Auction ended August 28 for $15 item. EOA is sent right away, and resent on September 4th when I didn't get a response. Buyers response is:
I am so sorry I did not respond to you. I am mailing a personal check out today for the xxxx. I had to drive to North Carolina last week as my father had heart surgery. I just got back last night and did not have access to a computer while I was there. Sorry for the delay. Thanks so much for your patience.
FF to September 17th, still no payment, so I email again and get this in response:
I want to apologize for not getting payment out to you yet. With all that is happening since last week (I was working in Mid-town Manhattan when it happpened), I have not been able to think of anything else. I will be getting a check out to you today. Please understand why I have not paid you and rest assure, you will get your money. Thanks and stay safe.
Now, first the check has been mailed on the 5th, now it's the 17th and it's just being mailed. BTW, she lives in New Jersey.
My answer to her:
Your email on September 5th stated that you mailed payment that day. That was 6 days before the events of the 11th. You have also been actively bidding on many other auctions since then, even placing bids on the 11th as well. I'm going to be filing for my Final Value Credit and relisting this item.
She emails me back and says that payment has been sent, and I can do whatever I feel I have to do. In the meantime, I've contacted the second highest bidder, and she want's the item.
I received the first winning bidders check in the mail a few days ago. The second highest says hers in in the mail. What would you do?
I'm totally ticked that the first bidder used first her father and then the WTC attack as excuses for not getting payment out. She was bidding and paying for auctions during both time frames. First bidder has a 27 feedback, second highest has a 126.

Easy....Send the slowpoke her check back and complete the sale with the second highest bidder....who appears to be more responsible.
Write the slowpoke a nice e-mail and tell her
that the merchandise has already been sold and that you are sending her money back.
It's hardly worth it to risk ticking off the second highest bidder (even though she can't do anything about it) because, in a sense, she is doing you a favor by bailing you out of a bad situation.
You can even file for a partial FVF refund
from ebay because you are selling at a lower price.
Of course, wait until you have the second-highest bidder's check in hand before
cutting your ties to the slowpoke.
Though, I would not give the slowpoke a NPB award because, technically, she did pay.
BTW, how much of a $$$ difference between the slowpoke and the second-highest bidder?

A whopping 50 cents. I hope the second bidders check arrives today so I can clear up this auction. I also suspect I may get a neg from the first buyer, but we'll see.
If she hadn't used the WTC as an excuse, I might have been more patient. That just ripped my shorts.

I would sell to the second bidder. Once the high bidder defaults by being late or unresponsive within eBay guidelines, they no longer have any right to receive the merchandise.
