Ebay has responded to my email I sent them last night:

Thank you for taking the time to contact us with this information. I understand how this situation could be of some concern.

Even if this person did contact his brother-in-law, there would be nothing he could do. As you point out, you have done nothing wrong and eBay has strict guidelines in place for employee conduct.

This situation does not constitute extortion. You might ask this person to check with the bank or the post office regarding the payment. I know that because of the holidays and the bad weather in many parts of the country, this piece of mail may not have left the post office until Tuesday the 2nd even though it was mailed on December 30th.

Well, he never responded to my email of last night. Yay!!!

I told him when and IF I receive his payment I will email him and let him know, so there's no need to email me every single day. I so far have received 13 emails from this guy.

I do not take it personally unless the percentage of "idiots" exceeds 2%. That seems to me to be about the number of buyers who are lacking touch with reality, whether criminally inclined or just "not in step with the rest of the universe." I am quite happy selling to the other 98%!

Nope, don't have anything like that to send with his shirt. But I did order a pizza last night so I have a used pizza box. I could always mail his shirt in that - I've heard rave reviews on this board about that packaging method....LOL

Apparently, the "Pizza Box Packaging" technique is no longer a secret- I received an item yesterday packed in one.

Sounds to me like this poor dude needs to get a life. Maybe he should go to work at e-Bay with his so called brother inlaw and maybe he would get an hour lunch break. I had something like this happen to me in Dec. Auction ended on the the 7th and I received the check on the 26th. Auction staed must be paid for within 7 days of the close of the auction. I sent the check back to them. I dont have time for this type of stuff and I am sure you dont either.

Deerhunter: My auctions also state payment is due within 10 days after auction end. However, on the 11th day (providing there were no holidays in between) I file for my NPB alert. On the 20th day if still no payment I file my FVF's and relist and NEG the bidder. So I really give them 20 days to pay for their item.

If a customers needs more time I'd be happy to wait longer as long as they were upfront with me. But I have no tolerance for the ones who are demanding & rude (like this guy) or people who just outright lie to me about sending payment.

Sounds like a guy who won one of my auctions months ago for a t-shirt. Same daily emails about not receiving his order. I too politely told him that I would ship the same day as his payment came in. Then I got the email that I had one more day or he would leave negative feedback. Sure enough, the next day he left me a neg. Two days later, his payment shows up. It went out when he said he mailed it, however, the dummy had the wrong address on the envelope. The post office was able to track me down via my business name. I sent his payment right back to him along with his original envelope showing him that he was responsible for the mail delay. I've just learned that you will run across people like this from time to time, and not to let it bother you too much.

Celebrity: I just checked to see if it was the same person - sounds just like him! But nope, he hasn't left any negs as of yet (at least on his one screen name that I know of anyways).

Have you done an eBay search for his personal info (name, address, telephone #, etc.)? For some reason this tends to back down bullies like this when they know that you know who they really are and they're no longer a "virtual being". Chances are this guy would never be harrassing you like this if he had to do it face to face or over the phone.
Let him know that you will ship his item as soon as you receive the pay't and are notified by your bank that his payment has cleared - something you would do for any other transaction. Then if he ever wants to know why you requested his personal info from ebay, just tell him that you wanted to be sure that you had all of his information so that when his payment comes there is no possibility of applying the payment incorrectly and delaying shipment. ABSOLUTELY get delivery confirmation and advise him that if he didn't pay for insurance you are not responsible for non-receipt of the item. Delivery confirmation will not get you reimbursed for a lost shipment.

Well, here's today's update.

I live in NY.

I received 2 payments from CA that were postmarked 1/5 (today is 1/8!)

I received payments from TN, TX, UT, NE, and more that were postmarked 1/5 and 1/3. (NOTHING BEFORE 1/3)

BUT - no payment from FLORIDA that was supposedly mailed out on 12/30.

I can feel the headaches starting again! I told this joker when and IF I receive his payment that I will email him and let him know - like I do with all my customers.

So I'm not going to email him. BUT - if he emails ME (like I have a bad feeling he is going to) I am going to tell him about my payments from CA that reached NY in 3 days and that I have NOT received his payment.

His payment is now 5 days late.

My question to you guys: Should I start the NPB process now? Is it too early? (My luck his payment will come in tomorrow) - however I really have a feeling he never sent payment.

Your suggestions?

Well Exec Girl, I'm not sure, cos I've been lucky enough so far to not have to NPB or even neg anyone yet... obviously I'm still pretty new here. But personally, I'm thinking I would probably do the NPB thing now. It's been fifteen days since the auction close for cryin out loud. And he's harrassed you the whole time for an item he still has not paid for. By the way, is it all clothes you sell? I am always curious to see what my new friends here are doing. If you want to, email me your auctions, neighbor girl! [email protected]

Hello ExecutiveGirl,

Have you done a search on this bidder for all auctions they have won in the past few weeks?

Perhaps this is a scam. User builds up enough feedback to appear genuine and then goes on a buying spree. Emails all the sellers that payment is in the mail and where is the item?

Perhaps enough sellers will just ship in order to get the pest out of their inbox.

Pest never does pay and simply moves on to another userid once eBay catches up with the shenanigans?

Well, I just got today's mail. NO PAYMENT from this guy. Plus, since I told him the other day that I wasn't going to tolerate his threats, etc. I have not heard from him in 2 days!

Off to file my NPB alert on this guy!

Ok, this is beyond rediculous.

I filed my NPB alert this morning.

NOW, I just received his email:

Did you get the check?

AAAAAAAARRRRRRRRRRGGGGGGGGGGGGHHHHHHHHH!!!!!!!!!!!!!!!!!!

I responded:

As a matter of fact, NO I HAVE NOT. I have received payments from CALIFORNIA (to NY) that were postmarked 3 days ago. So let me ask you - WHERE IS YOUR PAYMENT?

I just don't know what else to do about this guy.

Another email from him:

[b]My payment was sent out the previous saturday. You should have received it by now.
If you do not send out the shirt, I will send another email to ebay.[/b]

To say this guy is driving me nuts would be an understatement.

Sheeeeeesh!! I can't believe this guy!! He can email Ebay or God or Santa Claus or anyone else he wants, that doesn't mean he should get a shirt when you have not received payment. Good luck Exec Girl. I can't wait to see how this one ends. On the edge of my chair...

For some reason this thread has me thoroughly entertained. I have to check it 3 times a day to see if you received this guy's payment yet. (I've got to get a life.)

Anyway, my response to his last e-mail would be "Yes, I should have received your payment by now. But...I haven't. I'm sure you understand I will not ship the shirt until I have been paid for it. You may continue to follow up on your payment with the post office, however I am cancelling this sale."

Add a "don't bother me no more" or other snappy line and we'll be done with this. My entertainment will be over. (This is where I would insert a sad face graphic, if I knew how.)

But, don't despair. I have just closed an auction with a buyer that seems to be playing with a 48-card deck. That might end up being fun.

Ok, here was my response to his last email... brace yourself.... lol

You do what you have to do. Do you honestly think ebay expects me to mail out your item when I didn't receive a payment from you? Ebay will do nothing unless you show them PROOF of payment, which is a CANCELLED check or MO - and since I have received NO payment from you there is absolutely nothing you can do. Your threats are harmless. Is there a reason you choose not to have this check traced? Anyone who sent payment would have had it traced by now. I really have to wonder why you refuse to have this payment traced?

By the way, I already wrote to ebay regarding your threats. Here is what they had to say:

I would not ship until I receive payment. He can do whatever he wants to do but I would not ship until I receive payment.

I seriously doubt that he has any relatives working for eBay.

I think he's lying. I think he's trying to scam you into giving him something for free.

Considering the buyer has 14 postivie feedbacks (and you have to take all things into consideration)...I would answer his emails politely, but would file a non paying bidder alert at the earliest date, think that is 7 to 10 days (assuming you have not rec'd payment by then). That does not hurt the buyers record, may upset him some. it also might "light a fire" under him to get payment to you. I have had buyers tell me they put the check in the bin with old newspapers, and their mortgage check, etc. at any rate, after the non pay bidder alert, at least you are able to file a for a refund from ebay within 10 days after that if he has not paid. i think you are on the right track! good luck....

jerseylily: On the 15th day after the auction ended I already filed a NPB alert... but he continues to be a jerk and tell me to mail out the item before receiving his payment he "says" he mailed out on 12/30.

Exec Girl,

While you are anxiously awaiting this person's next email why not use eBay search to see if my theory about a possible scam bears out?

I'm am really intrigued at this point. If you like, email me (check my profile) with your "buyer's" eBay userid and I'll poke about as well.

I find it hard to believe that someone who has built up some decent feedback would turn around and be so insistent about your shipping the item when you continue to tell them the payment has not arrived.
