I contacted an ebay seller re "new" software that didn't sell after her auction closed. I offered to buy it. I mailed my check, she cashed it, and I received the merchandise. It was junk. I truly missed the boat on that transaction.
Can anyone suggest how I can seek recourse? The bank can't help since the check's cashed, it was outside of ebay, and she won't return my messages.

I think you're screwed. That's the risk of buying outside of eBay. You can't leave negative feedback or turn them in to eBay.

Tell your bank you want the check returned. They can do it and should if it is within 30 days of your bank statement. Tell them it was an internet purchase and what you received was not what was advertised. Do not talk to the teller ask for the branch manager. This is why I will never take checks the writer of the check always has the opportunity to reverse it. It is just not practiced very often. And banks will not volunteer to do it. My bank would do it for me without and issue.
