I send a winning bidder his item that he won and paid for on ebay. I also send him someone else package by mistake. This package had a tracker on it. The user will not answer my emails. Can I report him to the Postal Office for some kind of mail fraud. Can I claim the insurance on this if he dosn't answer my emails.
Maybe someone out there ran into the same problem.

There is nothing you can do except email the person, tell them what happened and send them the postage, tracker and insurance to that they can send it back to you, unless you have an identical item to mail to the other person. I am almost sure there is no fraud as you have addressed the package to the wrong person. If your really desperate pull his contact information and call them on the phone. Be sure that you make it clear that you are going to pay for the return postage.

what is the item,may be he has grown used to it,it becomes part of the family.

someone sent me a glass creamer by mistake,i use it to keep my sweet and lows.

Legally he is required to do nothing unless you send him postage to return the package. It would fall under the law that allows you to keep anything you did not request that is delivered through the mail. Hopefully you can get through to him or even get his phone number and call to work out some kind of arrangement. But you will have to pay for any agreement made. If you have a second item, send that one. If not and you cannot get this guy to respond, refund the money to the bidder and move on.
