To Whom it may concern:

I had this bidder with a zero and a shade, outbidded bidders with numbers on a video tape, its been 2 1/2 weeks, no payment. Just about when I was to file an NPB alert, I get this email....
-----

To Whom it may concern:

I received the video that I won through the ebay auction. I am sorry to say that the video arrived damaged. It was shipped in a mailing pouch/envelope which obviously is not the best way to ship a fragile item such as a video cassette; especially one that is so hard to find such as this film. It is clear that it was damaged enroute through the United States postal service. The mailing envelope has a hole punched through it directly where the video that was inside has a hole punched through it. Of course, I did not open the sealed video and will not accept it in this condition. There is definitely a rattle noise coming from inside the tape that you can hear when handling it, that indicates it is in fact broken.

The anticapation in waiting for this video was great. I'm very dissapointed that this transaction turned out the way it did . I need information on where to return this product for a full and prompt refund; or exchange for the same sealed product undamged.
-------

BUT I STILL HAVE THE VIDEO IN MY HANDS!!! I checked his bid history and this is the ONLY THING he bidded on in the last 4 weeks!! So he couldnt possibly get me confused with another seller.

I dont want a negative from this, as bidders will probably believe whatever this liar will come up with! This is upsetting me big time as how come something be damaged whenI still have the item in my hand??? Yet he describe this so vivdly!!! I just signed with powerseller, can they look into this, or is it notworth contacting them? Also is it even worth replying back to this liar?

I can't even come up with any advice on this one. This is a first.
I hope you keep us posted on the outcome.

I wonder if he has the same video, damaged & bid on yours in the hopes of an exchange for a working one. He could at least pay for it first!
If you do get paid & mail to him I hope you put an invisible identification mark on it.

Here you go:

To whom it may concern:
Since I never received your payment I have not shipped the video you bid on and won. Whatever Video you have received in the mail is not from me.
Thank you
Seller

I would respond with something like:

Sorry to hear of the demise of this item, but you must have our auction confused with another you had bid on.
You were the high bidder on our Ebay auction #012345 for the video tape "The Non Paying Bidder Idiot" which ended 8/15/01 for which we have not yet received your payment, therefore have not yet shipped.
Please update us on the payment status for this item as we are soon at the time limit Ebay allows for us to start their filing process (the first requirement is filing a Non Paying Bidder Alert) to receive a credit for the funds we were charged by them for this successfully completed transaction.

Thank you,
asmartseller

Give them 48 hours to reply, then file if no response.

Heh...I sell videos all the time. I sometimes get the "video was damaged" lie, so I just tell them I'll refund them in full IF....IF they send back the original tape. They never do. Heh Heh

It might be possibe that this buyer bought the video on Yahoo or some other site and thinks that you are the seller of this item.

Another thought is that he buys under 2 names and has confused you with a transaction under the first name. This might be the reason he has the shades.

Whenever I pay someone money, especially on ebay, I know their name. When I respond to them, I never start the email with To whom it may concern. Either he hasn't paid or he had you confused with someone else.

One more thougth. Depending on how much feedback you have, and how long you have been on ebay, he might be trying to pull a quick one on you. The more people that use ebay, the greater the pile of seedy people.

Also, if he really paid, he would have mentioned it in his first reply. Ask him how he paid. Check of MO

Hi, thanks for your advice. By the way, this guy JUST did a user information request thing! Gotten a email that he requested it! Good thing I gave a PO box and a voice mail number! Of course I gotten his address and phone number but he doesnt even have a address and I question his phone number(I better check to see if his area code matches the address he gave me 3 weeks ago!)! Yikes! sounds like a creep! Should I call this number?

I live in Michigan and we have Ameritech for our local phone service. To block our number from someone's caller ID, we dial *67. If he has caller ID, this blocks the caller ID unit from receiving your number. Or call him from a pay phone.

How do you get a voice mail number?

Hi! I emailed honestjohnstoy's idea of a response and hereis what I got....

----
I did in fact send a money order(#*******)to you for the sum of $17.25 as instructed by e-mail on 09/10/01. The e-mail stated to send payment to (my name, my address)
---

So I emailed him waterbabes suggestion, and here is what I got
-----

To whom this may concern;

I have come to the conclusion that the video I've received is from another merchant who failed to leave his name on the package, only an address. Obviously it's not from you. Sorry for the mistake.

But I am glad that I contacted you and have found out that you did not receive payment for order#****** for video. As stated in a previous e-mail to you; I did send payment to a (my name, my address) Please inform me if this was the correct address; If not I'll have to track down the money order. I do want to purchase this video from you and have no problem sending out another payment. Again, please let me know as soon as possible if the above mentioned address is correct.

Sincerely
--------

So thanks waterbabes! However the concern is, even if he mails the payment, wanna bet he will stil claim it is damaged? (; Maybe if I ever get the payment, I might mail the video in a big box wiht tons of popcorn peanut to avoid him claiming "damaged in mail"? Wonder if this newbie had a "previous" user id? (:

I would mark the video before I sent it to him. I use ink that only shows under black light to mark anything I send out. I tell buyers that if they want a refund they have to return the item with my mark intact before I can send them the money.

yeager, you can get a free voice mail/fax number at www.j2.com

The faxes and voice messages are emailed to you.

"...There is definitely a rattle noise coming from inside the tape that you can hear when handling it, that indicates it is in fact broken..."

Try shaking a good videotape, they all sound broken to crazed buyers.

If you receive the payment for the video, pack it well and insure it through the post office. Then, if he wants to claim that it's damaged, you can just tell him to go through the post office with his claim, and for about a buck you've washed your hands of the problem.

How to get a voice mail:
I think it's www.Onebox.Com
They will give you free email
And free voice mail
(phone number with an extention for you)
With your local area code.

Or it could be pobox.Com
I did it like 1 year ago...
I know it worked but I was to lazy to call in each time...
