Rent20, I'm behind you all the way, I've dealt with plenty of deadbeats in my consulting practice (So far none in the auction Biz *knocks on wood*) and it's astounding the lengths people will go to to avoid paying you.
In my web designer days, I was once ripped off for 5 figures in a nine month period, one company simply folded and I just chalked that up to bad luck...the others, never intended to pay me more then their initial deposits.....and they went to some incredible lengths to avoid paying me.
In fact, your story sounds tame compared to some of the *(#($#$ I went through, at least you got paid in the end.
Anyway, just leave a clever Feedback and let it go. -- I say this because compared to my Web Design business......my margins may be a lot lower, but practically everyone pays.....it could be so much worse if you were in another industry.
I had a colleague who worked for a client for 3 weeks before they told him that they didn't have ANY money to pay him and that they were shutting down......they knew this beforehand and brought him anyway, hoping that they would get VC in the meantime.
FWIW, a "Float" means that there is money in the account -- but that's not available yet. E.g. You deposit a check and your receipt shows that your ledger balance is up by X dollars, but your available hasn't changed yet. Some banks will cash checks against it, some won't -- some tellers know the bank policy on this, some don't.

I will watch if she arises from the grave and starts to bid again and I will email the sellers of her winning auctions with links to this thread.

The saga continues. Tonight (Monday) I received the following mail. My reply is immediately below it.

Your family has had some extremely bad luck with both your mother and father dying 2 weeks ago, and now your sister dying so I do offer you my sincerest condolences. Assuming I get the merchandise back any refund check (minus postage and Ebay charges) will have to be made payable to the executor of your sister's estate. Please send me the contact info for the probate attorney. I would like to send a condolence card to the funeral home where your sisters funeral is being held, so I would appreciate you giving me that info.

Meaning she's copied the video tape and now wants a refund for the original. Your policy may vary, but I do not accept refunds on any media that can be copied (CDs, movies, pattern books, etc.)

Have your Tampa friend contact the local newspaper and provide the facts as told to you. This is a pretty amazing coincidence (mother, father, daughter all dying within such a short time) and quite newsworthy. You've got the name, address and phone number of the deceased; your friend can provide that to the paper as well so they can send a reporter out.
Don't *you* contact the paper, as you risk your eBay registration by divulging someone's contact info. Have a friend do it.

It just gets better and better. Tonite (Wednesday) I received this email. Notice that she did not give any of the info I requested regarding the probate attorney or named the cemetary.
Thank you for your warm reply to my earlier e-mail. My husband did, in fact, mail your package back intact earlier today. It should reach you in a few days. Please let me know if you don't get it & I'll put a
trace on it.
At this point, if you do have a check from my late sister, please don't feel it needs to be returned. Please keep the funds for your time and trouble or, if you wish, donate it to a charity or organization you
support. Either way, I'll feel a little better, and I know she would say the same.
My sweet sister was blessed with riches throughout her life, but not in the financial sense. She lived very simply and left only a small amount in her bank account. My husband was able to handle most of the details, as she had no estate to speak of. She has been cremated and her ashes have been placed beside our beloved
parents in Massachusetts.
She was very close to our folks & they would refer to themselves as the "Three Musketeers." It comforts our family to know that they are together once more.
I thank you again for the kindness and consideration you've shown to a complete stranger. I only wish there were more people like you out there.

Apparently she doesn't realize the check has been cashed amd cleared her bank. Or she may have called the bank and determined check has cleared, so this is a last ditch effort to put some guilt on me so at least she won't get negative feedback. I am tempted to reply, but at this point I think no replies warranted. What do you all think?

Trust me I will watch her feedback and bidding, but she apparently seems to be a light buyer and only 7 feedbacks. I am very tempted to write her a curt letter back saying that the check was already cashed, and the only way she will get a refund is to send me proof sister was run over by drunk driver. I would also like to tell her that I will be watching her bidding and slam her if I see any activity.
I think she must be someone with too much time on her hands and very limited income to go to all this drama for a lousy $26 item. If I do provoke her anymore, I could get the ultimate "stalker" so probably best to let sleeping dogs lie.

I hate to say it, but I think the story is valid. They told you to cash the check and keep the funds or donate them. They are returning the item. The only explaination that resolves these facts would be the death of the buyer.

kahml- How would eBay know she died? I'll bet there are tens of thousands of actual dead eBay users who really ARE dead. It doesn't cost anything to have a user ID, so there would be no charges to her credit card (Which would be deactivated).
I've NEVER heard of eBay purging inactive accounts.
As long as her feedback doesn't warrant a NARU, she could be on there forever. The only way to really prove "non-death" is if she starts bidding again.

I don't follow your thinking here. Why wouldn't her ID be valid? Being a bidder on eBay would not have to involve credit cards, or credit card charges. I suppose she would be NARU'd in the usual way - or not at all, unless the family went to the trouble of un-registering it.

Not necessarily - not if she is not yet aware that the seller cashed the check in the manner he did.
More than likely, if he had deposited the check, it would be coming back NSF, or (more likely) "account closed".
Then there would be another email "sorry, but we had to close the account - there was nothing in it anyway - but we did return the merchandise."
Mind you, I'm not agreeing or disagreeing, just envisioning another scenario.

For those of you who still want to believe this gals story, lets rehash her various excuses to me.
1- She initially requests a time extension because her dad died.
2- A week later her mom dies so another extension requested.
3- A week later she sends a personal check, but asks me to delay depositing it until 8/16.
4- On 8/15 I get a email saying from this womans sister claiming her sister was run over by a drunk driver.
Point number 4 is quite important, as what are the odds that she would be run over by a drunk driver just before I was supposed to deposit her check? True the check has been cashed, but I think it was only sent as a attempt to look good so I wouldn't enter negative feedback. Yes, she has offered to let me keep the $ for my time and trouble but that seems to be a empty offer. She probably isn't aware that I cashed the check up here versus sending it in for collection.
So she probably hopes this empty offer will make me think she is legit when I get the notice back from my bank the check didn't clear. Or she could be aware check has cleared, so is hoping this empty offer will make her look good and save face, and maybe hopefully even shame me into returning the money. For what its worth, I called the back this morning as I still have her account number. I asked if there were funds in the account for a $31 check to clear. I was told NO as unlike the last time when I was informed funds were floating in the account, this time the girl told me there was a DEBIT on the account. I feel all choked up if my cashing the $31 check directly at Suntrust caused a debit to go on her account. In general banks don't like customers who overdraw accounts, so I can assure you that Suntrust put a nice fat charge on her account in addition to the actual check itself.
I could not resist sending her a final email, especially in light of the fact she gave me permission to keep the money or donate it to a charity. My letter is immediately below, and I cannot see her writing me back as she has painted herself into a corner.

Well I have already cashed your sisters check which is why I sent out the videotape
so quickly. Normally I wait 7-10 days for a check to clear before sending out merchandise. However in this case the bank the check was written on (Suntrust) also has local branches up here in the Virginia area. So I just went to the local Suntrust bank next to my office and cashed the check at the teller window. Since I had the cash in hand, is why it was shipped so promptly.
As I said I would have been willing to refund the item if you gave me the name of the probate attorney, but since you said your sister had a small estate with little money, then I completely understand why your family wouldn't bother going to the hassle and expense of hiring a probate attorney.
I do like your idea of donating the $26 to a charity, and I think a very good choice would be MADD (Mothers Against Drunk Driving). I actually had a friend who was killed by a drunk driver last year
so I contribute on a regular basis to MADD and have even done some volunteer work for them. So as per your suggestion I mailed off $26 to them today, and I am sure your sister would appreciate that. May I take the liberty to suggest that since you now have a family member that was killed by a drunk driver that you might want to get involved with a local chapter of MADD. They are always looking for volunteers and this would be one way of showing respect to your sister. If I had my way, every drunk driver who causes a accident should be locked up for life as these low-lifes have no respect for their fellow human beings.

didnt you state in one of your earlier posts that when contacted via phone, you were informed that the "deceased" woman was out shopping and that the "deceased" mother answered the phone? wouldnt that be enough proof that this woman is full of crap?

You know kiddo2 really needs to get a grip on reality here. I have had 3 deadbeats in a row this past two weeks - fortunately they have not been as bad as the above. Unfortunately one of them did leave a "neutral" feedback on me saying "I could improve on my rapport." She got huffed about the Auctionwatch notification emails that are sent out to winners. "She got confused!" I have since removed the AuctionWatch WBN. I have no sympathy for cop-outs!
I just sent a pin over to a gal in England - bubble-wrapped the thing inside the little jewelry box, bubble-wrapped that box, plus the stuffing in the box. It was a small box that it was mailed in 6x4x3. I just got an email telling me that "she was very disappointed - it had fallen apart!" She even went so far as to send me a picture of it in 3 pieces. According to the picture, the pieces were taken apart at easy points to where she can easily glue them back again. I made these little pins and I know they wouldn't come apart unless you "really" pulled on them. However, I can't prove that she pulled the pin apart. The package was not insured, and I normally won't replace anything unless they have insurance on the package (which most of them do anymore cuz they know I won't replace or refund). This is the first time I have sold anything to an international.....really has not put a very good taste in my mouth at all. It's obvious she wants another pin!!!!!!! for nothing; however, she is not going to get another pin for nothing. Another one to be added to my "blocked" list.
