item. I previously posted about a seller whom I bought a Video tape from, she was in England, and when i recived the tape, it was twisted, and I emailed her about it, she replied back saying it was my machines fault, as your machines cannot play British tapes (I told her in emails previously when I bought it, as well as in the email that I told her it was damaged, that I do have a British VCR, but what does that have to do witht he tape being twisted?) and that this is from her own private collection, and since it is MY FAULT, mail the item back and she will refund the cost of item only, which was 6.00, but to mail the item back will cost 7.50!!!

So I emailed her saying it isn't my machine's fault, so please do not blame it on me or my machine, and I think she should refund me the shipping the item back as well, as it will be economically unfeesable for me, and I guess to be honest I was a bit upset with her (didn't like being called a liar nor her sarcastic rude attitude), in which she responded back, calling me a moron and that she will negative me!

Well I did some research on her, and noticed something. SHE ALWAYS LEAVE A POSITIVE FEEDBACK WHEN PAYMENT ARRIVES FROM BUYER! I was the ONLY ONE she didn't! Suspicious? From the time she mailed the item and to when I received it was 18 days, more than enough time to leave feedback, as everyone else gets instant feedback within 5 to 10 day period.

Also it just occured to me she said she checked the tape from beginning to end in her email (even though the tape was left at the twisted spot) and that this is from her personal collection, not a former rental. Than WHY DOES IT HAVE VIDEO STORE RENTAL STICKERS ALL OVER IT!??

I know I will get a negative, but should I just negative her anyway? To me, it looks like she KNEW she was selling a defective merchandise. What do you think?

Obviously the seller either knew right away that the tape was damaged or at least realized it before sending the item since she always leaves feedback immediately but didn't for you. I would love to say I'd neg her but I wouldn't because I would be in fear of retaliation. These are tough situations because there is no way for an honest person to prove their case in a one-line feedback. If it was a higher dollar amount item, I would pursue it further, but if I were you I would just drop it and leave no feedback.

Advice?

If you were willing to pay all that money for a tape, just unscrew the casette holder, open it up, and *UNTWIST* the tape. I've repaired many a tape, even computer tapes, and it is not a big deal.

As for the lady...just leave NO feedback unless you are ready and able to take retaliation. Returning it would cost you more money than its worth.

Hi

the tape is not only twisted, but as I checked the tape condition after the twist, I see lines/crease marks, then more damage marks, so it looks to me the tape went through a real bad machine with teeth! Also seems like there are sticky stuff inside the tape as well! Yuk! I wouldnt play this tape on a vCR for fear of damaging my VCR. I know audio tapes can survive twist, but video is more delicate, so this tape is toast! You would think someone who seems honest based on feedback from others bidders would pull something like this, and write that sarcastic email. Maybe I am dealing with the sellers kids or girlfriend?

I this something I should notify ebays, for "misrepresentation" of an item, or is too small of an amount for them to care?

She probably looks honest based on her feedback, because when she's pulled something like this, nobody negs her for the same reason you don't want to (not criticizing you - I might feel the same way and not neg her either, over such a small amount.)

I don't believe eBay will do anything, but I'd report it anyway, and send them copies of her emails. You never know what is already in a file on her at SafeHarbor, and at some point they might take some action against her.

Merchandise damaged, seller refused to refund

That's about it, right?
