I have a dilemma. I had an auction
end on October 8. I never received
payment from the buyer and contacted
the buyer twice regarding not receiving
her payment with no response. Out of
the blue, the seller emails me tonight
saying she sent a money order previously
and has not received the item she ordered.
My question is, how can I prove that
I didn't receive or cash the money order?
BTW, this buyer has a total of five
feedback with one negative for being
a deadbeater. How would you handle
this dilemma? Thanks so much for any
input.

just calmly request they send a copy of the money order receipt. i have had bidders claim to have sent money orders, and i've never received them, and when i ask for a copy of the money order receipt, they suddenly offer to pay another method...if what they are saying is true, and they have actually sent the money order, i believe they can have it investigated, which would prove your innocence...stick to your guns, if they can't come up with a receipt, and don't want to pay, file a NPB!

This buyer should be able to check where they bought the money order and confirm it hasnt been cashed.

if the buyer sent a check they can call there bank if the check she sent you has been cashed.

if she used many of the credit payment services she can check in her account to see if you have yet even claimed the payment.

if the buyer sent cash they could track the payment through the po but mostly like they are just SOL.

in any case I would right back to this buyer useing ebays send this auction to a friend link your emaiol will show up with Ebay address as sender.

Let the buyer know that you still havent received the Money order she sent, and recommend That she send you another and have the missing money order traced. Tracked, canceled what ever .

In the mean time let them know if the orginal money order does get to you you will send it back to them.

the burden of proof is on them not you as long as the money order wasnt signed and cashed by you.

It's virtually impossible to prove you didn't receive her payment. She can, however, prove you did, IF she can present a cancelled check or statement from the MO issuer that the MO has been cashed. So the burden is on her.

Exactly what HCQ says...if she wants to make any claim against you, she'll have to have proof of payment (which the receipt for a MO is not, BTW. It only shows that the MO was purchased, not that the seller received and cashed it.). The worst she can do is leave negative feedback, and since she's already got one negative for non-payment, another from you will certainly not make her look very credible when someone checks things out.
