Here is the story - any advice on what to do would be greatly appreciated.
Back in the middle of October I bought an item from an individual in Hawaii (I am from Canada). I send them a money order and he had confirmed they had received it and that they had send the item out November 2. The item was insured.
I have not received the item yet so last week I send the individual an e-mail stating this and asking when they had sent it.
The individual sent me an e-mail back the next day stating that they had indeeed sent it did remind me that it was insured. I said I would wait one more week to see if it shows up and contact him.
I still have not received the item. I am going to e-mail the seller (they have 16 all positive feedbacks) and state that insurance should be claimed.
This is my dilemma - to protect my butt in case he is just stalling or for some reason the postal service refuses the claim should I file a report to Safeharbour before the 60 days to do so has passed?
I don't want to jerk around an honest seller but I also don't want to get ripped off by him or the post office.

if the seller sends you copies of the shipping receipt, insurance etc., it should not be a safe harbor issue. if they don't then file right away.

Did the seller use delivery confirmation? Do they have a postal receipt showing the item was shipped? Ask them to email you a scan of the insurance receipt...
If it has been shipped, all you can do is wait. After a claim has been filed it takes about a month or so before the PO will settle up...

I mailed an item 11/7 from Ohio, going to Texas. It still has not arrived, I bought delivery confirmation. I check every day at USPS, just hoping, but still no package. When I called the 800 number they asked me to wait and it will show up. Monday I will be shipping another item to buyer if it has not shown up by then. I would like to check out USPS auction site. Cannot remember the site addy.
one thing you need to remember is that shipping from usa to canada does take longer than if canada was shipping to canada or usa to usa.
we ship many items to canada and they always take a lot longer than if we ship to another part of the usa. the customs department holds the blame for taking so long.
i do agree with the other poster that if you receive photo copies of the us postal forms, it is not a safe harbor actionable item.

News Flash. Just received email from buyer in Texas. The stein arrived today!!!. Almost 5 weeks priority shipping. Whew, will wonders never cease?
