Being summer it may be a repeat ("People's Court), but it's worth bringing up the discussion again seeing the disputes on these boards about shipping.A lady buys a bust of a black person for $200 on ebay. It arrives with a hairline fracture. The lady says the box was not damaged, and she unwrapped it carefully and would have noticed any chips but she had not seen any.The lady had bought insurance but felt it was a case of mail fraud and did not want to file a claim based on fraud since "it was not the post office's fault."The judge said the Post Office drops packages a lot and this could have caused the fracture. The judge did not agree with the buyer about not seeing any chips upon opening the wrapping, as it could have easily fallen out. The judge also said that the lady could file a claim with the PO and let them decide whether to accept or deny the claim. As for the buyers claim that the seller fraudlently sent out a damaged item, the judge said the buyer was very upset and had stubbornly made up her mind and open her mind to any other possibility for the damage. So the judge did rule in the defendents (sellers) favor.

The judge was right. Amazing how often brain dead snap evaluations on the part of people clog our court systems.
