I think these are those boarderline questionable items they sell at flea markets.
The package reads similiar to (tiny letters) OAKLEY SUNGLASSES (Huge Letters)
They don't make a claim of being Oakley's just sunglasses doubt it will get cancelled.

Regardless if they're being advertized as Oakleys or not, the intial posters point I believe is that there is a 99.999% chance that it will NOT get VERO'd by eBay, nor will the seller be suspended if they relist.
However, if any individual seller did this, even with 100% positive 2000+ feedback (unlike USPS) they would be vero'd and then subsequently suspended if they listed them again. This would be a clear indication of a double standard.

WOW...I dont believe it I just checked.
The two Oakley Sunglasses Auctions USPS had on have been Vero'ed...COOL!!
I noticed USPS was very Carefull not to put the words OAKLEY in the listing..but the picture clearly showed the words and symbol for Oakley.
I am going to keep an eye on them for other fakes...Maybe I can get them suspended as well!!

Specific items pulled for VERO - sure, but suspended - I doubt that's possible.
A primary ebaY growth strategy calls for attracting large established businesses to use their site for e-commerce. They appear to be willing (and eager) to ignore their stated TOS to make it so.

I noticed they relisted the Item...I let Oakley know. Lets see what happenes now.
I noticed the USPS is selling fake oakleys on Ebay...they are very careful in the listing to not say the words OAKLEY, but
if you look in the pictures you can see the work Oakley on the Glasses and the fake plastic cases. In the last listing looks they they
have gone so far as to Edit the picture ..taking the Namer Oakley off the Glasses.
I complained last week and you cancelled the Auctions but I see now they have relisted...is this now grounds for Suspension on Ebay
or Is the US Govt above the rules of conduct there?
Here is the ID and links to the listings. Are you going to cancel the auctions or continue to let them sell fakes?

I'd report them again, but this time I'm sure eBay will claim they have no proof.
Therefore you need to contact the Oakley VERO address instead and let them know.
Im amazed they VEROd them.
With regards to figmente's comment: "Specific items pulled for VERO - sure, but suspended - I doubt that's possible. "
If they pull the "relist" trick, then any normal seller would be suspended IMMEDIATELY AND PERMANENTLY for doing so.(I had a friend have that happen on a legit piece of software purchased at retail and listed on eBay unopened, and not oem, not academic.. The Vero people went a bit overboard on that one).
This will be interesting to see if a newbie eBay safeharbor employee actually pulls the plug on USPS without realizing that eBay is partners with them. That would be hilarious, especially given the problems with USPS's auctions a lot of people have noted.

I went to the link but I didn't see anywhere to look for sunglasses except for ebay's search and it brought up thousands of listings.

Looks like I may get them Suspended!!
Check out the email from Oakley Vero.
""I have received all of your emails and will reply to each as soon as
possible.
A short answer to this question: eBay does not "self police." Therefore,
sellers are permitted to list infringing items for sale and the auctions
will run until notification from the trademark holder and action by eBay.
I will call this account to eBay's attention for suspension.
Thanks!

Lowprofile, I think you should let some reporters know about this story. Especially if USPS is not suspended.
Email [email protected], [email protected], [email protected]
And to give some context, FYI, I've heard USPS has sold inappropriate items in the past, such as movie screeners (these are videos intended for review only, never for sale).

I am curious as to why all the resentment for this seller?
I personally have dealt with them on several occasions and have found them to be one of BEST sellers I have had the pleasure of dealing with on eBay.
I wish more sellers acted as the USPS does, then there would be fewer bidders coming here complaining about sellers. Oh well I guess ebay might suspend one of their BEST just to give the appearance of fair play.

Well, actually, why should USPS be treated any differently than any other seller?
eBay is strict in enforcing VeRO. If they want to take that hard line under the supposed guise of law, then USPS should be suspended as any other seller.
If they're not, than it becomes pretty clear VeRO is for the corporate smooching we all suspect it to be.

I havn't dealt with the USPS (buying from their sales on eBay that is... of course I've dealt with them for shipping)
But based upon their feedback and what I've read here and elsewhere, they pretty much don't give a ---- regarding packing, shipping or insurance. They simply forward the package as they originally LOST it without repacking to meet THEIR OWN CRITERIA for other shippers (2" packing on all sides, etc..)
Others have stated they also charge insanely high shipping rates..when they have 100% full knowledge of the actual rates.
They're BULK sellers and show it per their feedback and complaints.
Also, as others mentioned here... They should NOT be exempt from all the same rules everyone else has to abide by, and that is where the complaints here are comming from, regardless of their other past history.

If eBay does not take action on this issue, then we all know what's really going on.
Even though it seems minor, it is good that you brought this to our attention.
If I could sell fake oakleys for the price they are selling them for, do you know ow much money I would have?
It's illegal to sell counterfeit merchandise. It's a violation of federal trademark law to sell merchandise that bears the trademark of a company but is not made by that company. I'm SURE USPS knows this, it's just one of those, well, we have it so let's sell it kind of deals.
In fact, it could very well be merchandise that the Postal Inspectors siezed.

ebay closed the Oakley auction relisted by the USPS, but didn't suspend them as the rules state.
How many times have we seen sellers come here and complain that they were suspended for relisting after ebay closed their original auction?
This is absolute proof of ebay's double standard.

Do you really want the USPS suspended from eBay? What do you think they could do to all the eBay packages? Do we all want hassled when we step up to the counter? Don't they already ask enough dumb (do you want any packing supplies today) questions every time we mail our goodies? Get the Postmaster General of the United States ticked off at eBay...

ROTFLMAO yeah like that was really going to happen... Have you really looked at all of their auctions... probably a 90% completion of sale or better and they sell alot of stuff.
I am betting that deep down, most sellers wish they could get the action that USPS is getting.

You are missing the point. VeRO is being used with abandon against individual sellers. eBay defends this under the auspices of the law.
Therefore they can make no exception, nor argue one. I wonder if someone can sue eBay for suspending them for VeRO issues if eBay refuses to apply the rules to all sellers?

twelvepole:
Any one of us could get the action the USPS is getting if we got all of our merchandise for free! Since it all falls in their lap, they simply start the bidding at $1, which almost always gets things rolling.
As far as my personal experience, I bought two lots from them last month and they had horrible customer service. I sent three emails asking if they would combine my shipping costs (of course, they wouldn't) and three more emails for a total including insurance. They kept responding back to my old emails that had already been responded to. It was incredibly frustrating and took four days of emailing to get everything resolved.

Lowprofile, did you write to eBay and ask them to explain how they could not be suspended?
But wait - let me predict their answer.
Blah blah case-by-case basis blah blah blah we cannot discuss individual cases but blah blah blah.
Lowprofile, I appreciate this opportunity to be of assistance, and wish you the best in your future trades. Have a great eBay day!

Dear eBay,
I have learned recently that USPS has violated your VeRO policies and had auctions pulled, only to put them back up again and have them removed again.
My experience is that individual sellers who have done this have been dealt with swiftly and severely by having their account suspended. My question is - how many violations would it take for USPS to be suspended?
