The facts:

Guy from Australia won auction in early Dec. Asked for BillPoint invoice which I sent. Ignored BP invoice & paid via BidPay. I didn't take BidPay at the time (nor did he ask me in advance to pay this way) but I decided to just accept it & not make a stink. He paid, I shipped.

Few weeks later, winning bidder on 8 of my auctions. Sent him EM saying, "Hi XYZ, I have your address, would you like to for to give you a single shipping price for combined shipment?"

Never heard back. Meanwhile, I doing EOY cleanup & cancel the old, unused BillPoint invoice to him.

Waited a few days, send another EM, "Hi XYZ, Haven't heard back from you if you'd like me to combine shipping."

Get EM from him, "You rejected the BidPay payment I made to you."

HUH??? I NEVER received a BidPay notice to reject. And if I did get one, I don't even know HOW to reject them.

EM him back saying I hadn't received nor rejected anything & to check & make sure he filled out the correct name. Hear nothing from him. Then I recall the BP invoice I cancelled..EM him & ask if this might be the confusion & would he please forward on to me anything he might have which indicates I rejected his BidPay payment. Hear nothing from him.

Checked him out on vrane. His feedback is closing in on 500 but he has NINE negs for payment not received by sellers. He responds to all of them saying he put cash in the mail & they are liars/thieves/etc.

He's left more negs than he's received & the sellers on a number of them indicate it's retaliatory.

Since he's refusing to respond to my emails or offer any proof of where I "rejected" his BidPay payment, I'm sure this is going to my most unpleasant transaction ever.

My question is that it appears I will be filing for 8 NPBs. If he doesn't pay & it goes to 8 FVF credits, can I then write ebay & get him suspended based on that number of NPB's? Or does it take 4 unique NPBs to get the 30 day suspension?

BTW, even though I'm facing 8 negatives from this guy..I refuse to let the thought of it stop me from doing the right thing. He doesn't pay, he gets the negs..all EIGHT of them even if I get 8 in return.

It usually takes FOUR from FOUR diferent sellers, but if he's being that obtuse about it, maybe they will suspend him fior 30 days.

Bummer..was hoping I'd get SOMETHING positive out of this for taking on 8 negs at a time.

EVENTER -
If you point out to eBay that he's got EIGHT NPB alerts from EIGHT auctions, they might go ahead and suspend him.

Usually it takes more, but I think "Eight is Enough" should apply. Ask them after you file for FVF, and see what they do.

If you post 8 negs he could accuse you of feedback bombing.

If a Bidder receives three "official" eBay Non Paying Bidder warnings they get a 30 day suspension.

Upon return, if they receive a 4th NPB warning, they are suspended indefinitely.

NOTE two things:

1) An eBay Alert is the eMail notice bidders receive after 7 days of no contact or no payment for winning bids when a seller initiates the NPB/Final Value Fee process by reporting the reason as being due to NON PAYING BIDDER. The alert gives the bidder and seller 10 days to work things out - for bidder to honor their winning bid (IF the seller is still willing to trade with them).

The eBay official NPB WARNING signals the official NPB "tick" against the Bidders account for NonPayment when the Seller completes the NPB/Final Value Fee Credit process. The Bidder will get the Offical NPB WARNING via eMail at that time. (this is what is counted toward the "Three strikes = Temporary Suspension" plan.)

2) Suspended INDEFINITELY, upon 4th NPB official Warning, does NOT equal Suspended PERMANENTLY. (this is a problem, I think!) *sigh*

HOWEVER, if you notice a trader with feedback that indicates a clear negative trend in trading behavior, you should report it to [email protected] so that someone from eBay can look into the situation and determine if they should attempt to contact the registered member or seek other means of halting the negative trend... which COULD include suspension.

Also, traders with a TOTAL feedback score of -4 or less, will be suspended automatically once eBay is notified of the situation.

Is it still feedback "bombing" if he bid & didn't pay for 8 separate items & I leave feedback on each one? Now in the old days of non-transactional, I can understand how it would be bombing but these would all be transaction related. AND, based on his history, even if I left one, he'd hit back w/everything he had...so I might was well give all 8 if I have to give any at all.

I have a lot of multiple auction winners & usually leave positives on each one. I realize only the first one counts, but for my multiple winners, I want people to know they were good customers each & every time.

From what abacaxi said, it appears even if the process goes through to my filing FVF on each of the 8, it won't get the person suspended (even for 30 days) since it has to be from [unique] sellers.

To all,

I hate to see it get to this point & hope he comes to his senses along the way. But I've pointed out that I've not "rejected" anything because he hasn't SENT anything to be refused. I can't think of anything else I can do, especially since he refuses to respond to my emails.

How the heck can I reject a BidPay payment I never got in the first place??

About the facts of the transactions, they're facts that only you and the bidder knows, but as far as I'm concerned, the bidder can tell safeharbor that you have a personal vendetta against him/her.
Just be careful on how you phrase those negs.

OTOH, you can only leave 3 negs and eBay wouldn't care less, as 3 negs are the "borderline" on neg feedback bombing.

Not to worry, when it comes to leaving negative feedback, I'm "Dragnet".."Just the Facts".

Hey, maybe I could leave 2 a month for the next few months.

Actually, if you read the NPB policy, it does say that Ebay may suspend a user based on NPB's from less than 3 unique sellers, based on manual review of the information. I'd report the bugger, and hope that at least one or two other sellers have reported him. A problem I'm seeing all too often is that sellers don't realize that a negative feedback is NOT a NPB complaint and doesn't count toward getting a bidder suspended. I doubt that they'd accuse you of feedback bombing for leaving factual "did not pay" negatives for eight valid transactions.

An Update:

I contacted SafeHarbor briefly outlining the situation & asking for a ruling as to whether leaving 8 negatives for 8 unique transaction would be considered "feedback bombing".

Here's a portion of their response:

[b]"If you do decide to leave negative feedback please be assured that it
will not be considered feedback bombing since each transaction was
legitimate."[/b]

They also went on to say that each "warning" is unique (if I have to file the NPB/FVF credit) & 3 gets the 30 day suspension & 4 gets an indefinate suspension.

I'm sincerely hoping for both he & I that it never comes to this drastic point.
