A buyer recently purchased two lots of antique picture frames from me for around $200. He emailed back and requested a refund due to flaws in the frames. I consented to refund his money upon me receiving the frames as they were sent. However I was suspicious because the frames are nice...and didn't think they warranted as much criticism as he was mentioning. SO, today I receive the frames in the mail---two of them are missing. They just happen to be two of the best ones that happent to be a matching set.
I emailed wanting to know where the other frames are---no response yet.
He also did not insure the package per my request. Luckily, the ones that did get here are OK.
I will refuse to refund his money until I receive the other frames.
BUT, here is my question---He paid via instant payment through PayPal. I have delivery confirmation for sending the frames to him. BUT he also has delivery confirmation for sending them back to me. If I continue refusing to refund his money, can he just reverse the charges through paypal---and have his money and two of my frames??

I may be wrong but I thought they could only do a chargeback on a credit card purchase?

You are definitely in the right here, do not refund until you receive all merchandise back.

Hi, what a shame, I am sure there has to be a difference in the weight of the 2 packages. Yours should be heavier going to him, I hope you still have your receipt. Unless he made up the weight difference in packing material. I hope this helps.

I just received an email from the buyer. He says:
OH-- I guess you didn't get my email (WHAT EMAIL??). I decided to keep two of them because I think I can fix them. Why don't you go ahead and deduct 30 or 40 dollars from the refund...and send me the rest via PayPal now.
WHAT?? So what am I supposed to do now? I am tired of messing with this bozo.

You should get back everything you sent out or else "this bozo" doesn't get a dime...

tell him the 2 he kept were the ones you were really selling. the others were just bonus add ins.


I would not sell him just the two he kept, it should be all or nothing.

first of all and most important wipe out your paypal account incase he reverses the transaction then your funds will be frozen

What nonsense, the buyer is trying to put one over on you. Did he think you wouldn't miss two frames.

When he first emailed you about the return, that was the time for him to ask if he could keep two & how much did you want.

I would make him return them to you & not refund anything until he does.

Good advice given, to empty your PayPal account.

It sounds like you are being scammed and if you are using Paypal, they will not be on your side. Paypal allows buyers to indiscrimately chargeback purchases and sometimes does it automatically if their automated fraud detection gets triggered. They also allow "verified" users to attach credit cards that with name and address information different than that registered with Paypal. How else do you think so much fraud occurs on Paypal? Anyone can create an account or steal Passwords attach a stolen credit card, send you money to purchase goods and then several days later after you have shipped the goods Paypal can approve a chargeback and leave you hanging.

in my experiance paypal does not evan listen to the sellers point of veiw

we had two chargebacks last year one I feel we were right in not refunding second no refund was due buyer received item was happy with it and left feedback saying so
in both cases we filled in all paypal paperwork never heard anything back from pay pal untill they debited the accounts

I cleared the funds out of the account both times so they werent able to get funds

in the first case I felt we were right but buyer was really getting nasty thretning irs local zoning local licencessing ect ect it wasn't a great amount so i felt it was worth it to refund and get rid of this nutcase

second case buyer had filed 7 days after he paid becouse he had not received goods , I supplied paypal with DC and a copy of the feedback buyer had left saying it was a great item and he was happy they still never responded to me but debited my account forunatlesy there was only 8.00 in it at the time

I was finally abel to strighten it out with Damons help ..he is a great guy but why should we need to contact him ?

what really iratated me both times was the lack of response from paypal they never evan emailed to say "we found in favor of the buyer" they just went after the funds

my advice is to clear funds from your paypal account and refuse to accept paypal to you are sure this is resolved..

He actually left positive feedback for you and then claimed he didnt get item? Was there not in investigation?

I should have been clearer

he filed before he received the item 7 days after the auction ended item was in route went parcel post he didnt pay pal the day auction ended but a couple of days later

I supplied paypal with DC and a copy of the feedback but apparently they never contacted him to confirm he received they just debited my account for the 8.00 that was there plus put hold on the account for 52.00
once I got Damon involved they came back and said they would have to ask his permission to return the 8.00 to my account

he agreed and it was done.

my point is paypal does not seem to invistaget the claims but instead just refunds the buyer.

Paypal will take the money from wherever they can get it. I read one claim on Paypalwarning.com's Wall of Shame that Paypal debited a wife's account because of a dispute with the husband's account. The rule of thumb when dealing with Paypal is, expect Paypal to do whatever they please, regardless of banking or legal issues.
