I know I will get a negative fb from this guy, because he negs everyone who negs or neutrals him, close to 100 people so far out of 300 transactions. He deserved his neg and all of his negs since they all say the same thing: the customers didn't receive what they paid for.
I did the paypal complaint form, even though I know from experience that they will never try to get my money back. I used existing funds to pay for this stuff. When you have existing funds they don't give you the option of using the credit card until the funds are used up.
With that many people complaining to ebay about this man in the past month and half, why is he still allowed on???? Ebay kicks off sellers who have done nothing wrong, then allows these crooks to do this for a period of 2 months without any intervention at all.
I know in the morning I'll have an ugly red mark on my record for negging a crook, and I can live with that. Had those negatives on his record been there before I'd bid and paid, I would never have bid or paid. Most of them are from the past few weeks.
How should I respond to this feedback I will receive? It seems he copy/pastes what he says. Almost all of his negs to his victims are this: THIS BIDDER IS VERY DIFFICULT TO WORK WITH. MEAN, POOR EMAIL COMMUNICATION.
The fb he leaves are in all caps just like this. It'll prob. be what he posts to me. Kinda ironic, it took him 2 weeks just to send me a total with the shipping/handling which wasn't stated in the auction. I've been emailing him all month and he hasn't responded as to where my merchandise is.
While I feel the proper response is important for either a buyer or seller, I feel it's critical if you are a seller.
Please leave a calm factual response in normal type....when I see that, as a buyer, I pretty much understand what really went on...
Hard to imagine someone like you describe, if a high positive seller, going Sybil all of a sudden...
Personally, I leave factual feedback for every transaction I've had on eBay....good, bad or indifferent...and have negged deadbeat buyers more than once. I also praise buyers for their prompt payment, usually the day the payment arrives or clears, depending on method.
I pay particular attention to sellers who wait until they've received feedback before the leave it because I know they always receive payment before shipping the item. I generally avoid such sellers where possible....it's just a point of ethics with me. It's sounds as if your seller is such a person/business.
If enough people complain to Paypal, maybe they'll freeze the sellers account...that is a good question to put to Damon over in the Paypal forum. I hear he's back from vacation...
Good luck!
Pat

I usually recommend leaving negative feedback when negative is due. However, in this instance I would recommend not leaving feedback quite yet. Finish the investigation with eBay and Paypal. By the end he may be NARU and negative feedback won't make a difference to him anymore, but it will stay on your record forever.

I had already negged him when I posted this. He negged me soon after. The few people that have received their stuff got it like a month to two months after they paid for it. He deserves this neg.
The neg he left reads:
Complaint: This bidder sent us RAMBLING emails that are very hard to follow. Nasty, also.
Response: 1 sentence asking where my stuff is is rambling?? XXX is a crook. check his fb
The XXX was identifying info that I took out.
I seriously doubt paypal will get my money back for me. I'll just remember to buy all shipping supplies from Wal-mart like I used to before. At least I'll get what I pay for. I hope ebay eventually kicks his butt off. I'm not worried about the neg being on my record. Anyone checking his fb will see what kind of person he is.
Well, off to the post office to mail off a bunch of packages. I actually send people what they pay for lol. What a concept.
Most of my customers don't even have fb yet. I think I'll be the first pos. on their fb. That's kinda cool . Although I think it's other sellers buying up my stuff because I had pics so fuzzy no one else wanted to bid on them lol. It was well worth the $$$ for my new camera with a flash Now all my pics are clear. I'm running my first batch of clear pic auctions this week. I can't wait to see if I get better bids now.

I've always wondered about that. Till what point does Ebay Naru sellers with alot of negs(if they even do). I've seen one seller that has 3000 feedback, however 117 are negs and about 79 neutrals. 58 negs and 40 neutrals are within the past 6 months. Now I know within the ratio he still has alot of positives, but I've seen alot of sellers with 3000 and up in feedback with only maybe 2 to 5 negs. I was thinking of bidding on this seller's auction until I seen his feedback.

Did you ever receive your items?
Calling someone a crook in feedback is a step toward having it removed by ebay.
I wouldn't like it, you wouldn't like it and ebay certainly frowns on it.
If you received your items, he's not a crook, he's slow and inconsiderate. That's the way the negative should have read. If you didn't receive it, you shouldn't have waited until the investigations were done and then posted feedback. You have 3 months to do that. I think you've just kissed your money goodbye.
If you feel uncomfortable send the info to ebay's safeharbor and let them read the negatives. They will suspend if they feel the negatives are mostly for the same thing (ie: no pay)

No, I never received the items. I doubt I'd have a chance at getting the money back anyway since I paid by paypal and it was under $25.
I called him a crook in the response to my neg. only. If ebay removes all that due to that, that would be cool with me. I'd never wait 2 months to send someone's stuff to them. At least 70 customers have not received their stuff from this guy. I do not regret negging him, he def. deserves it.

I've been receiving emails from others this guy ripped off all day since I negged him, one guy even welcoming me to the "fan club." Just made me feel warm and fuzzy all over. Many of these haven't left neg. fb for him yet, but did tell me that they were filing complaints with ebay. There's prob. over a hundred that haven't received their stuff from this guy in the past month/2 months. At least I'm in good company I guess. But my purchase was for less than $25 so ebay won't help.

Well, this guy sent via UPS a box of newspapers and a few rocks so now he's free and clear with paypal either way since it'll show a delivery was made. Gotta love it.
I'm still getting emails from other victims. Evidentally one was successful in getting the neg removed from their fb after finding out this guy had done this before and been suspended by ebay a few times for failure to perform and ebay keeps letting him back on. Why?????

If you can get in touch with others he "stole" from, and he receives 3 negs in a row, Ebay will automatically suspend him. Good Luck.

The best thing for you to do is send all documentation to ebay's safeharbor. You may have to keep sending it but one day they'll wake up and see the light.
Three negatives don't automatically suspend someone. A total of -4 does, but with his feedback, they will probably boot him. If everyone of those people would leave negative feedback before you send it in, it would be a whole lot better.
What do you mean he sent you rocks? Were they "gems" that you ordered or was he being weird?

the auction was for large quantities of tape....I received dirty....ordinary rocks that was surrounded by newspapers.

As I recall from some threads a while back, some people have had success with pulling personal info and then sending a complaint to the local authorities. If you and several of the people that have emailed you have recieved product other than what was specified (especially if it's basically just newspapers and rocks), it seems like that would be grounds for a complaint of fraud. While $25 isn't much, if enough people complain the total should grow enough to get their attention. Just a thought.
One of his victims emails me just a few moments ago. It turns out he goes by many different aliases! He has faced felony fraud charges in NY for scamming thousands and thousands of people from things such as false magazine subscription services to other scams. But this was back in 97 and even though he was investigated for all this, he's walking the streets scamming more and more people. 4 years and they haven't locked him away yet! what does it take for people like this to get put away?? Someone had emailed me a link to a newsarticle pertaining to the case. It doesn't state a conclusion to the case. This guy's real name isn't even what he told any of us new victims.
Ironic thing is, he scammed me before with the magazine scam! Only thing is, I never knew his real name before now, so I had no idea that's who he was.
