection may nor may not apply,when it comes to large amount,Paypal is known not to honor its seller protection.
If the seller has its own merchant account,he can call his merchant account provider and speak to a customer rep and learn more about the other party,if he loses the case,he could appeal to VISA/MC/AMEX/DISCOVER but it would cost him a lot of money to do so.
But with most ebay sellers who do not have a merchant account,we have to rely on Paypal to present our case and hope its seller protection will cover our loss.
