I have been having a headache with one bidder. I noticed on my feedback last night a nasty neg.. I have just moved my email to another ISP and he'd tried to get in touch. Back to the point: He claims that he sent me payment for an item, I have no record of getting it. He's posting Negative feedback and now that I've caught up with his email, sending nastygrams. I asked him if he could get a copy of his money order with the signature. We'll see what happens, but if he's still upset, how would I get in touch with this AW mediatior? He wants his book, I want either proof of payment or payment before shipping. Just because it went in the mail doesn't mean it got here, and even then I'd be taking someone's word that they sent it. We had a long discussion on another thread about stuff like this, now I'm having to deal with it.

As far as I understand it mediator's costs money (15.00). First off it is the buyer's responsibility to pay for item, you didn't receive it, you don't send it. If you had received payment and sent it and he didn't get it the burden of proof would be on you. He already gave you an undeserved neg. He has to prove that he sent it and that you cashed it. Which he obviously can't do. So I would e-mail him and very calmly and factually outline the problem.

1. I did not receive payment
2. I can not ship merchandise without payment.
cc it to safe harbor and wait.
If no payment arrives file a NPB and move on.

I would at least ask him for a copy of the money order receipt. Normally, on the receipt it gives the date of purchase, amount, etc.. The buyer might have to have the MO traced. If indeed he sent the payment.

If the Negative is really important to you (i.e. you want it to get the heck out of your feedback), it might be worth the 15 dollars to hire a professional mediator at SquareTrade.

Since you seem to be quite sure on your stance (you didn't receive payment, he hasn't shown you payment proof), there is a really good chance you can win the case.

I emailed that I'd need a copy of my signature on his money order. He sounded like he sent it, but if it never got here it's the same as not being paid. For all I know he didn't send it. Some folks I wonder about.
I never got anything. In fact, his lot was one of about three that was outstanding. I recall contacting him and telling him I needed payment. He told me that it was mailed on Jan. 26th. Fine, but it never arrived.
It seems that some other folks have had similar problemswith this recently. I haven't had anything quite like this in the 2 + years I've sold on ebay.
I've held off negging him, though I feel like it. I want to get this settled, but if he continues to act like a jerk.....boy am I tempted.

His signature on a money order means nothing. Your signature on the back of it is what counts. If you haven't received the money order, the fact that he sent it is irrelevant. You haven't been paid.

Below is an edited version of the nastygram I got. He might have emailed me after I switched ISP's. He's so cock sure that I got it. I had contacted him a while back and said I hadn't gotten anything. He told me to wait, that he'd sent payment. I told him it hadn't gotten there and that was in the middle of Feb., at least. Next thing I know I'm negged and getting this, after I contacted him. Earlier I asked if he couldn't check on the MO, but he sounded like he thought it would arrive. I don't know if he actually mailed this or if it's a scam. He never made any effort to contact me by phone, that I can tell.
"Look guy I have a money order recite that I sent you on 1/26/01 to....... and I have e-mailed you about it and
you never replyed,so I am sure you got it so if you are unhappy be unhappy
with yourself.And just send my book."

This guy is a deadbeat. Yep, you missed some of his e-mails, but you have been in contact with him since. I have no idea how long it takes to research a lost money order. If he really really wants that book, he would act like an adult and instigate the investigation from his end on what happened to that money order. He would send you ANOTHER ONE. He will get his money back from the first one would he not? Fact is, you don't have the cash. He has to PROVE that you got it and cashed it. He won't. End of deal to me. I would file a NPB.

Collegepark...I'm not 100% certain but I believe that M.O. which was lost can be canceled by serial # if it hasn't been cashed (much in the same way your personal check can be stopped by check #). If so, I don't understand your buyer's rage unless he's simply ignorant. Don't neg him just yet. The ownness is on him to furnish the stub where he bought the M.O. and have it canceled. Whether he likes it or not THAT IS HIS RESPONSIBILITY, NOT YOURS! For this reason I keep ALL my stubs with M.O. buys and throw them out ONLY when I have the item in my hot little hands. I have a similar situation as yours right now. My buyer says he sent payment on 2/26 but I haven't received a thing. I emailed him last week and never got a response...until yesterday! I thought he lost interest in acquiring what he won. Anyway, his response was more in giving me the benny of the doubt. He was going to cancel the check and issue another one. My response back was that if snail mail presides and his stopped check comes in, it will come back to him, warp 9. Up until yesterday I was typing up a neg all ready to post and then a little light poked through the clouds. Still not out of the woods though. I will be at the Credit Union this afternoon and find out how lost M.O.s are dealt with. The tools are there, just keeping a cool head and learning how they work is the hard part. Boy...isn't all of this FUN??
