I had a sle close last night high bidder has emailed stating they will use escrow. I did not agreee to take escrow in my terms and conditions and I would rather not take it. Am I required to accept escrow paymnent or can I tell her no ? Item sold for 96.00 so not a lot of money involved . I don't want to take escrow becouse It appears to be pain in the ....

If your terms state No Escrow, just explain to the buyer that they must abide by your terms.

meya Terms don't state "no escrow " but they also do not say escrow accepted . there is a spot under payment options in mr lister to accept escrow and we did not check this

Even though you don't spell it out in your terms, on the auction page it would say you accepted Escrow if you had checked that option.
Reply in a business manner with the Payment terms you do accept that were spelled out in the auction. They can't force you to use any payment method you don't accept.

A few points,
1. If the buyer is willing to pay the cost, why is there problem?
2. While $96.00 may not be a lot to you, It may be quite a bit to this buyer.
3. The buyer may have been burned by another seller.
4. The buyer may be a complete computer/internet/ebay neophite and want the protection they think they get from escrow.

Greg-who gives a flying fig? If seller states no escrow, seller doesn't need to explain to anyone. Answer to original question is "no".

seyms the seller did not state in the auction either way on the escrow. They left the eBay field blank, but did NOT state they did not do escrow.
So what is your problem with escrow?

I would agree with others. There's nothing particularly bad about escrow, it just takes a while longer to get the money. You probably have a newbie who is scared of losing his 96 bucks. And I think there are a lot of people for whom 96 $ is "a lot of money"! If he's willing to pay the escrow, just let it happen.
I know it was not nice of him to TELL you that he was using escrow ... but there are times to be anal about your TOS, and there are times to suck it up in the interest of completing the deal.

With Escrow, the buyer has a MUCH easier time keeping you from getting your money for the item. READ the terms of the escrow company, and decide if you want to deal with them. You will probably decide not to.
And tell the buyer that the auction would have said "accepts escrow" if you accepted it.
They are quite safe mailing a opersonal check ... if you don't mail the goods, they have the US federal mail fraud laws behind them.

ABACAXI : The first thing I did was looked at escrow terms and YES it does make it easier for the buyer not to pay .The way I see it I ship the item If she decides for whatever reson not to accept I not only do not get paid but I am out shipping and enough time has passed that the second bidder is probably no longer intersted.
Gesi: Greg, A big problem I have in this case is this was a ten day auction , bidder bid first day never contacted to ask about escrow just declared after the sale that "I will be using ebays escrow service to pay"
on the whole I am easy to get along with ask me for something I will probly go along ...Tell me you are going to do something and we may have a problem

Reply to the bidder and tell them that you do not use escrow, escrow was not mentioned in your auction because you do not use it, and they can just send you a check or money order by the US mails like the rest of your buyers do.
They HAVE TO FOLLOW YOUR TOS! Even eBay will not force you to use escrow if you don't want to.

I would take it but.
Iescrow allows you to modify the terms. Make the S/H ~$10 higher, to compensate you if it's returned. Make the S/H non-refundable, and make sure the bidder pays iescrow fee. And make the examination period short (1-2 days)
I do find it very difficult to actually get iescrow to send me the check in the case that the buyer neglects to followup and indicate that they received the item. It's supposed to be sent automatically after the examination period but they don't always do that.
You know that iEscrow changed thier name to tradenable because they are in Calif and Calif has some very strict laws governing escrow companines. Primarily targeted at real estate escrow companies.

You do not have to use escrow. Just because your TOS or auction didn't say you didn't take escrow does not mean you have to. Your TOS and auction also didn't say you didn't take prettily colored stones as payment either. The way I see escrow used is:
Customer sends money to escrow
Escrow tells you to ship because they have the money
Customer receives item and tells escrow they are not satisfied.
Escrow refunds money to customer.
Customer now has the item and their money.
You never hear from customer again.....
