The TOS That takes the cake
I was looking for a certain widget. I came across a seller who had one very reasonably priced and was going to bid until I read his TOS. I copied and pasted, there were some parts in red(don't think I can do that here) and enlarged(that either). I think some of this is a bit laughable but I am sure that some of you will agree with this person.
You will initiate contact within exactly 48 from the auction close. If you don't negative feedback will be left. I ask you to do this because I do not want to waste my time contacting a bidder that may or may not pay. I will have your payment in my hand within 8 days of the auction close. There is no reason why it should take any longer than that. I do exclude Sundays because the USPS is closed. I do not accept excuses. Negative feedback will be left if it takes any longer than 8 days. I will file for a refund of my Ebay fees. I will also watch your bidding activity for three days and email any sellers whose items you are bidding on that you did not pay. You will pay an additional fee if you choose to use Paypal or Billpoint. I feel I should not have to pay a fee because you are too lazy to go buy a money order or too paranoid to send a check. I charge a flat shipping rate of $7.50. This will be Priority shipping. You will be required to pay an additional amount for insurance and delivery confirmation. I do not ship any other way. If you ask to have it shipped another way I will leave negative feedback and file for a refund of my Ebay fees. Priority shipping normally takes 5-7 days. Ten days after auction end I will expect positive feedback from you on the transaction. Neutral feedback will be left If you do not leave feedback or contact me with any problems by or on the tenth day. I feel I should not contribute to your feedback rating if you do not contribute to mine. All neutral feedback's will state: Not a positive transaction. Problems with bidder. F- I will leave positive feedback 5 days after you have left me positive feedback. There will be no refunds under any circumstance. If asked and I have not left feedback, a negative will be left. Do not bid if you do not agree to any part of the TOS.
The item did not have any bids. Can't figure out why, sounds like a charming chap to do business with.

He had about 1 1/2 pages of auctions up. Two or three bids from people with 0,1,2, FB. I was afraid that he would somehow found out I looked at the auction a wrong way and negged me somehow.

Email him and ask him if he takes Bidpay!
Then leave him a negative fb for not accepting it.
How many feedbacks did he have?

Wow! I think he needs a picture of a guy wearing a hood and brandishing a whip to go along with that astonishing TOS.
I can see four places where his policies differ from eBay's, two which violate eBay policy:
You will initiate contact within exactly 48 from the auction close.
Ebay allows 72 hours.
I will have your payment in my hand within 8 days of the auction close.
Doesn't eBay suggest 10?
I will also watch your bidding activity for three days and email any sellers whose items you are bidding on that you did not pay.
Auction interference.
You will pay an additional fee if you choose to use Paypal or Billpoint.
Against eBay rules.

LOL -- this one needs to be counseled into a different career. Wow. (Can you imagine him as a parent? Or boss? Or even spouse? (I presume it's a him.)
He's got several ebay violations in there too. Wonder what ebay would say about that?

Thanks for the laugh.
Sounds like the terms a control freak would write. The only thing commendable is that he/she included this information in the auction description rather than sending after the end of auction.
At least people know up front what they are dealing with and can run away as fast as they can, or bid.

Not really that astonishing when you consider he has probably only had that many transactions. He a few negs. Unreasonable seller, damaged item....blah blah. You think they would have gotten the unreasonable bit from the TOS.

OMG and ROFLOL! That is the funniest thing I've read in a week. What a basket case this guy must be.
My favorite part is that HE won't email the winning bidder, because it could waste his time... but yet he has the time to stalk someone who didn't email him, or who didn't mail payment instantly, and email those sellers?

Please tell me this is a joke. I tried searching descriptions by some of the phrases in the TOS, and nothing came up.

I would like his seller id also - don't really know if I would bid or not...I just want to mess with him a little with some questions for seller. From the sounds of his TOS, I don't think it would take much to push him over the edge. And he can't neg me for that, can he?

This is getting a little sticky here - I know you're not coming right out and identifying this seller...but, posting here that you want the ID for various reasons - is very close to the line.
To err on the side of caution, may I suggest Perhaps asking the Originator to email you, if that is amenable to you.

First 200 items ending in approx next hour,
and have the comment "Negative feedback will be left " in their description:-
only 69 have bids ie less than 35%.
What's the ebay average?

search certain phrases of the TOS, and you get nothing. Search other ones, and you get plenty.
Something is weird here. Was this an offsite TOS?
