OK I NEED SOME HELP PLEASE
This is the situation, I has a seller email me 3 days ago telling me she did not bid on the product...and was not going to pay. Well i thought it was a closed auction so i emailed her and told her that if she was the high bidder she was the winner..
Last night was the time the auction close and after 3 hours from the time of the closed auction she neg me ???? The reason she gave in the feedback was that she was upset with the message i gave her 3 days ago.
I emailed her and asked her to expalin??
"This is the letter i got back from her!!!I submitted a bid on a mirror with sun/stars frame...NOT THIS product you now say I won. I DID send you an email the other-day, trying to EXPLAIN I DID NOT bid on this item/nor do I want it shipped to me.........and you told me 'sorry, you won it, if your highest bidder'?! I do NOT know how I ended-up with THIS item as my winning (the CELTIC mirror........which I do not like @ all) ........................perhaps is some mix-up..............but, I do NOT want to purchase it. 'Thank-you'........hope this explains it all...."
So i fired off a letter to ebay safeharbor. with this letter enclosed and expalined the best i could...the letter i gave her and ebay is this
To Safe Harbor:
This case involves bidder leaving negative feedback three hours after auction closed. Bidder claim that they never bid on this item but bid on another product. Link below shows this is not true and they knowingly bid on this item #5735335XX.
Their email response is included in email history.
Bidder had the chance and choice to RETRACT bid for 3 days, but instead chose to continue the auction and left negative feedback hours after auction ended. The feedback was related to a email sent to me 3 days ago from the bidder stating she did not bid on the product and was not sure who or how she could have??. The negative feedback given to me by the seller is not related to the purchase and is related to the email sent to the seller three days ago. This is grounds for removal because it does not relate to the auction. This is a guote from your feedback policy "The feedback, on its face, has absolutely no connection with eBay. If read the letter given to me buy the bidder below you will see she is giving negative feedback related to the email sent to days ago
Please help rectify this situation since I believe it was unfair and unjustified.
Thank You.
To Bidder:
Hi! You have put me in a predicament here that is entirely UNFAIR to me. You have given me a NEGATIVE feedback unfairly and without a justified reason.
You said that you did not bid on this item (#57353352XX) , then, please explain to me how your name came up as the highest bidder on this item?
You said it could be a mistake. I did a little investigation and looked up your bidding history and none of the bids that you
placed is a "mirror with sun/star frame".
The link below will take you to your bidding history:
The way you can bid on a product is:
A..) Insert password
B.) Click Enter
C.) Screen shows what you bid on and that you are the highest bidder.
Again, you will claim that it was a mistake. Then, why did you NOT RETRACT the bid?? You had three days to do this.
Instead, you chose to give me a negative feedback after the auction closed.
This is UNFAIR and unjustified. This is how I make a living and you may think that it is only "words"..but it affects my business and how my company is perceived.
Instead of admitting that you may have possibly bid on the wrong product, you have made it look like I forced you to purchase this item and therefore gave me a negative feedback.
And on your e-mail, you casually wrote that perhaps this is all a mix-up and hoped that your e-mail explained it all??
Explain to me please HOW I DESERVED A NEGATIVE FEEDBACK?
Please contact Safe Harbor and make them aware of your mistake. I have contacted them as well and they will create a file on this situation.
Well last night my letter went out threw vrane auotmated service..and her's was included. She emailed me back this morning with these letters
"Please stop emailing me...I now consider it a harassment/will report it
to ebay....'thank-you'!"
then this one
Noooooooooooooo...NOT onterested in this UGLY mirror to
purchase....................!
then this one
I have placed bids on ebay over last sev days, but then was out-of town, so wasn't able to scan thru "my ebay" page, to be sure just whatever I WANTED to purchase was only there...therefore, was why I had quick emailed you BEFORE the auction ended...but got a neg reply/uncalled-for............
Don't worry, I am deleting my user-Id from ebay.............have had enough of this.
"THANKS" so much, for your miserable hassle................................................'bye'!
NO MORE OF EBAY for ME!!!!!!!!!!!!!!!!!!!
NOR will I respond to your emails any further.............your being SUCH a hassle...........so relist your item
PLEASE HELP ME FELLOW EBAYER..I HAVE A GOOF BALL HER ...AM I DOING EVERYTHING RIGHT???

If she removes her ID then the neg will revert to a neutral...
Break out the party hats!
She sounds like a scattershot newbie who expected to be outbid?
Or doesn't know how to watch an auction?
Or just has buyers remorse.
What is her feedback?
What else has she bid on?
I didn't jot down the auction #.
If she NARU's then, great.
What's your feedback range?
One neg won't kill you.
Just reply calmly.
Neg her calmly, too.
"Did not complete transaction. Refused payment. Avoid."
I doubt if ebay will remove it, but good luck.

---why didn't you cancel her bid after she she sent you the letter saying she didn't bid?? she was obviously going to be a problem---and the solution was to get rid of the problem rather than wait for her to do it.............

I would pray for the cleansing rain of NARU.
And have a handy "About Me" page with friendly contrition to future bidders.
There are a couple of sellers I have run across who have done it. Seems to work for them, spanking hot sales and lots of feedback between "that was then and this is now."
Good luck!

Hi eastwest
I really doubt that there is anything more that you can do on this. You can plead to ebay but good luck.
Your bidder seems to think that she can pick and choose her items. If she continues to do this she will be gone soon anyways.
Sorry that this happened to you. If it makes you feel any better I will say that I looked at your website yesterday and it looks very good. Your prices are excellent.

capriole -- negs are NOT changed to neutrals anymore (and haven't been for a long time) when a user leaves eBay or becomes NARUd.
eastwest -- best leave it alone. Contacting other sellers/bidders is not a good thing. eBay may remove your feedback (not likely though) but anyone reading it will see it for what it is.

I did catch the item number.
I think that maybe(in both cases) she bid impulsively, then changed her mind and probably doesn't know how to cancel her bid. Now it is too late, so she proceeded with the only thing she does know how to do, neg.
I highly doubt ebay will remove the neg though. I have yet to hear of one ever being removed.
Just wait your 7 days and file your NPB, then your FVF credit request. You'll at least get your FVF back. There is nothing you could about the listing fee, which you would be out anyway.
Plus as an added bonus, you get her closer to being NARU'd. I don't think she actually plans to close her account though, because she is currently high bidder on a few more auctions.

eastwest-- Warning other users regarding a poor buyer is one thing. The fact that you so promptly dished out negative feedback does not reflect well on you -- if you were serious about eBay looking into the matter you could have waited.

I said to myself this is not fair and i need to warn other in her feedback
last night i was going to wait till ebay got back to me ,, but the thing that changed my mind was getting the letter saying she was not paying today
At that point she went from new ebay person making mistakes to deadbeat...sorry but that's what i think

luvmy2bears, I had a feeedback removed, so now you heard it. Someone left neg right after auction ended.
Had to write ebay three times to convince them that the feedback removal policy did relate to the feedback that was left. They said no twice.

Eastwest, SquareTrade is the name of the company that you can pay (I think it is $25) to try to have the negative removed. Your bidder would have to be willing to show up for the discussion. Many people do not have a high opinion of SquareTrade but it is up to you. There were a few discussions about them here very recently.
You sell so many things that if this was a reasonable bidder you may have been able to trade the item for another that she would rather have but it looks like she didn't even give you that chance.

Because the bidder made no genuine effort to retract her bid and correct the mistake, she is clearly at fault in this transaction and deserves the appropriate feedback.
Eastwest, you've done the right thing in this transaction, so move on with a clear conscience. There are plenty of "wackos" out there and they have the ability to ruin your day. Don't let them! Post a big negative and move on to easier and more enjoyable sales.

I agree i really do think she was trying to bid on somthing else i sell. I did not know that till after the auction closed and she emailed and expalined why she gave negative feedback. She said she was trying to bid on sun moon frame well guess what?? I sell those as well
I really thought later she has made the mistake and bid on the wrong thing ..the reason? she is talking about somthing i sell as well

Eastwest..you have done all you can so its time to move on. File the NPB alert and then ten days later file the FVF refund request and then forget about it.
TheRedCircle...am I to understand that you are suggesting that any negative feedback left by a person in a transaction is retalitory IF it is left AFTER the other person leaves a neg?
If this is your position it is in direct opposition of all the posters who so strongly feel a negative MUST be left for a deadbeat, no matter what.
Following your possible logic all a deadbeat has to do is make sure they neg the seller first and any subsequent negative feedback by the seller would be retalitory.
From the use of the term "retalitory feedback" used on this board I get the feeling any neg/neutral feedback which is the second one given in any transaction would be considered retalitory...this is illogical.
Each person in a transaction has the right to give his/her opinion of the transaction. If it was a negative experience that experience is not invalidated just because the person giving it gave it later in time than the other person gave theirs.
Giving a negative is NOT dependant on being quicker in giving it than the othr person. There is no "first negative is the only legitimate one" in a tranasaction.

If everything went down just as you decribed it, you're getting shafted here. But there is little you can do about it. I seriously doubt that ebaY will remove the feedback because in reality it is directly related to the auction for which it was left since it directly related to the emails exchanged between you. Like it or not, all of the emails involved were part of the transaction. Maybe you'll get a sympathetic rep at ebaY who just might give you the benefit of the doubt. I hope so anyway. But be prepared for the worst. It won't hurt to make several attempts to get it removed. All they can do is keep saying no.

In certain circumstances ebay will delete feedback. But it may be that the individual who left it has to request the deletion. Which won't help you. I had a seller leave me a neutral with very negative wording. I emailed them and asked what I was supposedly being accused of. Well they realized that I hadn't had any auction business with them and the next thing ebay deleted this derogatory neutral. A few weeks later they left a positive for me also meant for someone else. With transaction based feedback this won't happen anymore. But anyway, ebay did delete my derogatory neutral.

auctually there IS a way to get the Neg FB removed really easy........just leave her a feedback and use her REAL NAME, phone # or email in it. in it, ebay will remove ALL feedback relating to that transaction. once a REAL NAME is used. even if you are the one that used the real name. just look up the bidders contact info, leave the feed back then ask safe harbour to remove it yourself. pretty sneaky eh?
