Have you ever received payment from a NPB after you resold the item?

I know you'll ask:
No, no long distance call. Value of item is not worth it.
No, I didn't deluge her with payment requests.
No, I didn't threaten her.
Yes, I waited the recommended # days for reminders, etc.
Yes, I will return her MO.
Yes, I sent final e-mail to let her know I would be relisting item since I guess she must have changed her mind (hoping for response). I also stated I couldn't accept pymnt after item was relisted.
Yes, relisting item is in TOS.
Yes, I waited over 1 week in case mail was slow before e-mailing---no accusations or threats.
Yes, I would have waited longer for a late payment had I known a payment was coming. I don't mind waiting until someone's next payday.

No responses from buyer except when she requested my address for MO same day EOA. So I shrugged it off and assumed she changed her mind & didn't want to bother with e-mails.

2 days after item was resold (day after rec'd MO): E-mailed me saying she'd been out of town and thought she'd sent it.

She has 2 prior negs for NPB/no response and a neut for taking 1 mo to pay.

I would like you to share your experiences with me. Would I be committing a fraud to file FVF after she sent late pymnt, which I can't except?
Should I e-mail her that I have to return MO and give explanation?
or - Just mail it back with a note?
or - Should I e-mail, then ask if she wants MO back now or would she like me to hold it to see if new winning bidder pays. It's been 3 days & I haven't rec'd response from new winning bidder.

I'm not upset, just want to make a good decision.

this did happen to me. received the payment over a month after item was resold. I put the check back in the envelope (after marking void in large black letters on both front and back of check) along with a note explaining that item had already been sold but thank you anyway. never heard from them again.

The new winning bidder just paid me, & I shipped it out. I agree that the only thing to do is return her MO with a note and hope that'll be the end of it. I went ahead and added her to my blocked bidders list. Just a single e-mail would have avoided this whole thing.

Sounds like you didn't have another of the items on hand. If you do, send the item and keep the money. Otherwise, send the money order back. I have done it before as it is simply the right thing to do.
I had something similar happen to me a week ago. I had a NPB and relisted the item. The person had e-mailed me stating that payment was just sent. I actually took it as just another attempt to blow smoke as it had been nearly 6 weeks at that point. Low and behold, the money did come. Since the item had not been sold yet, I sent the item. Then I edited the auction to be a different item. I will always take payment for an item if I still have it.

You are right, there were no more of the same item. I have stopped an auction, too when a late payment came. For you to wait 6 weeks for payment was very patient. I would have thought they were just "blowing smoke", too at that point.
