There is a person whose house was BADLY damaged by the hurricane a few years ago-one tree fell on the front lawn and broke the sewage pipe, all that #*!@ backed into her bath tub;her second floor windows were all blown away;her roof tiles were lifted and scatter all over ;roof leakings destroyed house contents, carpets were badly stained and fungus and mildew spread, etc etc.
Her insurance company sent her first check 91k (contents, temporary lodging and some structural damage),then she received a second check of 100k for contents and more structural damage.
The insurance company filed for bankruptcy and the state takes over.
She went after the state for another 100k,it dragged on until now and she now claimed her lawyer left out a piece of document and the state is going to settle with her for 60k (not 100k).
If my math is correct, thats 250k in total they are dishing out for her policy.
She had done some repair work but left most of the inside as is with mildew infested couches, walls and floor to prove her point.
The city has come around several times to ask when she is going to fix up the place.
The house is 28 years old,is she trying to have the insurance company pay her for a new house so she can sell it at a good profit??
Now she is devastated that she is not getting the entire sum,how much does it cost to fix up the place now that construction work has slowed to a crawl?
Does the insurance company have to compensate for all the damages incurred?
Since I have never have to file a claim(knock on wood),I have heard some said homeowner never recover in full from the insurer but I also heard some even made money from the insurance company?
Do household contents go by replacement cost?
Can we all have clothes and shoes from way back sitting in our closet plus pots and pants used daily and old appliances compensated as if they are like new??
I am not familiar with construction work, but is 250k enough(some went to temporary housing, aka motel),the house costs 150k 28 years ago,a 2 storey house with circular driveway.

It's not a scam, unless she's trying to scam the state for more than her house is worth. It's called life. It's impossible to know what her policy covered and to what extent she had contents covered. Policies vary greatly. Many just give a flat rate for contents, if you own more than you're covered for, tough noogies, shoulda updated your coverage before the bigg'n hit.

You are right,we have to review not just homeowner policy ,but health as well.
There is a salesman for Valero Energy Co who maxed out on his life time max of $1 million.
One million is not enough these days, you figure a person could have cancer in mid life and then heart or other complications later.
