I sold an item back at the end of April. I didn't get payment so I sent a reminder the second week in June, he insisted it (check) was sent the first week in June. I never got the check so I filed a NPB alert and he insisted it was sent the first week in June. Well, he says he checked with his bank and that check has been cashed. He said he tried to send the scan of his bank statement but it was too big.
My question is: Is there a way I can check with my bank to see if that check was deposited? It is possible I messed up and deposited his check and didn't print a packing slip (this would be the first time I have done this in 3 years). The item is 40 dollars.

He can send you a scan of the front and back of his "cashed" check. He may even be able to get HIS bank to send you a copy of front and back of the check! If your name appears on the front, and you signed the back, then I would assume you deposited the check, and a big apology and shipment of product is in order.

I have had this happen twice and both times they had not sent payment. I offered them to send me a copy of the cancelled check that I suposidly cashed. If they could I would give them back the whole amount and send them the item too. Neither ever took me up on my offer. They were both trying to scam me or or least make me wonder enough not to give then a negative for non payment. It didn't work.

That sounds like a good idea. In his e-mail he says his bank statement shows that the check was paid. He says he has the cancelled check. I could ask him what my middle initial is on the back of the check, I sign all the checks with my middle initial, does that sound like a good idea?

If this person was telling the truth he would have said, scan to big to send, will zerox & mail you a copy. When someone is telling the truth they will go all the way to proove it.
I have two people trying this right now. One, after I asked them for proof of payment said she just realized her check to me was never cashed. The second one never answered my email asking for proof. (both sales were under 10.00!)
My first clue that payment was never sent was the fact that neither one emailed me as to where their package was. I didn't hear from them until I filed a NPB. Seems this is the case for you too.
Are you sure you didn't include your middle initial in your EOA email. I would still ask
for proof by seeing the cancelled check. They can get this from their bank. An honest person would not hesitate to do that for you.

Tell him to scan the front AND back of the check.
No reason why he cannot do that.

An update:
I asked him to check the back of the cancelled check to tell me what my middle intitial was. In his e-mail he had said: I tried to send you a copy of the bank statement with the cancelled check but it was too big for your mail to store."
He e-mailed me back and said he actually doesnt' have the check, the bank kept that after they paid it. All he has is a bank statement with a check for the amount showing it has cleared. So, I told him I will have to see a photocopy or a scan of both the front and back of the check. If it turns out I am at fault I will refund half his money and of course send the item.
Any thoughts?

He is lying. First of all, the bank doesn't keep the checks. They send them back to you once they have been cashed. Second,how convenient for someone who sent a check more than a month after the auction ends, to claim that you cashed it, (but they can't produce a copy). These deadbeats never cease to amaze me in how they come up with ways to delay, delay, delay, and never pay. Check his feedback, (if he has any). Guaranteed the feedback comments are left a long time after the auction ended). This is a classic stall tactic.

Um, not all banks return checks. Some just send out the statement, and charge the customer for a copy of a needed check.

I do not get cancelled check from my banks. haven't in 10+ years and several different banks. But I can get a copy from and back from them like 10 times a year for free.
His bank statement proves nothing except that he wrote a check for that amount and it cleared....but it does not mean it was you.

Twice in the last two years I have had a similar occurrence.
The first time the package with the check in was signed for, but the check was never cashed.
The second time, (yesterday, in fact) the package with the check in never arrived. In fact, UPS has it "in transit" since the beginning of June!
Both checks were for large amounts. That is why they were sent via UPS. I can say the check is on its way and here is the tracking number

My bank doesn't return cancelled checks, and they probably charge quite a bit to copy one for you. Did you ask him if his bank charged for this service? And how much, if they do?
I would offer to pay this fee if it turned out that my signature was on the back of the check.

My bank doesn't return checks. Once the bank that holds our mortgage told us that we didn't make our mortgage payment and they sent a foreclosure notice! I had to fax a copy of the cancelled check to the mortgage company and the bank charged me $8 for a photocopy of the cancelled check~ what a rip off! I was so mad! The mortgage company should have given me a credit on my payment for screwing up like that!

Go to your bank, explain the issue to them. Have them call him and request he fax them the check front and back scans or that he give them his branch offices phone number and your bank can check into it with them.
IF he's perpetraiting fraud then the banks now involved and he can face REAL problems.
If its an honest mistake on your part then have your bank issue a wire transfer of the money to his account.
