Maybe someone can help, I deal and buy glass and pottery. I bought 3 glass dishes,That said I will be really happy with this treasure. I wrote her at auction end before they wrote me, I paid promptly, within a couple hours of auction ending, Still no feedback. THE ITEM WAS MAILED PROMPTLY . When I received the dishes 2 of them had several chips. There was not any mention of chips or I would not have bought them.When they arrived they were wrapped in several layers of paper all around them. A lot of paper that made shipping cost more, and foam on the bottom.As soon as I received them and saw they were chipped I e-mailed the person. She sent a letter back stating she would get back with me on Monday. Well I just get a letter back SAYING SOMETHING ABOUT FAMILY MATTER AND stating Send them back I will refund the money. SO I ALREADY PAID SHIPPING ONCE AND INSURANCE .Now she wants me to pay to ship back which will cost me more in the long run.How do I handle this ? I realize this may be petty stuff to some but I would like to know how to handle this . HELP PLEASE. THANKS

When she recieves the merchandise back she should refund your shipping cost. I would wait til she gets back to you and clarify this.

Were the items insured? Maybe they were chipped in transit. I NEVER AGAIN will refund money before I have the item back in hand as I have been ripped off by bidders looking for a freebie.

If the items are insured, I would make a claim. Be sure you have saved all the packing materials. If you declined insurance, it is your responsibility, and your loss for being too cheap.

you may want to clarify the shipping cost issue before you send them back as you say if she only refunds the sales price and you have to pay shipping both ways it may not be worth it.
She is not obligated to refund shipping costs , I see a lot of folks say in there TOS that they do not refund shipping cost's since they are paied to the carrier and not them.
If in fact they were chipped prior to shipment then I think she shoulc pick up shipping both ways but that is her decesion and you should find out up front what she intends to do

If the chips were not mentioned in the ad, the seller owes the buyer an apology and shipping both ways. No ifs ands or buts and I'm a seller, only occassionally a buyer.

If items chipped in transit, seller should bear the cost for one-way shipping.

If items chipped and wasn't disclosed in listing, seller should bear cost for round-trip shipping.

In any case, clarify with your seller what it is she intends to refund so there are no nasty surprises when your payment arrives!

First of all I wasn't cheap and did pay for insurance. I complied with all the rules. NO I don't think this happened during shipping, as I stated there was to much paper around each item. She even complained the shipping was more than she quoted me, I ship with bubble wrap and peanuts.To keep my pieces safe. There was not any glass chips in box. Some of the chips were very big and noticeable.I feel she should in all honesty return all fees. I am not trying to just rip her off.. I feel if I just send back the items she will do nothing.

Then seller should pay for shipping both ways, but I'd still get this confirmed with her before I put the items back in the mail to her!

I can understand your distrust with shipping them back to her, but, putting my seller hat on, you can't expect her to send you the money until she has the items. If her feedback is okay, I'd ship them back and give her the benefit of the doubt (AFTER clarifying what she was going to refund!)

I agree the seller SHOULD REFUND shipping both ways If I was the seller I would.
However I don't think there is anything obligating her to do this.
So I would figure shipping costs back to her and have a clear understanding just how much she is going to refund before you invest more money in shipping it back to her.

well here is the latest buyer has turned it all around on me. Said the items was old and I was getting good deal,that I should shop in shopping malls so I could use magnifying glass on the items I bought. Refuses to pay shipping.TOLD ME THEY HAVE 145 POSITIVES ONE NEGATIVE WILL NOT HURT THEM. I told them God knows the truth I sent my money and paid in good faith believing I was receiving what the add said I getting A GREAT TREASURE..lol But at least get what I payed for.So I told them I hope they enjoy the money.I told them I hope not to run across anymore sellers like them.and will write it up to a lesson learned.

Welcome to the world of eBay, where dishonest sellers are free to prey upon the trusting public.

There was a thread here a few months ago asking how many sellers are still BUYING on eBay, and the answers were OVERWHELMINGLY NEGATIVE.

I hope you charged the purchase on your credit card so you can initiate a chargeback.

Save her emails. Email her back and state that, in your opinion, she has committed fraud and admitted to it via her communication with you. The chips were something that needed to be disclosed by a reasonable seller. This item in chipped condition is a materially different $$value than a chipless condition example. Inform her you will file fraud charges with ebay-safeharbor-fraud unless she makes good immediately. AND FILE the charges.

The fraud charges with safe harbos sound like a good idea. You should print a copy of the ad. I would also copy the pictures if they are still up as they may not print clearly.

Granee,seyms and Skip555, yes I paid with credit card so now I will be paying extra with the interest charges. Yes I saved ALL CORRESPONDANCE.The pictures are still up,also the pictures were not close up so you could see them well. My printer is not hooked up right now.As you can see I am pretty new to all of this. I started on Ebay last year for a little extra income I am disabled.I was off for about 5 months till a friend gave me this computer.While I was on I did pretty good for just starting,but I got one neg. from a person I sent bowls to simiular to this.They were ok when I sent them,and I packed them very good, She didn't email me back or anything to say that they were chipped just went in and gave me a neg. If she had of I would have refunded all of her money. So they threw that one instance at me.All of my feedbacks are excellent from buyers and sellers alike except that one. I have always went in and gave good feedbacks even though at times I wasn't happy with all aspects of transaction or delivery of items.I want to thank everyone for their help.Now should I give them a neg. and say buyer beware?

You WILL BE HAPPY TO NOTE AFTER ALL OF THE EMAILS BACK AND FORTH AND ALL OF THE HASSLE.They said for me to ship the items back in ONE PIECE and they would refund my money and shipping one way.This was after my last email last night to tell them to enjoy the money and I would remember their name and that I hope to never run across another seller like them. AS FAR AS I AM CONCERNED THEY CAN KEEP IT NOW..I AM FED UP WITH THE HASSLE.

Please don't let this seller get away with this. They probably do this crap often and get way with it. Do not let these jerks rip you off. They ripped you off, don't continue to let them walk all over you. You may get a negative, but you can hit them with the same thing and maybe more since they committed FRAUD.

My advise is to tell the seller that you are requesting a refund for the total amount you have already paid PLUS the cost to have them shipped back to them WITH delivery confirmation. (that way they cannot say they never received them once they leave your hands.) I would also tell them that in the meantime you have saved all the email correspondance that has transpired between the two of you along with the actual auction description describing NO damage or chips being present. I would tell them I am forwarding all this information to safeharbor to investigate fraud and when the situation is rectified (by you receiving a payment in full) then you will email safe harbor and let them know that restitution has been made but until then, it will be investigated by ebay.

I recently had problems with a woman with good feedback ( no neg.) issue me a check that bounced. I had to pay the check and go back on her for payment. I got the run around.......so I told her the same thing as I have mentioned above......It got her attention real fast and needless to say, I received my money. I never did have to forward anything to ebay, but just letting her know that I was going to was enough to perk her up and get her attention. Good luck and don't give up, you are due a refund in full if damage was not noted and there was no chips to be found in the shipping carton upon arrival. Try this and let us know how it goes!

Even though your printer isn't hooked up right now, I think you should copy the ad and the photos to your hard drive -- you can always print them off later when you do have a printer hooked up. (Or you can put them on a floppy and take them somewhere to have them printed.) I would copy the photos in addition to the ad, because, depending on your browser, sometimes they don't get saved to your hard drive when you save a copy of the ad. (Also, if you received the end of auction notice from ebay, it includes the full text of the ad.)
