He filled out my vendio check out and then paid with paypal using a confirmed address which is his old address. I shipped to the confirmed address and it shows delivered. His (old) roommate said he never got it and it wasn't forwarded to the new address as it should have been.
He didn't pay insurance (silly on a very breakable item) but I insured for $49.99 on the $56.00 item.
I now have a notice in my WBN stating that if the vendio address is different than the paypal confirmed - it is the winner responsibility notify me by direct email but this item was a relist and that wasn't in the notice.
What a mess - I don't even know if insurance will pay?

Yea, it sucks. Been there, done that (shipping to the wrong address that is). And I don't think you will get anything out of insurance either since it shows as delivered.

I'm not sure how to file the claim but I don't see why USPS won't cover it as they should have forwarded it or sent it back to me. Also the old roommate would have shipped it on to him if he had gotten it - so it was most likely stolen off the door steps.

Ahh, but I think the USPS's responsibility ended when it was delivered to the door step. What happened to it after that has nothing to do with the USPS. If you had wanted the guarentee it was delivered to a person (not just a location) you would need a in person type service like signature confirmation. That way if the person is not home they have to go to the post office to pick it up.

Your claim might be worth a shot but I get the feeling it will be denied. Can't hurt to try though.

I purchased insurance from USPS for loss or damage?? The fact that they choose to leave an insured package on the door step is beyond my control?
I filed a claim for $45.00 for a lost package before and got reimbursed including postage which you don't get in the case of damage. But that was before online shipping labels?
Has anyone been denied for lost of a package under $50?
Why do we brother if that's the case?

Did your buyer file address change with the post office?
If Paypal is showing his old address as confirmed address,it tells me he is still sending his credit card statement to his old address,so why should it be your fault he does not get the package?
And since he did not pay for insurance,what does he expect you to do??

If I open a letter addressed to someone else, it is a felony. But an ex-roommate can get away with interfering with the US Mail? I don't think so. Notify the postal inspectors.

Mail theft is mail theft, it does not matter when it occurs. It is a violation of the law to interfere with US Mail reaching it's intended recipient. There are exceptions for bulk mail and if you have a signed agreement with a third party.

parklane64 - USPS and USPIS are two whole different monsters. The USPS does not investigate postal mail theft, the USPIS (U.S Postal Inspection Service) does. You can report mail theft to the USPS but it get's sent directly to the USPIS for investigation. Remember, we were talking about "insurance" and not "mail theft".

Another thing to remember here is that it was only insured for $49.99.

DMM 503.4.5 An item insured for $50.00 or less is delivered as ordinary mail. Delivery of insured mail is subject to 508.1.0 and 508.2.0 .

My wording in the previous post of "on the door step" was not well chosen. Mail carriers can not leave parcel items "on the door step" unless you have given written authorization to do so in releasing the USPS and carriers from all responsibility of such articles, or the parcel is marked by the sender as "Carrier - Leave if No Response".

Does this "roommate" live on a college campus? If so, the package will probably be at the campus P.O. If it is an apartment complex, have the roommate check the manager's office. It could have been delivered there if no one was home to accept it. Also, what does the DC number show when you run it?

I'm not sure but I know he's still in touch with his old roommate and must trust him that he doesn't have the items.
He's really bummed out because he's been looking for this item for 2 years. I bet his address is correct with paypal NOW.
I'm just tried of this happening and then the customer trying to put the blame on me. Short of stopping my Vendio WBN and check out button - not sure what else to do?
