So, I dutifully reported a power seller (5000+ FEEDBACK) to eBay for more than 10 items posted at one time. Silly me.

Well, not just one item. But 35 in one instance, 22 in a second, 17 in a third, 15 in a fourth, fifth, sixth and seventh, 13 in an eighth.

Safeharbor replied that they've warned the seller not to do this again and left all the auctions intact.

Aren't they supposed to do that? When I launch out of AW I list the same time for all my auctions. Well all is only about 7. I am not a big time seller as you can see. Never will I make a power seller, I can't sit here that long.

ecom ....... eBay generally sends a warning for a first time offense, to ALL users, not just power sellers.

I would think "most" eBay users would appreciate that, wouldn't you?

Libra ...... If the items are all identical, the seller should be running a Dutch auction, not clogging the category pages with identical items.

I am a powerseller and always have to follow ebay rules. I don't see that I get any breaks at all, just the monthly newsletter.

I was curious about the 'link' rule and tried reporting two different auctions. One auction was a regular seller that had a link to their site. EBay's response to that report:

Upon review of the information that you have provided, we have determined that the seller has violated eBay policy. I wanted to let you know that I have warned the member against any future activity of this type.

If I report an seller that is a member of the NFL with a link to their store off of eBay the answer gets fuzzy:

The account whom you have reported is currently being reviewed. Although we may not be able to keep you abreast of our actions, we pledge to thoroughly investigate the information you have provided.

An article in TAG/Notes gave me the idea to make this test, and eBay didn't surprise me. I don't even know why I reported them, I knew what the results would be before I got them

Here is a very insightful piece from the latest TAGnotes newsletter:

**************************************************
As further confirmation of this program of favoritism, this is from
a Power Seller support letter, excerpted to protect the identity of the
seller. It refers to one of the corporate sellers on the TAG list
“The member to which you refer has been reported numerous
times and we have taken appropriate action. I understand your
frustration but would like to remind you that, according to the User
Agreement, eBay retains the right to end any listing as they see fit”
and “The seller to which you refer has an account higher than a
Gold account with their own private account manager who has been
alerted to this situation. The account manager is working with the
seller to correct the problem as soon as possible. As powersellers are
given a certain amount of deference when it comes to their accounts as
opposed to regular sellers, these special sellers who are higher than
Gold Powersellers are given the same amount of deference as opposed to
Bronze level powersellers. That is why the auction has not been removed.
and “In regards to your last question, eBay enforces all of our
policies equally, however, when and how we enforce them is determined by
various factors - one of them being the level of the powerseller
account.” TAG sees this clearly as an admission of just how unleveled
the playing field on ebaY is.
**************************************************

Thanks TAG

Seems pretty clear to me!

eBay is saying: "We enforce our rules equally amongst all sellers! However, please note that some sellers are MORE EQUAL than others!"

Seems fair doesn't it??!!

That "excerpt" that TAG published doesn't sound quite kosher to me.

There is something about it that sounds contrived...like it might have been made up by someone in order to "prove" ebay favors the big guys.

I don't deny the possability of ebay management giving big companies more leeway than they do other sellers, but this excerpt is to open...not at all like other emails we have seen that dance around an issue.

I think this report I will take with a grain of salt...it is to "pat". Support personal may not know all the rules and may interpet them incorrectly, but they have been WELL TRAINED in how to respond in a manner that doesn't really say much...this email doesn't follow that same pattern.

Well- I can say that there are many words that define ebay and their rules for selling.

"..eBay retains the right to end any listing as they see fit” TAGNOTES

I don't believe that I would consider FAIR as one of the words I would use in reference to eBay.

Received another response for one of the other items from Community Watch.

"We will take what we feel is the appropriate action." - eBay

Powerseller or Not, I find it incomprehensible that anyone would report a "links" violator to SafeHarbor.

If you want a level playing field, start by leveling eBays rules and concentrate more on what you can do to facilitate your own success on eBay or whatever auction venue you chose to participate within.

Being a tattle-tale on "links violators" accomplishes nothing but re-inforce eBays Strong Arm Tactics.

The funny thing is that over the next 12 to 24 months you'll see an exodus from Ebay caused by their own heavy-handed-ness. Yes, they'll be around, but the auction community is certainly changing.

I've deleted eBay from my computer. I will never buy or sell anything there again.

There are many other options although you may have to list twice as many items for twice as long. Build your sales and reputation on several other sites. Like the Roman Empire, eBay will shortly decline.

And each and every one of us help speed up the process by going elsewhere. You all brought Yahoo to its knees so why is eBay allowed to get away with it?

To NOT do this is to support a dictatorship and good Americans don't do that.

Riigghhtt. I want to bring to it's knees, the very site which has let me build my own business, provided a reasonable income even with the down times & allowed me flexibility in scheduling my work around my family.

Yep, sounds like a darn good plan to me.

I may not LIKE many of the changes ebay has made & am certainly willing to investigate other avenues of revenue but I have little desire to cut off my nose to spite my face.

Perhaps if you had a rare nose disease that threatened your life you would be happy to cut it off.

EBay is such a disease and needs to be stopped now.

My understanding is that Powersellers can have links to their off eBay sites. There is only a finite market and this takes business from us little folks.
