I personally will not and do not pass on any fees for accepting credit card payment from buyers at all.

I dont know what the ruleing is if its legal or its not legal and I dont really care for that matter.

PAYPAL is not the only credit card service out there other services are FREE USE them why offer paypal if you Wont be responable for there fees.

by the way only deductable Items for taxes for sellers are the fees they actually pay them selves there for shipping paid by the buyers and bidder is not a tax break for sellers you need to prove to the IRS you actually paid actual fees if your listing and EOAs say buyer pays there is no deduction you already got your break when the buyer paid you the fee for paypal shipping or other fees.
