Deal Divides Dems
The U.S. Senate is moving ahead with the business of populating the federal courts.
YEAH
Yesterday it approved, by a vote of 56-43, the nomination of Justice Janice Rogers Brown of California's Supreme Court to the U.S. Court of Appeals for the District of Columbia Circuit.
All 55 Republicans, joined by Nebraska Democrat Ben Nelson, voted "yes."
Then, as provided by last month's filibuster compromise, it voted for "cloture" on the nomination of William Pryor for the 11th Circuit; this will allow a confirmation vote today.
Considerably fewer Democrats voted to end the filibusters on Brown and Pryor than had on Priscilla Owen.
Here are the vote totals:
Owen (May 25): 81-18
Brown (June 7): 65-32
Pryor (June 8): 67-32
We initially assumed the relatively narrow vote for Brown reflected Democrats' view that she was not just "extreme" but really extremely extreme, because of her provocative criticisms of the regulatory state that keeps liberals' hearts aflutter. But the similar numbers in the vote on Pryor lead us to think that what's changed since May is, as we argued yesterday, that liberals have become considerably less enamored with the compromise.
Fourteen Democratic senators voted for cloture on Owen then cast what amounted to protest votes against cloture on both Brown and Pryor (15 if you count Wisconsin's Herb Kohl, who wasn't present for the Brown vote).
And what do those Democrats have to protest? A deal that, while formally keeping the filibuster alive, will make it very difficult to use, at least in this Congress (except in the cases of William Myers and Henry Saad, whose nominations the senators who signed the agreement are permitted, though not required, to filibuster).
The results of the Brown and Pryor cloture votes suggest that there are 12 Democrats who cannot be counted on to support future filibusters:
The seven compromisers, who are obliged to refrain from filibustering judicial nominees (Myers and Saad excepted) in the absence of "extraordinary circumstances." To determine whether such circumstances exist, they must rely on their "own discretion or judgment"--i.e., they may not simply vote the party line. If they do, the "nuclear option" is back on the table.
Three senators who voted for cloture on both the Brown and Pryor nominations, suggesting that they are disinclined, whether for reasons of principle or politics, to filibuster judicial nominees.
Two senators who voted for cloture on Pryor but against it on Brown, suggesting that they are somewhat disinclined to filibuster.

Yes, logansdad, but the only thing that is important is that she WAS confirmed...and now will be another non-liberal seated in our courts.

Linda, I wonder why you call her a "non-liberal". Is it maybe because you're reluctant to call a judge "conservative"? You're surely not prepared to make the case here that she isn't in fact conservative.

profe - The last two times I answered a question from you, I felt like I'd been hit with a 2x4 after reading your replies to me. I will give it one last shot...
I used "non-liberal" on purpose....to say that anyone that wasn't a socialist, a progressive, an ultra-liberal or a liberal...would be just fine with me.
Just as I have used Liberman when discussing a dem that I could have lived with him being elected. He's more a centralist...more to the center...not EXTREME left...and he's more grounded...more aware and willing to protect this Nation.
In using him as an example, I also believe many of the nominations that President Bush has made are not all what the main-stream voters would see as being a neocon-conservatives. And I don't see Judge Brown as one who has earned that label.
I believe the left doesn't care for her and didn't want her seated because she usually doesn't go with them on all these supposed 'civil right' violation cases or affirmative actions cases....when most expect she SHOULD because she's a black woman.
I like that she's been independent in that way.

What gets me here Linda, is the fact that you won't call her conservative. You and others have ranted about "activist judges" here before...trouble is, those judges you were ranting about were liberals. I guess you figure it's not activism if a judge's actions take an extremely conservative slant. The following is from Ted Kennedy's website, but I'll tell you, every point can be verified, every one documented.
A 1999 dissent drafted by Brown suggested that the First Amendment allows employees to use racial epithets in the workplace;
A Brown decision would have barred administrative agencies from awarding compensatory damages in race discrimination cases;
A Brown opinion would have struck down a law requiring paint companies to help fund treatment of children exposed to lead paint;
Rated "unqualified" by three-fourths of the state bar's examiners when nominated to the California Supreme Court;
Brown told a meeting of the Federalist Society that “where government moves in, community retreats [and] civil society disintegrates”;
Brown has said that government leads to “families under siege, war in the streets…”
Brown said that “when government advances, freedom is imperiled [and] civilization itself jeopardized.”
Brown told an audience that people of faith were embroiled in a “war” against secular humanists who threatened to divorce America from its religious roots.
Now, while I know you probably don't disagree with any of the points above, and frankly, I agree with some of them also, why do you avoid calling her conservative? I submit to you that if you were to do that, you know good and well that you'd be no different from those of us who would like to see liberal judges appointed. You're the one who's always lecturing us about double standards....my goodness!

Brown made that decision because she felt the 'free speech rights' of the accused had been violated.
But...of course your HUGE ted kennedy's website wouldn't be explaining why and on what basis each of those decisions she made. Won't work to their/your advantage to have ALL the facts involved be noted.

I figured you'd do two things:
1. Deny the points because they came from Kennedy's website, and
2. Claim "no double standard".

There are no "innocents" in war. Those bombs saved thousands of US lives and possibly a million casualties. I hope we have a president in office that would not hesitate to do the same again if the need arose.
edited to add: this is the one confirmation that I really wanted to see go through. See epitomizes everything America is about. Hard work and persistence can get you where you want to be.
