I agree with Stavecards. I am not an attorney, is anyone posting here? So, what we say does not matter. The case has not been thrown out yet and is very much a real case. This part is FACT, not opinion.

It's possible the case hasn't gone very far yet. Just because the case wasn't thrown out of the court when it wasn't first presented doesn't mean that it has a chance to succeed in court. My gut feeling is that BV doesn't have a chance in hell to win and they will get stuck with the legal fees for both sides for their efforts.

At the pace that I have usually seen corporate lawsuits like this, I would agree that this case is probably in its preliminary stages. My point was that I am speculating that there is at least enough credible evidence, particularly some signed documents, not to have been thrown out of court by now. If there was just verbal discussions, I would speculate that a judge would have already thrown it out of court. Who knows if Bidville (really AuxPal) has enough evidence to really win the case? Very likely we won't know for a couple of years the way these cases drag on and on. However, I do find it interesting that PayPal issued an apology. Usually you don't see something like that unless a settlement is on the horizon.

There was a BidVille apology to PayPal on their site a while back ( since deleted ) on the BidVille Announcement Board that said something like "we didn't want to infer in any way that PayPal was a bad service or bad in any way and the sellers that accept this form of payment due to our lawsuit against PayPal."
As to a lack of a signed document, I remember an interent love story gone wrong severals years ago where a lonely Montana rancher had met a lady on line and they corresponded via mail and the rancher made the error of saying he wanted to marry her and live with her forever even though they had never met. When they did finally meet they found that they were not suited for each other. The vindictive women took the lonely rancher to court for half of his ranch because he implied they would be wed. A totally ridiculous claim but some odd judge let it get past the filing stage and the case made it to a court docket and a lot of press releases ( the internet was much newer then ).

They should apologize. It was paypal's fault that Bidville didn't get off to a faster start. BUT things are really picking up now. Bidville will be #1 by the end of the year.
