Man that is SOOO true. I always figure the person just feels so guilty that they can't stand it, so YOU have to turn into the bad guy. It's really sad when someone has to live their life with good guys and bad guys and can't just 'fess up to their mistakes. Heck, maybe the person in this case thought that since they helped you, you wouldn't mind, or wouldn't notice or care. You didn't do anything wrong and I hate to see you beat yourself up over it when the other person was clearly being irrational. I have been in that boat too! so just report it and cross that irrational one off your list.

Hi:

As others have posted here, it is illegal. However, you are probably dealing with the sort of person I like to call, a "wacko".
The wackos of this world are rude, missing some brain cells, and react in a threatening manner (i.e., never email me again! get professional help).

It's actually the wackos of the world that need to get professional help.

I'd ignore this nutcase - it's not worth the aggravation in dealing with this person - is it? Remember.....what goes around, comes around.

Ijust received an e-mail from Safeharbor that they mailed the following to the person:


[email sent by eBay to user]

We have received a report from another user that your auction listings:

such use could be a copyright or trademark violation. Since we are not
in a position to judge whether these claims are true we have not ended
your auction. However, we invite you to review our new Copyrights,
Trademarks & Your Listing guidelines found at:http://pages.ebay.com/help/community/png-copyrights.html

This page provides helpful information regarding the laws regarding your
auction listing. If after reviewing these guidelines, you believe
changes to your listing may be appropriate, we encourage you to:

(1) edit the listing to remove any objectionable links or material, if
no bids have not yet been received;
(2) end the auction early yourself (links below); or
(3) change the photograph that you have linked to in your auction.

The complaining party may request a Notice of Infringement. If
objectionable material is not removed, they have the right to submit the
Notice of Infringement, under penalty of perjury, and request to have
your auction ended. If we were to end your auction, you would, of
course, have the right to appeal their request. Keep in mind that your
account can be suspended for violations of eBay policies.

We understand that the laws governing use of materials found on the
internet often are confusing and unclear. We trust that our guidelines
along with this email will assist you in evaluating your auction

They also say:

If you still wish to request the removal of a particular auction, please
email us at [email protected] and we will send you a Notice of
Infringement form. That form will require you to state under penalty of
perjury that you own or control the content and that you have a good
faith belief that the material you identified violates your copyright or
trademark rights.

It is not worth going any further with this her/his auctions have ended. She/he listed some more of the same items and the description is changed; in one of the new auction the same picture as the one that just ended is used and I am still fairly sure that it was one of mine. I just hope the winning bidder makes sure that the advertised item and the picture are the same which I very much doubt(I guess she/he is into false advertisement too).Man when I think through how much trouble I go to scan in every single item, even if it is let's say the same book, but there are usually slight differences in the condition of the cover etc.

I see this as part of doing honest business dealings with a lot of interested people, and I have the feedback and a lot of lovely letters from buyers to prove it.
