Hi Guys,
I missed all of you. I have checked with my bank every four days to see if the check has been cashed and it has not been cashed to date. I stated in my letter and on the check that the check was void after 30 days, which I think is a sufficient amount of time to cash the check. My parnter wants to wait 45 days before putting a stop on the check. July 13, 2001 would be the 30 day mark.
I was hoping against hope that this guy would finally learn when to cut his losses and cash the check. I wonder what could be going on in his tiny brain. As long as I have his money, he is hurting no one but himself. I wonder how his meeting with CEO, Meg went.
We will see what happens... We are selling full force again. We just tightened up our terms of sale.. Before this our terms of sale were non-existentI think that the more professional we look the more these troublemakers will stay away from our auctions.
No other news to report. We will see what happens...

There is some news to report this morning. I telephoned the bank and found that the check had been cashed on July 5, 2001. My friend, and several sellers told me to write "Cashing Accepts as Paid in Full", which I wrote in the letter and on the front/ back of the check. I found out that if a person writes "Without Prejudice" they can cash the check and still bring a case against you in court for the remaining disputed amount. I was thinking of getting a copy of the check to see if any similar statement was written. Or perhaps our psycho buyer consulted an attorney and found out that we met our obligation according to California Law by attempting delivery three times in good faith. Or perhaps the wife just cashed the check, the husband may never budge on this.
What a transaction! During the course of all this chaos, my eye developed a twitch (like Inspector Clouseau's boss! Pink Panther movies) and I am glad to report that it is back to normal again and has stopped...
It is a good idea for any seller to read the commerical code that governs buying and selling in their state. Keep your fingers crossed for us.... I will let you know what was written on the check, hopefully they just signed it.

Well, so much for "good luck." We got a letter from the buyers stating that they did not consider the payment to be in full and demanded the rest of the shipping charges. The letter was sent to our residential address. I now worry if these people will hurt us or our animals. I was hoping to keep my business address and home address seperate but it seems that we really have something to worry about. This was our haven and now it isn't anymore. Just unlucky I guess. Perhaps this thread will be the one that never ends.

They likely rooted you out through public records...easy to do nowadays...
If their tone becomes threatening, involve the local authorities...
I'm guessing the disputed amount is around 500.00 or so now?
If so, invite them to come to your locale and tell their story to the judge....If it was me, I'd consider the claim settled in full unless directed to pay by court order...

Can you get a Restraining Order against him so if he shows up at your home you can immediately have him arrested?

We haven't made a formal complaint yet to the police, but I am going to organize my documents and bring them on Monday to the police station. I will see what they advise.I think a restraining order is ordered by the court, not the police. Please correct me if I am wrong.
The husband got my address from the Bill of Lading, of which he made a copy. I wish the shipper had not done that. They are not entitled to receive the BOL unless they accept shipment, the act completes transfer of title.
My husband thinks I am worried for nothing; that this guy is full of hot air. So far, he has sent a copy of the letter to the District Attorney and one to E-Bay. E-Bay never contacted us again about the fraud investigation. I don't know how that stands.
I also ordered a copy of the cashed check to see if they crossed out my "paid in full" statement. According to what the bank could see on microfilm, they just signed both their names to the check.
He purchased the Armoire as a business. Isn't there a Hispanic/American Organization for civil rights that might be interested in the discriminatory practices of their Roofing Company? Just a thought.

I didn't read through all 5 pages here, did you (or can you) post a copy of the letter he sent to the D.A. (leaving out yours and his personal info)? I'd like to see what he wrote to the D.A.

As for a restraining order it depends on what the laws are in your jurisdiction. In some states police are able to issue an emergency restraining order, usually when the courts are closed for the weekend or holiday. When the courts reopen, you then need to go down and either appear before a judge, magistrate, or who ever is appointed to hear such matters and they will then decide.
In general, the police have become more knowledgeable about the restraining order process because of the increased awarness of domestic violence (in fact, this is what prompted some jurisdictions to allow certain police officers to issue restraining orders while the courts are closed.)
This is just my humble opinion but I think it maybe time for you to contact an attorney in your area or a local law school that has a legal clinic. You can call your city/county/state bar association and ask for a recommendations. Often an initial consultation will be free or deeply discounted. Its also a good idea to see more than one lawyer for a intial consultation and pick the one who you feel most comfortable with. (Think of this as neededing major surgery - you're likeley to ask for a second opinion)
A lawyer or legal clinc would also be able to advise you on any possible legal issues that might arise if you did conact the Hispanic Chamber of Commerce in his area or other Hispanic business organizations. As true as it may be you don't want to add a liable/slander charge to his list of compliants. AND they'll be able to evaluate additional claims you may have against the bidder.

To get a restraining order against the buyer, he'll almost certainly have to have committed a more overt act than discovering the seller's home address and sending a letter to that address--i.e., he'd have to have made some sort of threat. A suspicion that he might do something won't be sufficient.
