It's bad enough that Supreme Court Judge Antonin Scalia has one son whose law partner is arguing the Bush case before him, but now CNN reports that a second son, John Scalia, "accepted a position with the Miami-based firm Greenberg Traurig on November 7. The next day, Barry Richard, a partner in the firm, said he was called about representing Bush in Florida." Richard argued the Bush case before the Florida Supreme Court and Scalia has struck down that court's decision in the case. This is beginning to stink, particularly since the AP has reported that"federal law says judges should disqualify themselves from cases in which their child is known to have 'an interest that could be substantially affected by the outcome of the proceeding." Applying the same criteria Scalia used to conclude that Bush would be "substantially affected" by the Florida vote count, it's clear that his sons would be "substantially affected" by Bush victories in the U.S. Supreme Court. It appears that Scalia, like Bush, believes that he is above the law.

Did he say "STARTING to stink"?

But seriously, there is something very fundamentaly wrong when sons and brothers and the kitchen sink are allowed to raly, to undermine another party...As a foreign-born, my "stary-eyed looking up" to this government has saddly tarnished.

Hello Krs,

This news, if confirmed, really is terrible for this country.

One expects the politicians to be partisan. One expects businesses to be interested in their own bottom line. One expects families to stick together.

One does not expect judges to make rulings when there is any hint that they are serving personal interests of any type.

Scalia should have disqualified himself. Or better yet, his sons shouldn't have taken jobs that put their father's integrity in question.

And it has nothing to do with Go Bush or Go Gore..it has to do with keeping politics clean...as much as possible...We look down on other countries for their lack of sophistication. Now, we are the laughingstock of the world...
This could have major negative impact with our future relations with the rest of the world. I have been here long enough to know that we have gone through many crisis before, but this somehow, seems so...base...

what has been the reaction of the press to this revelation? i haven't seen anything on this. shoshanah-have you taken a worldwide survey that causes you to say we are a laughingstock? why should we care about the opinion of those so ignorant as to think that? just maybe there are a considerable number of people around the world(other than the brits) who believe we are simply going through a longer democratic process because of a very close election.

This is true about Scalia's two sons. I heard about it this morning and researched it. I later saw it at www.cnn.com (direct link off main page). Here's what it said:

"Some Democrats raised alarms Monday because two sons of U.S. Supreme Court Justice Antonin Scalia work for law firms connected to the case. John Scalia accepted a position with the Miami-based firm Greenberg Traurig on November 7. The next day, Barry Richard, a partner in the firm, said he was called about representing Bush in Florida. A second son, Eugene Scalia, is a partner in the Washington office of Gibson, Dunn & Crutcher -- the firm representing Bush in the Supreme Court arguments. He is not involved in the case."

I'd like to think that our US Supreme Court Justices are non-partisan. But this just 'looks' suspicious. If you were on trial for your life, would you want the judge's sons to be partners in the law firm representing the other side?

I don't think so.

I'd say that Scalia was frustrated with Olson's weak arguEments, so he made the case for him. Check the first utterances of Scalia.
