It depends on how you would interpret the word "services".
As you stated, the first page of the user agreement (which you must accept to become a "user" under their definition) states:
Our services are available only to individuals who can form legally binding contracts under applicable law. Without limiting the foregoing, our services are not available to minors. If you do not qualify, please do not use our services.
Taking that one line at a time "Our services are available only to individuals who can form legally binding contracts under applicable law." Nowhere is "services" defined as merely browsing their site. You do not have to register a credit card, and click a link swearing you are over 18 to enter their site (except for the adult section).
Without limiting the foregoing, our services are not available to minors. Again, the word services. If you interpret that to mean viewing their pages, so be it. But, Ebay does not interpret it that way.
If you do not qualify, please do not use our services. Ebay lists their services to be:
Registration
Buying and Selling Tools
Feedback Forum
My Ebay
Safeharbor and
About me.
Nowhere on that page that lists the "services" Ebay provides, does it state their services include simply viewing their site.
Again, if I am viewing the site, with one of my kids, or even without them, and I come across an inappropriate listing, I will report it. Nothing will convince me otherwise.
wlaschin, they are normally moved to the appropriate adult category within 24 hours, or ended, depending on the action they take.

WOW! 24 hours, maybe I should put the word porn in the subject line for any emails I send. They take 7-10 to respond to fraud and sellers that have been suspended and are now selling under another id. If the seller is breaking a rule on listing the item where it should not be seen, why is he/she not suspended?

They are normally given a warning for the first infraction, and if they continually do the same thing, they will be suspended, or so they say, anyway.
