All anyone has to do is read what your son Bear's first few posts are to see how he was trying to lie and deceive people.

All America knows BUSHY had the power to keep the 2 Border Guards out of jail any time any day but DID NOTHING.

What a fake this guy BUSHY is wants us to believe he is all for our troops,police and firemen but lets these brave border guards set in jail.

Who else thought in BUSHY's State of Union speech last night BUSHY was saying the U.S. should have private mercenaries?

Report: Drug agents lied, destroyed evidence

EL PASO — [b]A federal report released today on the shooting of a suspected drug smuggler by Border Patrol agents concurs with prosecutors that the men committed obstruction of justice by failing to report the shooting, destroying evidence and lying to investigators.p/b]

Conservative members of Congress have criticized the case against the former agents, who were fired after their convictions, saying the men were doing their job when they injured Osvaldo Aldrete-Davila in 2005 near El Paso.

The U.S. Department of Homeland Security report on the investigation was drafted in 2006 after Ignacio Ramos and Jose Alonso Compean were convicted and each was sentenced to more than a decade in federal prison. The 77-page report was made public today and offered few if any new details on the case.

The report, which is heavily redacted of names and some specific details, primarily outlines what Aldrete said happened on Feb. 17, 2005, as he tried to run from Border Patrol agents after trying to elude them in a van loaded with marijuana.

According to the report, Aldrete, who was given immunity and has filed a multimillion dollar claim against the federal government, told investigators he was unarmed and shot as he ran away from Compean and other agents. He said he tried to surrender and ran again after Compean slipped while trying to hit him with the butt of a shotgun.

The report also notes that other agents on the scene that day could not confirm whether Aldrete was armed and initially lied about whether they were aware of the shooting. They later cooperated with authorities. Those agents, whose names were removed from the report, were not prosecuted.

A spokeswoman for U.S. Attorney Johnny Sutton, whose office prosecuted the case and who has been widely criticized for pursing the agents and not the drug dealer shot, declined to comment.

Lawyers for Ramos and Compean did not immediately return phone calls seeking comment.

A spokeswoman for U.S. Rep. Dana Rohrabacher, R-Calif., said the report only bolsters the congressman's support of the agents.

"The OIG report has just emboldened our position because there is nothing in there that indicates these agents were not justified in shooting this individual," said Tara Setmayer. "This finally sheds some light on what these agents were thinking."

She pointed to Compean's written statement which she said reflects that he "clearly believed the drug smuggler had a weapon and feared for his life."

Two Texas congressmen said the office of inspector general for Homeland Security told them the report would say that the agets planned to "go out and shoot Mexicans" on that day.

"The congressman is absolutely unequivocally not happy about the fact that what he was told was in the report, is not in the report," said Jack Hirschfield, a spokesman for Rep. Michael McCaul, an Austin Republican.

"So far it looks to me like Agents Ramos and Compean may not have followed proper procedure following the shooting, which at most should have resulted in their suspension from the force, but not criminal procedure," Rep. John Culberson, D-Houston, said in a statement issued this afternoon.

Sen. Diane Feinstein, D-Calif., also asked Senate Judiciary Chairman Patrick Leahy, D-Vt., to pursue a Senate probe of the prosecution and sentencing.

Rohrabacher and others also criticized President Bush today for not pardoning the agents.

Ramos and Compean were sentenced in October and reported to prison in January. Reports were released Tuesday that Ramos was attacked in prison in Mississippi on Saturday night after the airing of an episode of America's Most Wanted that highlighted his case.

Compean is jailed at a federal prison in Northern Ohio.

Mexican drug cartels operating in cities in the U.S. are buying up legitimate businesses to launder money and using some proceeds to win local mayoral and city council seats for politicians who can shape policy, personnel decisions, and police forces. Hey Bear,is this the reason border control agents must look the other way or suffer the consequences?

Mexican in Border Patrol Case May Still Face Drug Charges

(CNSNews.com) - The Mexican suspected drug smuggler granted immunity in the controversial - and politically explosive - prosecution of two U.S. Border Patrol agents is not entirely off the hook].


U.S. Attorney Johnny Sutton, the man at the center of the row over the prosecution and jailing of the two agents who shot the illegal immigrant, confirmed to Cybercast News Service Thursday that there is an ongoing investigation into Osvaldo Aldrete-Davila and others.


Aldrete-Davila had been driving a van containing 743 pounds of marijuana on Feb. 17, 2005, the day border agents Ignacio Ramos and Jose Alonso Compean shot and wounded him as he fled on foot toward the Mexican border.


Sutton gave Aldrete-Davila immunity from prosecution in that drug-smuggling case in return for his testimony against the pair.


But amid the political row over the case, one allegation has been widely reported but never established: that Aldrete-Davila had subsequently - in October of that same year - tried to smuggle another 1,000 pounds of marijuana into the United States.


Critics have accused Sutton of being so zealous in the prosecution that he offered the Mexican further immunity for this second alleged offense. Sutton has denied this.


Pressed on the matter Thursday, the U.S. attorney worded his response carefully.

"If an allegation of drug smuggling is made, we're investigating it, and that includes the allegation made in this case," he told Cybercast News Service.


"If we have sufficient evidence to prove a case against a drug smuggler - including Aldrete - we will bring it," Sutton added.


"If there is a provable case against Aldrete, we will bring it as we would any other drug dealer," Sutton added. "He does not have immunity for anything other than his truthful testimony."


However, Sutton insisted Aldrete-Davila was neither arrested nor indicted prior to or after the shooting incident, a statement the Border Patrol agents' union contends is false.

"There was no secondary arrest. There was no secondary indictment," Sutton said of the allegation reported numerous times in the media.


This possible second charge did not pertain directly to the case in which Ramos and Compean were sentenced to 11 and 12 years respectively for shooting at the illegal immigrant.

But the claim inflamed an already outraged public who questioned why a drug dealer would be set free for even one offense while border agents are jailed.


'Sealed indictment'

Members of Congress have called for hearings on Capitol Hill to investigate the case, while the agents' union, the National Border Patrol Council, is calling for a special counsel independent from the Justice Department to investigate Sutton.

Two resolutions were introduced in the House this month - one to vacate the conviction and sentencing of the agents and another calling on President Bush to pardon them.


The National Border Patrol Council insists there was a sealed indictment against Aldrete-Davila for smuggling the 1,000 pounds of marijuana.


Another individual indicted in that drug seizure was called as a witness for the agents' defense but was not allowed to testify because of a sealed indictment and an ongoing investigation, the union says.

The union further contends that U.S. Drug Enforcement Agency officials involved in the seizure of the 1,000 pounds of marijuana were not allowed to testify in this Ramos-Compean case because of an ongoing investigation that could have been compromised.


Given the secrecy and gag orders on the case, Cybercast News Service asked the union about its source for the claims about a second drug offense.

"The agents, before they went to prison," said union President T.J. Bonner. "They felt free to talk without being held in contempt of court, because they were going to jail anyway."


Bonner believes the prosecutor is being disingenuous to claim there was no arrest.

"He's just being very cute," Bonner said. "Because the indictment was expunged, he's pretending it was never there."


Sutton stressed that he was limited as to what he could say regarding any ongoing probe.

"There's an allegation that were discussed at the [Ramos-Compean] trial among lawyers that I can't go into beyond that," Sutton said.

"Lawyers for both the defendant and the prosecution who tried the case and the judge had hearings on those cases and rulings were made," he said.

"All decisions about what evidence comes into court was discussed among the lawyers and the judge, and the judge made the rulings about what evidence comes into court in the trial," Sutton said.

He said the character of the smuggler did not alter the fact that the agents had committed a violent crime.

"All of the discussion of bad acts of the smuggler were litigated at trial to determine what was admissible and what was not," Sutton said.

"He was cross-examined for many hours by defense attorneys. The jury was very clearly aware he was a dope smuggler, an illegal alien and a bad guy that runs from the police. That was all clear at the trial," he said.

DHS Inspectors Admittedly LIED to Congress About Border Patrol Case


Congressman John Culberson (R-TX) announced today in Houston, TX that DHS-Inspector General Richard Skinner admitted that his deputy inspectors Lisa Redman and James Taylor as well as DHS congressional liaison Tamara Faulkner LIED to members of Congress about statements affecting the case of Compean and Ramos.

U.S. Department of Home Land Security admits they lied to congress about the facts in the Southern Border Guards case.

Now super new-con Bear sides with DO NOTHING Bushy that leaves the Guards in Jail.

Bear is also against the efforts of 50 republican lawmakers that want these Guards released from Prison.

Bushy's government is so bad that guys like Bear don't know what way to turn.

I am betting a wide open border and lots of drugs flowing is good for the GUN BUSINESS am I right Bear?

If misconduct have been found in the case, it is cause for an appeal. There is a process in the legal system for that.

Efforts to stop smuggling and illegal immigration have led to increased violence along the southern border of the United States as criminal organizations seek to continue their operations, Michael Chertoff, the secretary of Department of Homeland Security, said today.

Testifying before a House Appropriations subcommittee, Mr. Chertoff said the department planned to spend $1 billion for technology and fencing to secure borders and $778 million to hire 3,000 additional border guards to further tighten entry into the U.S.

He said the increase in violence was a natural consequence of these efforts, as smugglers of both people and drugs try to defend their businesses against the increased enforcement effort.

Representative John Abney Culberson of Texas talked of a “dangerous and lawless” border area. He said it was like the old-time Indian country “except the Indians have machine guns and satellite phones.”

He said some smuggling organizations had established observation posts on hill tops within the United States to spot law enforcement activities, including watching National Guard units deployed along the border. Some police units were reluctant to turn their lights on at night because of the observers and armed smugglers.

Hey Bear, how is business brisk I would think. If I were you I would be looking into another business. I fear restrictions on selling guns might get a lot tougher in a couple years.

After all not only is violent crime up along our southern border under BUSHY but its up across the country.
