ok this is quite the story, i will try and keep it short and to the point.........
early july auction ends for $55 final price. emails are swapped by buyer and seller(i am the seller). payment never arrives after 144 days, i email buyer and file npb notice. buyer claims payment was mailed next day after auction ended and that was all he neede to expect his item. syas he hasreciept but refuses to trace or send copy. 7 days later i neg, screw up and leave the pos. checked but leave deadbeat bidder comment. some of you may remeber my post about that. anyway buyer retaliates with a neg, a real one, calling me a thief and fraud artist. i still have not recv'd the payment and he refuses to do any trrace etc. ebay says tough sheet about getting the neg removed. a few days later i get a fraud complaint from ebay asking me to respond. i relay the facts in the 1200 letters or less they allow. last week i get a copy of the m.o reciept in the mail from the buyer, still no proof of mailing but it was something. i call the bank and try and trace, they say no way as i am not the buyer/customer. say they only sell m.o to their customers etc...ok i hit a roadblock. buyer still refuses to trace after i tell him i called bank.in the mean time the buyer is sending me virus emails and jacking with my auctions. Being downright nasty and prickish. ok today i call the bank again and get a young new employee, i assume, because she traces it for me with no questions. she tells me it has not been presented for collection as of yet. i had told him that if he supplied proof i cashed it i would send item and a complete refund. thats how sure of my position. i had already requested his user info but never called because he has been a jerk and i did not want any crap over the phone. so after today i call to let him know what up with his payment as far as a trace goes. he is at work but his mother answers and i speak to her asking her to relay a message. after i tell he the details she says wait a minute, comes back with an envelope with my never been mailed payment asking ifd that was me. i say yes she said she never mailedit because she did not want her 40 yr old son bring anymore crap into her house. my item and all he has bought have been beer advdetising garbage you see ion stores etc, you know banners and inflatables. she said he has this stuff al overher house and doesn't like it etc... what a trip.. so she promises to send the payment off, feels bad her son is acting like a little boy etc. she then asks me not to send the item and just keep the money. i say i can not do that because i would then be the thief he claimed i was. i told he she could throw it away when it arrives or better yet tell him to move hsi 40 yr old butt out on his own, she laughed and said she wished she has the courage to do that....so when payment arrives i will be sending it, after i am sure the m.o goes thru and using del.confirmation just incase momma tosses it out.....this guy has been the biggest jerk.....i wonder if ebay will remove the fb now, HELL NO they won't...

a question though, has anyone ever been thru the fraud filing process with ebay, should i even bother to tell them these details, dumb question i guess because he could get part of the money back from ebays insurance.isn't it a 25 buck deductable???........................................poor momma will probably take an abuse session from him if she tells him she has had the payment all this time.......40 years old, livin with momma and paying big time money for plastic garbage wort no more than a few bucks. i looked at his history of winning and he is paying over $100 for soem forthese advertising items. there is nothing rare or hard to find about hese things, beer banners, inflatable beer bottles...man what a trip!!!!

Did he used to be a lawyer?

But seriously, I am sorry it has been a horrible experience for you. Maybe you could go find some poison ivy and rub it all over the item before you pack it? Include a free "educational" video, too if you have one.

Seeing how he is 40 and lives at home - you just might have the recipe there for the perfect revenge!

becky you are quite the little devil aren't you. i think i get the connection, living at home at 40, poison ivy and i think the implied use of his hand to remove the item from the pkg....I LIKE IT!!!!

he did claim to be a policeman and have a uncle who is a lawyer and that he was born in 1948.....all lies which his momma confirmed......WOW and i thought i was a loser, hehehehe

OK, the guy was an idiot to act the way he has. And, yeah, at 40 he should be out on his own & not living with his Mom.

BUT: the real one at fault here is the mother. She's the one that purloined the envelope with the MO & refused to mail it out. The guy got pissy because he *knew* he'd gotten that MO & put it in an envelope to mail--and *knew* he had put it to be mailed out. Then he's told that his payment never arrived and he's not getting his merchandise.

Granted, he went way overboard. But you've got to figure...how many *other* payments hasn't the mother mailed out? Perhaps he's got several sellers demanding payments he's sure he's already sent out & he just reached the end of his tether & snapped...

You might want to inform him via email what you have discovered...

the mother is definetly to blame but just to clarify, he gave mom 2 money orders and 2 address, asked her to send them out. he did not have them pre addressed etc. now she mailed the smaller one of $25 she said and kept the other hoping he would forget about it. hehehe well he certainly did not. as for telling him i will AFTER i get my payment and am sure it clears. you really have to feel for the mom though, all kinds of beer banners and inflatables in your house compliments of your 40 yr old son/moocher.......his refusal to trace really left doubt in my mind about him paying plus something else i did not add was that he kept saying he bid too much, paid too much.......quite the transaction,.... still pending

a question though, has anyone ever been thru the
fraud filing process with ebay,
should i even bother to tell them these details.

I started to once and gave up.
I calculated the time I would waste with ebay.
PLUS, the time away from listing new items.
Not worth it.
I could be wrong, but from that one experience
I felt that ebay predominately protects the buyer.

40 years old and still at home.
Birds push their chicks out when they can fly.
Perhaps this fellow isn't ready to fly.
You don't want him hurting himself before the MO is cashed, do yea.

What a story, If this was about anything other than an eBay auction, I would never believe it. But then again, no one could make this up.

I could see his mother doing this with a personal check, but a money order!!!
She's kinda nuts too.

It might be worth one detailed email to eBay to get the negative feedback removed & it would help if the buyer would confirm it, but then you would have to tell him what his mother did, not to mention getting eBay to believe it.

Oh, the heck with it, just do what BECKY said. That's a great idea, he might even stop buying plastic blow ups, thinking he's allergic to them. Would at least make his mom happy.

I believe eBay's fraud protection program works a bit like SquareTrade. They'll take your [a user's] complaint but they won't do anything UNLESS fraud has been proven legally. Then they will suspend. I believe a fraud report is required before eBay will pay insurance.

did everyone see "Throw Mamma From The Train" with Danny DeVito?

Boy, I enjoy that movie, see something new every time I watch it.

Momma; "your friend's dead in the basement. Get him out before he starts to stink." (misquote I'm sure, but a hysterical moment in the movie)

Mom, tryin hard to be like my hero; Momma

(is it Momma or Mamma?)

If I were you I would send the wacko an email advising him that you were going to "tell his mom" if he doesn't stop behaving like an idiot.

If I was in this situation, due to the time that has elapsed, I would be returning the money order. I realize that it is good to get paid, but considering all that has went on with this customer, and you both have left feedback, this would be the best solution.
