I got an affidavit emailed to me that I had to sign and fax back to them. I did that today. I also saw that hammer1691 got a refund, he posted that in one of the other threads I believe.
Come on people, lets continue to share the information that we have. If you have received a refund then say so here and give kudos where they are due. If you are still having a problem then post here also so we can all help each other.

I also received an affidavit to sign, last week and faxed it back. Spoke to paypal today and they said that it's what they send you after you have filed a claim, but could not tell me if I would be refunded anything, only that it sometimes takes up to 30 days after filing a claim to hear back from them. Any more feedback from anyone else?

Yeah Graham I received my money back. Cudos to Paypal for coming through. Folks, I have no idea why Paypal is being so secretive on the front end of this thing. Common sense says they should somehow (web site posting, group email...) be notifying everyone. Behind the scenes secrecy is a little more understandable with a police investigation and all. I have been keeping an eye on this thread hoping to see some more good news. I am glad to have seen a few. My affidavit for refund came via email and I was able to fax it back. I don't know if that is the standard or if they were pacifying my whining a**. Keep the faith and don't let up on them. They are working on this one case at a time. It could take a while. All the more reason to notify everyone and set anxieties somewhat at ease.

I had spoken to soon... as soon as I looked at my email I had a confirmation that I had been credited, and sure enough, when I went to my paypal account, it had been

Well I just checked my Paypal account, and all I can say is WOO HOO (in a Homer Simpson voice). Thank you Thank you Thank you Paypal for refunding my Gametek money. I faxed the affidavit yesterday and today my money has been returned. Hurrah for Paypal, I know there a people out there who are P--ed off at them for one thing or another, but I will tell it like it is, Paypal has saved my butt and never done me wrong.
To the person who hasn't gotten the affidavit yet, I got mine after about 2 weeks from sending in the claim form so be patient, they are giving the money back.
To all the people who came here just to bad mouth Paypal and spread falsities about what Paypal was doing, all I can say in the immortal words of Bart Simpson "Eat my shorts" Paypal lived up to every promise they have made to me, you just gotta jump through them hoops.

Grahamreaper, I am very happy for your good fortune and I hope everyone gets the same result. But before we go petitioning for Paypal's sainthood we need to consider the wise words of SG52. He or she has been saying exactly why Paypal is not making any noise about, or going out of their way to help with, this refund. They know they are going to get 10% if not more of their customers to not conform to their rules. Some will never know about these rules since Paypals reps never seem to come completely clean. Think about how many of these customers are brand new to Paypal and joined just to purchase from Gametek. I am one of these people. It is not second nature to non-e-auction people to deal with this stuff. They know who gave them money for Gametek. They don't need Fraud Claim forms. If they were sincere about this, they would be proactively contacting people and not hiding in secrecy.

I can't disagree with you there. But the info is there if you are willing to dig. But I do think you can agree with me that there were quite a few people on here who blatantly stated that Paypal will never pay and anyone who thinks they will pay up is stupid, scooterman comes to mind. I don't see those people posting anymore, guess they don't like to speak unless they can be right.
For the people who have not gotten their refunds, keep hounding. Here is the phone number that I call when I need to talk to someone there. It is posted on their site so it is not private 888-221-1161. Everyone is entitled to a refund who paid through Paypal under their old TOS, don't let them off the hook. Incidentally I believe their old TOS stated 30 to 60 days after payment, OR AFTER THE PROMISED DELIVERY DATE FOR PRE-ORDERS. Maybe someone can double check me on that.
I do have a question for the general populous out there. I have a premier account with Paypal because of the auction selling that I do, and when I call their number I always get a prompt reply from them, when I email too. I was wondering if this is because I have the premier account ( hence I pay them fees to receive money).
Just curious.

I get that same responce. I too have a premier acocunt with about $3500 a months worth of money being put in my account. ITs odd. I guess since he has a big chunk of $$ taken out of our sales

Financial crime investigations often take weeks, usually months to investigate because of the length of time it takes to obtain financial records. We are still waiting on bank records from several of GAMETEK's accounts.
I will try to answer some of the questions that I see repeatedly in emails that I have been receiving. When will the people that paid by check, money order, cashier's check or cash get their money back? This issue has been discussed with the Santa Clara County Deputy District Attorney that has been assigned this case. Normally, after a case is adjudicated (complete), the court appoints a government agency, sometimes a private agency, to handle the disbursement of seized funds back to the victims. The court will then order that the seized funds be transferred to that agency. It is the responsibility of that agency to determine the criteria for reimbursements. All victims will be notified when this case is adjudicated and the refund process has begun. We have no estimate when this case will be adjudicated. A recommendation for the victims that paid by check, money order, cashier's check or cash would be to look into a class action lawsuit against GAMETEK. The attorney could then seek a court order to release the frozen funds.
Why did the people that paid with a credit card get their money back? The use of credit cards while shopping on the Internet offers another line of fraud protection. If you pay for something that turns out to be a fraud, the credit card company should refund your money. This is done by the credit card company, it is not ordered by the investigating law enforcement agency. Law enforcement has no control over credit card refunds. If you paid using PayPal, please see below.
Has Tam Tu been arrested? If not, why? Mr. Tu has not been arrested because this investigation is still in progress. Until we can show that is was not possible for him to fulfill his orders when he accepted money from his customers, and that the money he received for orders was diverted to other uses, we have no case. Thus, our case is dependent on the bank information that we are still waiting for.
Can I have Tam Tu's address so I can start civil proceedings? Mr. Tu maintained two business addresses.

If you paid for your Playstation 2 via PayPal, you should have already been contacted by PayPal reference your refund. They sent out an email to all customers that purchased from GAMETEK explaining their refund process. They followed the first email with a second email, which I have posted a copy. Click HERE for a copy of their second email and also a Letter of Declaration that you must fill out, sign and mail back to PayPal.

HELP PLEASE:
I received the LETTER OF DECLARATION
Signed it and mailed it priority mail with confirmation on 12/28. It just arrived at Paypal on 1/6/01 with tracking #.
How long does it take from the tiem you faxed or mailed your letter to receive your refund from paypal???
I have over $700 tied up in this mess.....Paypal has gained interest on my money (paid on 10/27/00) and I am out credit card interest on top of the $700+.
Also, should I fill out the Credit card papers to dispute these charges to ensure I get a refund on the interest from the credit card or will can that delay my refund from paypal?
Please Let me know...

I also paid by credit card, faxed my letter back to paypal, and waited a couple of weeks. Then I called them, explained what went on, and before I knew it, they had credited my paypal account with the money. Within minutes. Then I just had it transferred into my checking account which I had already had registered on paypal. You might want to try a phone call and an email to [email protected]. Worked for me

It's Jan 9th and I have been unable to contact Gametek via phone and obviosly their website has magically disappeared. I never received any playstations or even a notice with an explanation. The problem is I bought 10 Playstations and paid half of it with credit card and half with a check. I have already reversed the charges on my credit card,but does anyone know how I can get my money back??? Any responses would be so helpful.

I got the refund from paypal......
I mailed the letter on 12/28/00, they received the letter 1/6/01, I called them on 1/8/01, and I was refunded on 1/12/01. I did not get a notification email from paypal that I had received the refund. I just chacked my account and there is was in the history on 1/12/01. I called the #800 from my credit card (1-800-836-1859) This is not the premire account #800. The people that have sent checks and money orders, may want to see if they have been cashed yet... I also got my money back from Paypal recently.
I have filed a claim over a month ago. I had no "real" response, but bunch of automatic replies. I contacted paypaldamon, and he forwarded me the affidavit to fill out. I mailed the affidavit signed late December.
I just checked my paypal account, and it shows that the money has been credited to my credit card on Jan 12th.

Is there anyone out there who paid by check/money order who has gotten a refund yet?? There has to be something better we can do rather than sit around, waiting to for the police to magically get our money back, What if 6 months go by and they don't retrieve a dime...by then it'll be too late to organize a class action suit. Your thoughts and opinions are helpful!
