Check out the bidbay thread called "answer please"...Someone is actually questioning whether Bidbay stole the AW templates and have been using them for quite a while. The thread might be pulled, so hurry up.
I wonder how long Bidbay had been taking advantage of AW's hard work in making those templates. Anyone know?

It's pretty amusing that people aren't quite clear on those templates.
For the record they are the property of AuctionWatch.com. I should know, I had a hand in designing them over a year ago. They were openly viewable on their servers at http://imagehosting.bidbay.com/templates/ until I told them to remove them, now they're just blocked from a browsing perspective. They're still integrated into their selling form and still being served from their servers.
They copied all of our templates over and are actively using four of them.
I was fortunate enough to download the entire directory and have passed them onto our corporate attorneys for handling. Here's a beauty:

From our thumbnail page, viewable from the create auction process in Auction Manager. Go to create auction, then change template to view them all:
Now if you've got good vision take a really close look at that bidbay thumbnail above, or at the same thumbnail live on the bidbay.com site (until they read this, then they'll probably rush over and fix it.) See anything? That small logo on the bottom of the template is actually our old "powered by auctionwatch.com" logo, which we removed from the templates but hadn't gotten around to removing them from the thumbnails. Here's what it looked like:
Note to bidbay: when running off with other people's hard work be sure to remove their logo from it first.

Holy Cow, Mark!! I'm sure you don't feel so good when someone takes advantage of your hard work.
The question that comes to mind is ethics. How can a site that keeps bragging about community, try to pull a fast one like this? I can't believe the things that are going on there.
The ramifications of this issue can be big! But it really depends on what AW plans to do in the legal department.
Mark, do you know how long Bidbay has been using these templates? I think someone said they're seen it for some time.
Talk about eggs on someone's face. Maybe there'll be a press release on AW about this.

If you are "Dead serious" then maybe you could shed some light on just how Mark was able to go into bidbay's servers and place AuctionWatch logos on all of the images???
I realize that you are a fan of the site. It is very obvious. Now why don't you read some of the messages that have been posted here about that company and intelligently discuss them instead of yelling "They're the best!" I think that you are doinbg more harm than you are good for them by acting this way.
Just a thought, but I'm sure you will come back with some statement about how I am evil and I will get mine or something like that.

Having an interesting or rational conversation with Blondie about bidbay, is like having a battle of wits with an unarmed person!
I do not know at all if this is at all true, but someone said somewhere,(I don't recall where but I have it all saved to disc someplace) that she is the owners daughter, or some relative.

Mark, I apologize, Of course there are several users over there using "AW" templates if Bidbay put them on their server..I was laughing so hard at Blonde's post I had to go back a read again your post to catch my mistake after I posted...
I am sure your attorney's are going to have fun with this one..I hope that "AW" will kept it's members posted on how this is coming along..Good Luck to you....

yes, some auction sites have a lot of invisable girls names that post to their own site or other forums. supportgirl,jessesdreams,auctionboy..
. pretenders wishing they were contenders and always trying to misguide the readers and many readers fall for their mistruths.
It is the readers and users fault for keeping these sites alive, wake up and dont be blinded by the light.

Could somebody please direct me to somewhere where I could read anything in the user agreement or elsewhere on AW concerning their "copyright" to these templates? I just can't find any statement saying that these templates "belong" to them. In different scripts, html code, & clipart...there is typically a copyright, if it has one, in the actual html, etc. I can't find ANY copyright of AW. Not trying to start trouble or anything...just trying to get some clarification.
I'm sure if there is or was a copyright to the templates, action by AW towards BidBay would've been taken LONG AGO. JMHO

Well if you look closely at Marks pictures he has posted you can see the Auction Watch Logo on BidBay's templates.
I think that speaks volumes.

Yes, I saw that...but what I'm asking for here is some sortof statement. I've read the user agreement over & over & can see no such statement, so as far as LEGAL copyrights go, there is none that I can find.
I can go put a logo or state "powered by maghya" on anything I want, whether I created it or not, but that does not really mean "copyright of maghya".
I can't find anything here on AW about these templates (i.e. disclaimer of use, copyright notice, etc.).
Also, as I stated before, if there was a true copyright violation on Bidbay's part, don't you think AW would've approached BidBay about it LONG AGO when the templates were first introduced there? I really don't think that AW relies on their members to keep them abreast of this sort of thing.
Personally, I think if it were a TRUE violation, it would've been dealt with already.
Again, JMHO.

FYI: This is NOT the first theft by Bidbay from the Auction Watch site. When they first posted a formal chat TOS, they forgot to remove the words auctionwatch.com in several places and replace it with the Bidbay.com. This blunder was pointed out on Bidbay's OWN chatbaords!!!!! They are not very detail oriented when it comes to their cut and paste work...

I think if you look close enough to the thumbnail versions on BidBay's website you can see the Auction Watch logo.
