Feb. 2 of this year I was watching a auction on E-bay. I noticed the area code was in the same state where I live so I called the guy and ordered a computer directly through him. He of course took my check by phone, and promised me the computer in 7 days. Needless to make this a long story I still do not have the computer. I notice he is still running auctions on ebay and the fact is I have contacted some of the people he sold computers to as far back as Jan 23 and guess what...yep they have not gotten their computer either. I called the Pa. State Police today and they tell me this is a civil action and not a criminal action. I have talked to this guy weekly since I ordered the computer and each week he has a different story. Can someone help me out??? Again I did not buy from ebay auction I bought direct.
Thanks so much

If you MAILED the check, it is a FEDERAL OFFENSE ... go to the post office and ask for a mail fraud form. Fill it out and file it. The USPSinspectors will send him a letter that should get your computer shaken loose.

If you PHONED in the check, I believe you have SIX MONTHS to cancel it and recliaim the money. Ask your bank.

And contact your state's atty general's office "consumer fraud division" ... they can handle the civil stuff.

Get a statment from the bank, to prove the trans. If he lives in the same area as you go knock on his door,If you only have his phone # the telephone Co. can supply his address. And get the computer or your money. If he refuses hire a lawyer and go after him.
