Widget sold over a month ago. Bidder contacted me and said one of the items was broken (total of 2 of the same thing). She paid insurance, too. So, since she was really bummed about it, I sent her a replacement of something similar, which she accepted and left me positive feedback. She never asked to be reimbursed, and she asked ME if I had another to replace it, which I said I did and which she said she wanted. I sent it to her, and I paid the shipping on it. It arrived, she was happy and said so. Feedback was already left by both of us at this time. Now, I just got an email from her, asking if I recieved the claim form she sent me for the insurance claim, and since she paid the insurance, where was the money? My reply was "I didnt get the insurance claim. Did you send it here? I didnt bother with filing a claim here, since I sent a replacement. With that replacement, I presumed that you were satisfied, with your acceptance of the replacement".

My question is, isnt that unethical? She got a replacement, which she asked for and which I sent at my cost to get it to her. I never filled out a claim form, because she was happy with said replacement. Now she wants 50 bucks for something that was replaced?

Maui: Yes, that is totally unethical! She should have received a replacement OR the claim check - definitely not both! Wow, talk about trying to get something for nothing....

Hmm. Since you sent the replacement...you're the one that's out of pocket. She is out nothing. Shouldn't you get the insurance?

Uh-oh Maui I think she is trying to pull a fast one on ya. Sure does sound like she is being unethical to me. Since you have already replaced the item, and she has already left feedback - wouldn't that indicate the transaction is OVER? Of course the replacement was INSTEAD of the insurance money. Not in ADDITION to. Did her earlier emails say she expected BOTH the replacement and the insurance? Or was her wording so tricky and unclear that she can now say she assumed she would get both? Wow, talk about having to watch every single word when you already think you are spelling things out so carefully anc clearly. Sheeesh. That one would've seemed pretty clear to me: Replacement instead of insurance. But I guess some people are always thinking up new ways to get over. Good luck, I hope this one works out for ya, keep us posted.

LOL...I dont remember where shes from. And I dont even know where the insurance green thingy is. Since she was happy with the replacement, I didnt bother to put it in a safe place (prolly in the trash by now). And no, her initial email just stated one was broken and did I happen to have another one, which I did and sent. I havent heard from her since my last email that I showed you folks up there ^. I dont plan on doing anything further with her anyway. Sale is over, insurance slip green thingy is long gone, and its a done deal, lol. Just wondered if what I was thinking is what you folks were thinking and yup...GMTA

Hi Maui!

When you replaced the lost/stolen widget, title to the original passed from the buyer to you. So, if an insurance claim was filed (and there is nothing wrong with you doing that), you're the one who get's the $$.

If she were to make an insurance claim on an item she not longer held title to, she would be committing fraud.

When you get insurance on your car, and your car is in an accident, they repair or replace it, you don't get your insurance money back too!

That is what insurance is for, repair, refund or replace.

If she starts to throw hissy fits, include words like "Mail Fraud" to her.

I agree with the above posters that said you should have been the one to get the money back, but since I think that would involve the bidder bringing shipping box and contents to PO for inspection and your insurance form, I guess it is too late now.

Hiya Steve. Thanks for the info, and thats what I figured too. But, I didnt file. I never even messed with it. I sent a replacement, she was happy, end of story. I think Im an idiot though...I couldve had an extra 50 bucks!!!

The buyer is (was) totally unethical. If anyone gets the insurance it is you - you replaced the broken item. I am sorry you didn't save the insurance receipts. I save mine in a little box all year until I do my books. Then I put them in a manilla envelope for 3 years just in case. I know that sounds like a long time bit I always take my accountants advice.

I only had to collect insurance one time. Something I bought came all smashed up. If they had another one to send me I would never have thought of collecting the insurance.

If you didn't receive the broken widget back, how do you know it was really broke?? Maybe you really got taken!!

In the first place she wouldn't GET $50 because it was insured for that. The Post Office only gives you part of what it is insured for.That's where they screw you on the insurance thing. This person should be happy her widget was replaced which saved alot of trouble trying to prove what it was worth when you wouldn't get it anyhow.
