I had an auction end this weekend for a limited edition Mark McGwire 70 HR licensed photo, Or so I thought. I sent my EOA to the winning bidder who's response to me was:
"The photo has the date of SEPT. 27 1998. If that's the case I really don't want it because the date should be SEPT. 28 1998."
Now the date can clearly be read on the photo in the scan in the auction and IS the correct date. Even if it wasn't, it's the responsability of the bidder to check this out BEFORE he/she bids. Seems to me like this bidder just changed his/her mind.
Fortunately this is the first problem I've had, and I've been running 50 - 75 auctions a week now for about a year between eBay & Golds. But still, I'm PO'd as the scan is a clear scan and all my terms are clearly stated.
I hope it's just that the bidder has been misinformed as to the date, but I have a bad feeling about this one and not quite sure how to reply to his/her email without over doing it.

Send a link to a web page (Sports Illustrated or something "official" that shows the correct date. If they still refuse to pay, go through the NPB procedure and get your final value fees back, at least.

Per the Ebay user agreement to which you agreed found at the following URL:

It states:
"4.Bidding and Buying.
If you are the highest bidder at the end of an auction (meeting the applicable minimum bid or reserve requirements) and your bid is accepted by the seller, you are obligated to complete the transaction with the seller, unless the item is listed in a category under the Non-Binding Bid Policy (at http://pages.ebay.com/help/community/png-nbb.html) or the transaction is prohibited by law or by this Agreement. By bidding on an item you agree to be bound by the conditions of sale included in the item's description (or linked to from the description) so long as those conditions of sale are not in violation of this Agreement or unlawful...."
I will wait until noon tomorrow (I always put my time CST) (date) for your reply, after which I will have no choice but to file with Ebay for credit on this auction which will result in a warning letter to you from Ebay.
