I've won auctions from the same seller several times in the past and there hasn't been a problem. I received the items paid for on 8/31, however the items paid for on 8/21 were not shipped until 9/26, after I sent 3 emails. When it was received 2 of the 5 items were missing and there was a $7.00 overcharge on shipping (in part due to not shipping the whole order). On 9/25 I won 2 more items. Ok I was an idiot to keep bidding, I just thought that the 8/21 order was an aberation since there hadn't been a problem prior and the order of 8/31 came through ok.
The bottom line is that it is now 10/8, there has been no response to my emails,and I received a notice that the seller has filed with ebay and I will receive a warning if I don't pay within 10 days. This involves items from 2 auctions that closed near the same time, so I could end up with 2 NPB warnings.
This is a large company not a small home business that is easy to get in contact with and they have been racking up negs' since September for the same problems that I've been having. I told these liquidators that I will be happy to pay once we rectify the previous order but there was no response. If I send my emails to safe-harbor will that save me from 2 warnings or am I stuck? Thank you for any help you can give.

This should have been a warning sign..possibly a good seller going bad.

Pull their contact information and call them. And start copying SafeHarbor w/all your communication.

You said "I received a notice that the seller has filed with ebay and I will receive a warning if I don't pay within 10 days". Was this 'notice' just an email from the seller? If he 'has filed with ebay', you'd already have the ebay warning. He is probably bluffing. He should have issued the warning through ebay before now. But even the warning is not a permanent record, so while it does need to be straightened out, don't sweat the "warnings", which haven't even been entered yet. Yes, tell safe harbor that you are dumping this seller for lack of communication.

Even though it is "two" warnings, only one will count in your record, as far as being suspended.

You can file with square trade, if you wish, as well.

holding one transaction hostage until another is completed is not a legal business transaction. you know that i am sure. you are po'd, with reason it sounds like, but you are now in the wrong also. 2 wrongs don't make a right. if i were the seller i would be rewarding you with a couple negs if you did not pay up in a timely manner!

Try reading the original post again & this time you might understand it. shala didn't hold the transaction hostage, the seller never responded to her emails. The seller is in the wrong in all counts here.

First, thank you for all your help. I pulled the contact info. When I called them there was a recording saying to call again in 15 min or leave a message and they would return the call the next business day. 15 minutes later..same thing. I will be sending copies of all my email to Safe-Harbor tonight.

Eventer: They have a net feedback of over 4000 and I have bought from them a half dozen times in the past 6-8 months so it never occured to me to check recent feedback. When I did I found that they picked up 200 neutrals and 300 negatives in the past month!

Rgrem: The notice was from ebay stating that I had 10 days to work it out with the seller before getting an official NPB warning.

Outoftheblue: This company is a liquidator and sells everything: food, clothes, office supplies, electronics etc.

nowwaitaminuteder: There has been no personal response to any of my emails. Actually for the last order where only 1/2 the items were shipped over a month after an online payment was made, I did received a link to Fedex showing shipment was done that day. There was no explanation, simply a link that I almost didn't follow since I didn't have a clue as to what it was until I got there. I'm not holding the subsequent auction hostage. I'm currently out approx. $10.00. With absolutely no communication from the seller and a failure to ship, I would have to be a fool to send them another $40.00. I wasn't going to fuss the negs, unwarranted though they be, but I won't take a NPB warning without a fight.
