Hi Gang... need some help. I am mostly a seller but wanted to get a new updated version of a popular photo program so I found one on ebay for about $200 less than retail.
I emailed the person prior to bidding and asked her if it was indeed a LEGAL version with the regisration numbers, etc. She said yes, that she had bought it from a church sale and that it was still sealed, etc. She was rather beligerent and said that she had explained everything in the auction. Which she had but I just wanted to verify. I went ahead and bid and won. I paid her almost $350 by paypal. She sent the item to me and low and behold...I received a bootleg copy with no registration numbers. Now I have emailed her telling her that I want my money back but no response.

My question is .... what forms of recourse do I have. I know to file a reversal request with paypal and I am going to do that this evening but won't that only work if she has the $350 in her account when they decide to take the money out?

Can I contact her local police dept? Is it mail fraud since she sent if over state lines?

Any help will be greatly appreciated as I am a little freaked that I may be out so much $$$. Thanks!!!!

Well two things you can do one is Ebay buyer insurance you purchase was over there $250 decuctable.

if you paid by credit card Charge back.

A little advice Not sure where your buying your Photo Programs but The best of the best can be had for under $60 in most stores.

$350 is nearly the fee Business pays for Win NT.

Just curious what photo program would cost more then $350 Retail ???

If she is selling a bootleg copy, you can actually have the software company and the BSA after her. What part of jail doesn't she understand.

The very fact that she gave you a hard time when you asked for information was the tipoff.

To be honest with you Some of the sellers on Ebay and other sites very offten sell Items they dont know much about this goes double for computer hardware and software.

The Only thing they are guilty of is ignorance and not knowing the item they are selling well enough to list and sell it.
the part of jail they dont under stand is that ignorance of the law id no excuse.

Yeah, I should have gotten a clue when she was rude but I figure maybe she had a bad day. Who knows. Now since the auction is closed and I am figuring more out. She had another id and I checked it out and found out that she sold another copy to someone else on the other id and I emailed him and he was took as well. He hasn't gotten any response or refund and he received his a month ago. So I don't think she can blame it on ignorance. She knew full well what she was doing.

dman, Please tell me which store sells Photoshop for under $60. Actually Photoshop Elements does sell for less than $70 and is the best one for under $100. And the license fees are much lower than that for Win 2000.

Turn them into the software company and the BSA as mballai suggested.

A little advice from someone who is in PhotoShop 3 or 4 hours a day...

Unless you're willing to go with "The Gimp" which is GNU/Linux based, and free!, Adobe PhotoShop is The best of the best.

It also runs $600.00+

Actually Photoshop Elements does sell for less than $70 and is the best one for under $100

newguy speaks the truth and that's all you'll need for auctions...PhotoShop is overkill.

Adobe potoshop home edition $49.95 at staples.

two weeks ago they were offering $30 manufacturers rebate.

Adobe photoshop elements $89.95 at Staples
many times dureing the month with the same $30 rebate offer.

you will find 99% of the time they alway offer manufactures rebate on most there software at there retail price or very near it.

the photoshop 6.0 CD is $599 at staples but they do offer big rebates on this as well many times in store rebates and manufacturer rebates some time rebates up to $250.

Staples is a great place to buy all your software and hardware I just got a new 52X cd drive for free a month ago all I paid was sales tax.

they had the same deal on memory Hard drives burners modem network cards and more.

Adobe PhotoDeluxe is great, however, it DOES NOT WORK with Windows ME, and they have no plans to make it work.

Watch the clearance table at Staples. They don't care what it is or what it sells for so there are real bargins there but you have to be lucky. I just need to find Adobe's Design Collection on it.

That's odd. I run Adobe PhotoDeluxe under Windows ME every day with nary a problem.

Hey it's me again. Yes, it is Photoshop and I do more than just list on ebay. I also own a photo studio and am getting into digital prints so I do need Photoshop. But could I try and steer you back to my original question. I have had some great responses about turning them into BSA and I will do that but is there any other great ideas on how to get my money back?

I also own a photo studio...

Sounds like a good reason to buy it legit and use the tax write-off.

I would NEVER buy software off of EBay.

I'm sorry you're in this predicament. i'm not sure what else you could do that hasn't been said besides pull some information and bring a baseball bat...

Did you send money ALREADY in your PayPal account, or charge it to your credit card? If you sent account money, you'll have to try to get PayPal's buyer's 'insurance' to cover it (good luck) or eBay's buyer's insurance through Safeharbor. If you charged it to your credit card, request a chargeback from your credit card-issuing bank.

If she sent it through the USPS, it's mail fraud. You can also let eBay know (vero program), report it to Adobe and let them contact the appropriate authorities, and report it to the Internet Fraud website.

Well those that have seen me post before know that is exactly what happened to me.

Mine was for Windows ME and only cost $40.00.

I made the mistake of paying with funds in my PayPal account. I was new and stupid of their ways at the time and you all know what is coming next.

Yep, I am just out the $40.00. Still am. Matter of fact I can tell you what PayPal will say regardless of how you paid.

"We agree the seller is at fault but unfortunately there are no funds in their account to recover. Just bend over."

Many have recommended it before and I am one of them. Don't bother with PayPal, just charge back your credit card if you can, forget about turning it in to PayPal. Empty your account first and be happy you are free from them.

...........Quietly waiting on Damon to come by and tell you differently .....

Dman - arttsupplies is right on the money. Photodeluxe and Photoshop LE are never good alernatives for someone who needs robust photo editing software. Those are definitely nowhere near the best. PhotoElements is definitely an alternative for someone with limited cash.

There just isn't a decent competitor to Photoshop.

Big time disagreement here.

PAINT SHOP PRO (www.jasc.com, just for info, not an ad, I'll edit it out if this is wrong), is a big time replacement for Photoshop.

And affordable. It's the only thing I've used for years!

Plus it can use Photoshop plugins!

If it were me I would give her a call I would be polite and upbeat but let her know that unless she refuds your money you will be reporting her to Adobe ,BSA, Safe harbor local police ect. I would write up notes before I made the call so you are sure to make all your posts
I would take it from the postion that it was a honest mistake on her part I wouldn't acuse her of purposley selling bogus software...but firmly suggest she make it good.
It can't hurt shouldn't cost you but a couple of dollars max in long diatance and if you have a cell phone check your plan you may have free long distance.

Adobe is MILITANT against software pirates selling their programs. As well as filing claims with your credit card company, Paypal and ebay, you should contact Adobe. They've been pretty successful at getting people thrown in jail recently.

BTW, anyone who wants to compare sub-$60 programs with Photoshop obviously doesn't understand what Photoshop is all about. OTOH, most sub-$60 programs will do the editing you'd need for ebay pictures.

the only thing that will every challenge PhotoShop is if MacGimp matures enough to become really be stable under OSX. Because it's free and The Gimp (the original) under GNU/Linux is already as good as PhotoShop.

If you're going to get serious you need to use and master the "standards" in design. It's where most techniques and helpful hints are dissmeninated. And the best books are written catering to these apps.

Unless you need to do photo editing for advertising, etc. Paint Shop Pro 7.0 is all you would need. An awesome program for the money and their tech support actually emails you back the same day you ask a question!!

I use Photoshop. It has a lot of nice features and the plugins are helpful. But considering PS is the industry standard, its JPGs look like crap.

Here is a page with some free PS plugins. If you don't have it already, get the KPT-X Equalizer. Very cool.

I'm partial to PhotoShop > Fireworks (Macromedia -- better than ImageReady)

I really like Fractal Design Painter's JPGs. They are compact and look great. Though Painter is really a paint program, not a photo editor, it can do basic editing. Corel's PhotoPaint (which also comes in CorelDRAW) also renders JPGs very nicely. For some reason, Photoshop JPGs come out way too dark. Not only that, PS lightens images that it imports. I don't get what's up with Photoshop. But its tools can't be beat. (I'm using version 4, maybe they've made some improvements recently.) For eBay photos, I would recommend Adobe PhotoDeluxe. It uses the Photoshop engine but is much cheaper. Sorry about going off-topic.
