I sell in a CA antique mall and fill out state tax information for items sold there.
No tax is due as the mall collects the tax but I still must file.

I do the internet auctions from my home. The small amount of tax collected for internet sales will be added to the paperwork that I send in for the antique mall sales. I believe there will be some spot I can add the small sum taken in last year.

My question to sellers who collect state sales tax: Is it necessary to have a city license?

Sales taxes and business licenses are two different animals. You don't need one to do the other, and vice versa. Some cities or other entities don't even have business licenses, but if you live in any state where sales tax is collected, you need to take care of that no matter what.

Call your city hall and ask about a business license. You don't have to give your name or anything else...just ask if there IS one and what the requirements are. In my pokey little burg, it costs me $25 a year and a very small percentage of my sales over $50,000 a year.

I live in CA and in my particular city I am not required to have a license----some cities around here have a requirement to get a home business license but as long as I don't have traffic coming to my house I don't have to get one. On the other hand I used to live in a different city where i was required to have one.

A license may be needed for other reasons though. if you want to open a bank account in a business name, I believe it is a requirement along with a DBA.

Edit: I forgot to add that I have had a sales permit for years (used to do flea market sales) and pay sales taxes regularly. One does not require the other, as the previous poster said.

Can it be considered an extension of your brick and mortar and limited use? This may keep you out of Zoning's nosy side. Don't let government rule your life!

I do not see why my city has a right in charging me for a license. They provide no extra services in order for me to operate an internet selling business. One more reason to vote Libertarian.

I would suggest looking into the whatever law that governs applying for a city license in your own area. I don't have a city license because I do not have "traffic." The license for me would be for excess tax. I only have a state license.

Some jurisdictions call it a "priviledge license".

In the city where we have our brick and mortar business, in addition to having to pay personal property tax on our inventory and equipment, we need a "priviledge license" because we are located within the city limits. We do not conduct any sales with local businesses, but must pay for the "priviledge" of being located where we are.

Isn't that special? :-P

I called my city offices [I'm in Virginia] and was told to get in there and register for a business license pronto. To get one I had to pay for a home occupancy permit which was ten dollars, but there was no charge for the business license. Apparently a tax kicks in once you reach $50,000 in sales. Not a problem for me right now. ; - )

I use the licenses for my brick and mortar and just add the additional revenue and expenses to it.

I live in CA and my city requires a license. Online auctions fall under the cat. of mail order business. My cost was something like $75.00 the first year, and $25.00 a year after that. I collect sales tax. It's was easy to get the license. If you include your whole name in the name of the business then you don't have to file for a DBA (Doing business as..) My name of my business is: Kelly "Smith" Collectibles. (Smith is not my real last name.) Hope this helps.
