This is CRAZY! I had a DVD I was selling new, winner paid with perosnal check, despite my ad saying I only accept money order and cashiers check.My bank tells me to tell her it will take 14 days to clear. I told her that. 4 days after recieving her check, She said she is moving in 10 days and will be on the road. So I mailed it early, despite my worries. So far no bounced check.

but then I get a email from her saying the DVD is used for it doesnt come with a top sticker (this is a older DVD that doesnt have a top sticker), and she is going to check the DVD in her lap top and will get back to me.

2 days later, I get my first negative, she saying DVD was not new (it WAS new), and I mailed the item 7 days after check cleared (SAY WHAT??!!) and I ddint answr any emails! (she DIDNT ASK ME to respond back!))

So I gave her a negative back!!! She is a newbie, only 5 positive. I had to negative her! When is the bank EVER going to educate people! It doesnt take a day for a personal check to clear! I HATE personal check!!!!!!

I did put at the bottom of her negative comment (even though ebay sure doesnt give you enough room to say anything) that she violated my TOS, and that she never gave me a email to respond to, but now she is threatning to contact ebays to get the negative removed, and to get me in trouble!

So the question is, what is wrong with personal check newbies, why do they always use "check cleared day before i cashed it" scenario, and can I get in trouble with ebays for giving her a negative? Also if she is on the road, how come she had access to a computer to rate me?

what do you guys think?

Sounds like you have a sadly uninformed customer. From what I can get from your posting, you shouldn't get in trouble for giving her a negative.

You are not responsible for her bidding when she knew she was moving.

I think that you should have held the item as you said you would and she could have sent you her new address when she got settled.

I don't see how you can get into any trouble or leaving a negative. I seems to me you were more than willing to work with her.

YOU broke your own TOS and now you're mad?
Why bother to have a TOS if you don't use it? Then don't complain when the bidder doens't use it either.

Twelvepole, I knew you would come in with your sarcasm. If you read carefully, this person would have negged me ANYWAY had I mailed the item out 14 days from the check, for remember she said "item mailed 7 days after clearing".

Also READ. She negged me for "selling a non new item" when like I said item was new. She also mentioned unanswered email when she DIDNT tell me to reply back. She also mentioned "seven day after check cleared", when I mailed it near my TOS on personal check. I swear hoe can anyone ask for help around here when you constantly come in to take a jab at someones problems?

So tell me wise one, what do you do with personal check customers who will constantly email YOU saying things like "checked cleared two days before you recieved it, so where is it?" or you get a negative from a bidder, despite your best efford as a seller to accomadate bidders need, even if the bidder broke your TOS, what do you do? Or get a negative with the bidder claiming you didnt answer to her email, when she didnt ask to reply back to her email?

Or is life too "grand" for you?

Sorry to hear about your undeserved NEG. I do not accept checks (under any circumstances) and when I do receive checks in the mail (and it happens often) I email them telling them I have voided their check and to please pay with one of the methods described in my auction, and their voided check will be returned to them with their item once they have paid using a method I accept. If they want their check back first I tell them to send me a self-addressed stamped envelope and I'd be happy to.

These bidders need to learn how to READ the auction descriptions. NO CHECKS means NO CHECKS!

I think you were very nice to accept their check even after your auction said that you didn't accept them. The person here who is giving you grief for not sticking to your TOS is the same person who would have given your grief if you DID stick to your TOS - they would have told you to make an exception. You can't win

You cannot get into trouble for NEGGING her. People have done far worse with feedbacks and ebay does nothing about it. I wouldn't worry about it. If you have a good feedback rating your NEG will hurt her (since she is a newbie) much more than hers will hurt you.

At this stage just move on. I know that they can be a pain, but there is nothing more to be done.

There are a lot of high feedback buyers and sellers just as bad, so dont sweat it. Life goes on.

EG right on top of things again! She hit the nail right on the head! ironking? Listen to EG! She has had every loony tune out there bid and win her auctions, and she deals with all of them in a kind but no nonsense way. Take a page out of her book, and those that offer you sarcasm, ignore them.

I don't tell a seller to make an exception to their TOS, it just amazes me how many sellers do and then get burned by it and then feel the need to come here and complain...
It's simple, the seller relaxed their TOS and now is paying the price.
Check will probably bounce too and yes my life is Grand

twelvepole, DO YOU READ??!!! That I bending (did I actually bended my TOS??!!) my TOS has NOTHING to do with my MAIN ISSUE complaint. Yet you find the ONE THING in my post, and you hang onto it like a pit bull,and pick on it like a child. I see your comments on other peoples problems, and you do the same thing, do you just enjoy posting "troll"ish posts? So since you are a TWELVEPOLE, if I see you selling THIRTEEN units of a POLE, can we pick on you for that? Are you related to rollanotherone?

I read very well but I can see from childish attacks on me, that this is really a problem for you and are having diffuculty coming to terms with YOUR mistake.
Hmmm EG's advice... DON't Take Checks.... your TOS "I don't take checks..." complaint here, took a CHECK and now the buyer left you a neg...
The actual underlying problem is you didn't abide by your own TOS.
So yes you should take EG's advice.

did the MAIN reason a negative was left was because of the check? NO! It was due to unanswered ermails she never asked me to reply to. Dig?

I have come to the conclusion many people don't know what a cashier's check is. To them a check is a check and they probably have a box full.....can't be out of money, I still have checks!

I wouldn't worry one minute more about it. Just respond to the negative something like "I was accomodating, she wasn't".

The reality is unless you're selling cars a neg or two or more isn't going to make any difference to your business provided you sound reasonable in your response (no CAPS for emphasis, just a measured statement with a period at the end of it. The other person comes across as hysterical and a little bit nuts.)

The first neg is the hardest.

I would suggest that you return (or tear up) any checks you receive and restate that you do not take any checks. If you don't have your appropriate payment within 14 days file an NPB alert and get your credit if they don't pay up. No nonsense. No baloney.

I take checks only because my bidders are very trustworthy and that's the way I want to be treated.

This bidder falls under the not very bright category. I suspect they will soon be NARU'd.

Hang in there! Most eBayers aren't like this one.
