I had a bidder who purchased an item at ebays at 8/18. I recieved the payment in a form of a personal check, on 9/11, after i filed NPB. As stated on my EOA and auction TOS, personal check will have a 2 week wait. I mailed the item out on 9/25, exactly 2 weeks later (didnt cash the check until 9/15)with Dc and insurance, as requested by the bidder.
Yesterday, I get this..

I said wait just a minute. it has only been 9 days, even if it is lost, I cant file an insurance claim until 30 days AFTER the day item was mailed. Besides the Dcshowed it was delivered. i get this

Now what kind of trouble I can get into with ebays IF this person files fraud? I checked the Dc, it SHOWS it was delivered, but even if, and that is a big if, it was delivered to the wrong address, I still cant file insurance claim UNTIL 30 days later, but seems like this person doesn't wanta refund at all. I do not have another one of this item, and even if i did, hate to mail out a replacement item for this closed for 85 dollars.
Since I cannot offer a replacement, and she doesnt want a refund, I am helpless. i checked fraud feature on ebays and it implied that if I can't basically "make the buyer happy" I can get my account suspended? I REFUSE to give into this, plus i cant make her happy for I dont have a replacement!.
However with past experience at half.com, even with proof of DC, AND filing insurance, even if the other party REFUSE to sign the claim, half.com was on the side of the bidder, and took money away from me. since half is now owned by ebays, I assume no matter what proof I have, even with her refusal to sign the insurance claim, I am going to get into trouble?I am going to get my account suspended over this?
Any way I can turn the tables on her? Isn't what she is doing considered "feedback threat"? Please help. I am WILLING to claim her bogus insurance, but aeems like this is NOT what she wants to do.

Turn the tables on her. Tell her that receiving the item and saying she didn't is fraud and you will be calling the Postmaster and police in her area to do further investigation. Do not offer replacement or refund, that is what the troll wants, her item and the money.
Just tell her to do what she feels she needs to do as far as feedback and notifying ebay. Ebay will do nothing about any threats she makes or fraud she reports. You have the DC number showing delivery.

Tell her you have proof it was delivered and that you will contact her local postal inspector to investigate. I've had people try this on me before and they usually back down if you dont give in to them.

I had similar situation about two months ago.
I mailed an item with DC. The item seemed to just sit in a local PO for about three weeks. Suddenly it said it was in the bidders state.
The bidder was patient and waited but after another week it it was still not there. I checked the DC again and it said delivered.
The bidder still claimed it was not there, but USPS said it was.
I decided the bidder was just a crook and told them I would not refund. I took the neg and followed it up with the DC# to "proove" it was delivered.
Well about a month goes by and the item is returned to me as address unknown. The USPS site still showed as delivered a month earlier...
What is the point? I am not sure... just thought I'd share.

I try to run almost every address through the zip code finder to see if it is in the database.
This buyer may have gotten free replacements in the past with feedback and fraud threats and now wants to do the same thing over again, and again.

what are we to make of DC if the USPS is a bunch of fraudulent crooks?
If it was returned to kyms, and the usps still says it was delivered, then this should be reported to the postmaster general, the postmaster in the delivery town and kyms's town, and kyms's congressmen.
Let's get the USPS to do what they are supposed to do!!

I have a feeling that when that package got to the proper post office someone scanned it and said it was delivered. Do you think the actual postal clerk that delivered the package scanned the package. I doubt it. With all the work those postal clerks do they wouldn't have time to come back to the post office to scan that package so I would think that it was scanned before they tried to deliver it. I took a tour of a post office in the area I work and believe me the delivery postal clerk has to do everything in order to deliver their mail. Some had boxes and boxes. I honestly couldn't believe the amount of letters that had to be sorted and sorted by hand by those clerks. I am sorry I didn't ask about priority mail but I will the next time I go there.

Be specific as to the date so that they realize that it was impossible for them to say the check cleared when it hadn't. I would start with the date the auction ended, then when you sent your WBN and when they replied. Then when they sent the money, when you mailed the package and when you cashed the check. Put everything in black and white so that you and they have an identical copy. Be sure that you send that email to both them and you so that your email has the same date as theirs. This should help if eBay requests anything. Isn't it wonderful there are bidders out there like that all us seller can do is keep our fingers crossed.

If the DC shows it was delivered , and she claims it wasn't, then it's obvious it was stolen from her mailbox or front porch before she could retrieve it. Do your duty as a good ebay seller offering the highest level of service to your customers, and report it to her local police department as a theft. It saves her the hassle of having to make the phone call and gives her the opportunity to explain to the cops her perception of what may have happened. When you make the report, declare yourself as a victim, since you are the owner of the goods until she receives them. By doing this, you will be able to receive a copy of the Police report to forward to the Postal Inspector and eBay, if necessary. It will also block her from receiving a copy of the report in most states.
The light at the end of the tunnel will turn out to be an oncoming train.

Oh Yes, do what sparkz says....NOT!!! If you call the police and they find it at the post office or find out she received it, then you are quilty of filing a false police report....THAT WILL HELP THE SITUATION!!!.
On the outside chance that it was not delivered yet, ask your buyer to please check with the local post office for the package.
I have, on 2 different occasions, had the package lay at the post office waiting for delivery...if I had not checked and suggested this to my buyers...the items would have been returned to me.

The package has been delivered according to DC. Quit responding to the e-mails and move on. You have done all you can.
