Hi,
How do you deal with no answer no payment on a BIN auction?
This buyer used Bin or 40.00 pair of Dana Buchman nwt pants on the 5th of sep,
I sent WBN as soon as he/she used the BIN,
My tos states that he has to reply within 24 hours,
Well day later nothing,I resent the WBN 4 times (each 24 hours) and
A payment reminder but still nothing.
What do I do?
He/she had to be there to use Bin,
You cannt snipe that, so the buyer is just not responding?
I had deadbeats before, but never a BIN deadbeat
Any advice ,please???

(1) his server may be down or he is away from his pc.
(2) if he is like me,i am one of those bidders who will just jolt down the info you send me and proceed to make payment,you dont hear from me via email.
(3) 40 pairs of pants?
he could be selling them now,once he has enough to pay you,he will send payment ,how about that?
you know darn well one person does not need 40 pairs of identical pants.so who is he and what does he plan to do with your pants and in cyberland,smart ass gets to play a game of locking up the inventory without paying up front.

It actualy was just ONE pair of pants

But in my last email
I
very clearly explained that I will follow
My own TOS which means that in 3 days
I'll file for NPB alert and request my FVF after that.
If he /she did it like you do (n# 2),
I'm sure that he/ she would reply to that email
Saying that payment was sent and there is no need for NPB alerts. (you would think..)
Anyway, I just wanted some thoughts on this.

EBay's policy about buyer and seller contact is 3 business days. Since your auction ended on Wednesday September 5 the buyer has until tomorrow Monday September 10 to contact you.
EBay's policy is to wait until 10 days after the auction ended before us sellers can begin the NPB/FVF process.
Since eBay's policy supersedes your TOS, you may want to rewrite your TOS.
Besides if I read your TOS I would hit the back button

That's what you get for having an unreasonable demand in your TOS. You guys never cease to amaze me. You keep listing and relisting but the moment it sells you expect a miracle to happen.
But it's not your fault. I blame the guy who bid on your auction. He should have had more sense.

I checked out the auction.
1) IMHO your TOS is not legally binding since it is not on the actual auction site. Since it is a link (your aboutme page) it can be changed at your will. If your tos was on your auction site, once a bid is placed (and not retracted) the auction site can't be revised unlike your about me page, then it would be legally binding as long it's not superseded by eBay's policy.
2) You are dealing with an experienced eBayer (with less time as I, according to their feedback page) so I think I can safely say they know their rights and the eBay policy. I personally wouldn't push them too much

The only thing that I trully want is a reply within 24 hours, so I know that it was confirmed, that's all,
I'm currently waiting for the 3rd week to get paid from other auctions, I know that some rules are hard to follow,
Short payment times and all... but to hit reply...
Com'on do I really want that much?
BTW thank you for the note that I should have my TOS on the auction site,
I used to, but I moved it
(guess that want that good a move )
And I do realize eBays policy on 3 bix day contact,and I have to come back to that my TOS is very short, but..
I just wanted some extra feedback from you guys on what to do, in all honesty
I dont have too much experience on eBay,
I have many years of retail and fashion
And you really get used to imidiate payments and all being done in 5 min

As you gain more experience around eBay you'll learn that some buyers just don't respond to emails. I've never quite figured out why but they don't. They just put the payment in the mail and figure that should be enough. Personally I don't think you're asking too much by expecting a response but some people don't seem to understand what constitutes good communication...

that's the whole problem,
I have been so lucky, in two years on ebay
And after 73 sales I only had 2 problems
(well, 3 if I count this one)
I dont know what the statistics are,
But I thought that's pretty good
After reading some of the threads here
But each time one of these "pops up"
I just dont know what to do ...
Well, I'll let you know tomorrow
I'll have 37 auctions closing,
Hopefully some will reply to my emails
But something really nice happened few min ago, one of my bidders emailed me saying that she is the current high bidder on an auction that ends tomorrow but she wont be back till Friday so I dont have to worry about not getting replies there
(I just thought that it was nice from her)

In the past 10 days I have had real problems with my email.
One buyer was not receiving my email, I knew because of the emails he was sending me. I finally went to ebay and sent "this auction to a friend" and asked him to respond to that. He received that one.
Then the email server for my ISP went down completely for 72 hours. I could not send or receive.

Expecting a response in 24 hours, and being ready to file a NPB at the first moment is short sighted. As my mother constantly reminds me, it is not about "me". On ebay many bidders are busy people, but still manage to buy and pay for lots of goods. Demanding them to do more than that is setting yourself up for frustration.
Pestering them about emailing you to "confirm" when they are already committed through the bidding process, is a nuisance.
And it immediately changes a friendly transaction into a contentious once. Some might read this as a control issue, as I do, and the more you push the more they will ignore you.
I buy and sell, and in selling, I send a notice with payment options and 90% pay within two weeks, 8% need a reminder, and 2% get NPB and the final 1% get FVF filed. THe key is to set up the transaction to make it as easy as possible for the customer. Lots of payment options, minimum paperwork, helpful links.
You might start a thread asking how other sellers achieve 98-100% payment rates and emulate them. Selling clothing I believe is a little trickier than other items, but the idea is to maximize your payments while reducing your frustrations. Your insistance that buyers send you a confirming email is a one way to guarantee aggravation.
That buyer may have already sent payment and left on a business trip, have a family emergency, or a broken computer. In that case all the worry is for nothing, you have been hoisted on your own petard.

if you are a brick and mortar retailer,then you know customers do not respond to invoices,how many will drop in and say i received your invoice??
some bidders bid on many items,they dont bother to email each seller,they just make a list and go about sending payments.

First off, I had no idea that people put their TOS on a page different than the actual auction. As a seller, that's one more thing I have to watch out for. Secondly, I cannot believe that a person is ready to NPB someone in just 5 days!!!!!!!! (3 business days) That is barely enough time to get the payment to you. In my EOA I state "please respond to this note with your shipping address to confirm reciept" about 75% of my buyers do. I don't NPB those who don't. But then, I also wait 3 weeks before sending the NPB.
While I know it is often joked about on here, a LOT can happen to someone in 3-5 days, which is why I give them 2-3 weeks. If I had been a winning bidder on your auction when my father-in-law passed away, I would have been really ticked off if you had NPB'd me. Payment was made within 10 days, but the email was limited because I wasn't at home. 2 days after the auction ended, I got on their computer, checked my email, printed out the info, and mailed the payment. (They have a per minute internet provider, didn't feel it was right to use up their time/run up their bill).

I ask that all my bidders reply to my EOA, 99% do. Those that do not get an NPB alert if my second email is ignored. An EOA should always get a reply--eBay specifies that you contact each other--NOT a one-way deal. Us old-fashioned folk call this common courtesy and unfortunately people now consider it optional.
I usually believe that the seller will pay in his or her own time. I wait at least the three days and then I may send a gentle reminder.
After a week and sometimes two I will check back again. I had one buyer who stated that her father had passed away and she had not been near the computer for a while.

Direct from ebay guidelines. Note the wording says "should" not MUST. There's nothing in here which SHOULD lead a seller to file an NPB just because they haven't gotten a response from a buyer to their EOA.
Impatience seems to have bowled common courtesy right out of the picture.

Anyway, here is an update,
The buyer emailed me
Today after a quick phone call
And said that his email
System kept moving my emails
To trash as " a junk mail"
And he'll send the payment out tomorrow,
So after all it turned out great.
Each seller has their own TOS
I have mine and I like to go by them.
Anyway, thank you all very much again,
