Good-morning,

I will try to deep this short as possible. Nsyc tickets up for bid. I won the bid for my daughter to go and her friend/ The reason I bid on these particular tickets, is they happened to be in the same row as her cousin. Sent money order certified, which cost me more money. Seller writes me, Sorry he does not have the tickets, ticketmaster never sent them to him. He wrotes e-bay, that he wants his lisiting fees back. I wrote him a letter, and said you got to be kidding me. Safe harbour writes me, and I told them he should not have sold tickets he did not have in hand. Anyway, I did recieve my money back. Wrote him and told him I was going to leave him negative feedback. he wrote me and said if I left him neg feedback, he would leave me neg. feedback.. Any advice?? What should I do? jools

I'm funny about certain things, you can do anything to me but when it comes to my children look out. I would neg him, and then respond to the retaliatory "seller's e-mail; "If you neg me I'll neg you". That should give you a chance to show what he did, when you neg him. And show how he runs his business in your response. If I told my daughter I got her tickets, and then had to take it back (she's 11) my life would not be worth living for weeks.

That is why I consider pre-sales a bad idea. Things don't always work out the way they should.

It happens all of the time on Ebay. Many, Many sellers do this. I used to browse the Beanie categories and there was always hundreds of pre-sale auctions. I'm not sure if it is against the rules but it's just not a very smart thing to do. These people are taking a big gamble that they will be able to get the items in a timely manner, if at all.

I personally would leave feedback (Seller did not state this was a pre-sale auction and was not able to deliver). Whether you leave a neg or a neutral, that is up to you.

At least you did get your money back.

I thought it was against ebay rules to sell something you don't actually have.
I would forward that threat of retalitory negative feedback to safe harbor and then neg the seller (stating just the facts such as - sold tickets he did not actually have) and if the seller retaliates, I would then ask safe harbor to expunge it.
I would usually suggest a "neutral" when no one is out any money but I think it is so wrong to sell something you don't really have and for a planned event (where you could have made other arrangements but didn't because you thought you had these tickets). And it involved your children (who are the usual concert goers for nsync). So that warrants a neg. especially to warn others of his business practices.
I don't know if safe harbor will, indeed, expunge a retalitory neg. There has been some changes coming to the feedback system but I don't think retalitory negs were addressed. It was posted last week on the announcement board and may still be available (the new feedback changes).
