I am NOT an idiot, but I feel like one right now! I bid on and won an auction for a 4 CD set. I got it in my mail today and they are copies! I got an email from someone else who had bid on the same set and was the 2nd highest bidder. She said that the seller contacted her and said he had another set and would sell it to her. She too got copies and hers don't work! Should I have emailed the seller and asked if they were legitimate copies? The auction description had a picture of the LEGAL CD set! Now what do I do? Grin and bear it? HELP!

Contact the seller and ask for a refund. Be polite but firm. If that doesn't work, turn up the heat. Notify them that the discs are illegal and that you can't use them. Again, I recommend you be polite but don't take "no" for an answer. Once you've received a refund, notify eBay and leave neg. feedback at your discretion. Software bootleggers are the scourge of the earth in my opinion. The seller will continue ripping people off until he is stopped. Sorry this happened to you.

Well, if it was not mentioned in the listing, then it IS mis-representation...you can contact [email protected], see what they say, if anything, ask seller for refund and NEG the rotten egg...

On the other hand, if it was quite inexpensive, yes, you brobably should have questioned the seller...If it seems too good to be true. it is...

shosh I agree with you, if something seems to good to be true it is...but the bad part here is, it wasn't "cheap" I got it for about 3 bucks less than I would've gotten it for had I bought it directly through the actual company who sells it--UGH

twinsoft I needed to consult you all here and calm down a bit BEFORE I blasted the seller...I don't like to shoot and ask questions later I DO intend to email and ask for a full refund!

smoothauction Thanks for the links...can I post the actual auction title without inviting the seller to this thread?!?! Don't wanna get kicked outta this joint I like it here!
Let's just put it this way, it's a CD set for my SON who's TWO...it's a popular CD set sold on TV...are they good hints??

Question sort of off-topic.

A friend of mine had been looking for a CD for awhile and finally found a copy. She bid but was outbid at the last minute. The high bidder eventually backed out so the seller offered it to her and she accepted. I seen the listing myself and it clearly states "liner notes included" and that the CD is in "excellent condition". My friend got the CD and the liner notes are NOT included and the CD is covered in scratches and fingerprints. Does she, as the second bidder, have any recourse? She asked for a refund and he has ignored her. She can't leave a negative because she wasn't the high bidder. Can she report the seller to Safeharbor or does she just have to take the loss?

If you give hints that make finding that auction easy, I will have to lock down the thread or delete any such posts.

Kaffro: I wanted to apologize if you thought I was trying to change your thread. I brought it up because you mentioned the second bidder of the auction you won having problems. Want to make that clear!

kiki2 Oh, don't apologize It's no biggie! I just want to make sure that some other honest person doesn't get ripped off too! I wish I could answer your question, but I can't...have you tried posting it as a new topic? (Not that I wanna kick ya outta here )

It is very unlikely that SafeHarbour will do anything about this. They do not have the skills needed, nor the balls to properly deal with this type of complaint on their own. They will simply tell you they will only react if the copyright holder contacts them directly.

If the seller included a picture of the real CD artwork in his listing and provided you with copies, then I suggest you contact the distributor of the real CD's and state your case there. From what you have said, this is a very obvious case of fraud, not just against the copyright holder but also using the mail for fraudulent purposes.

And we wonder why organizations like the MPAA are always looking for tougher copy protection for their members' products. With the advent of cheap CD burners, thousands of illegal CD's and VCD's of movies and television shows are showing up daily on eBay. They could care less as long as they still get their cut.

btw ... I am speaking from experience!

I emailed the distributor of the REAL CD set, just waiting to hear back from them. UGH, I always ASSUME that because I am HONEST, that everyone else is...guess not Anywhoo...I will let ya know how I make out. Thanks to everyone who posted advice. I TRULY appreciate it!!!

Kaffro, If you go to riaa.com the recording industry of america website, they have some interesting stuff. There is information on piracy. I know when I was in business I paid my ascap dues faithfully.
