Absolutely! It is not only against eBay's written rules... but it may also be considered Copyright Infringement under Federal Law (depending on circumstances).

the first auction i did was with someone elses picture. I asked permission and the seller even explained how to copy it to my hard drive so I could upload it.
if someone asks for my picture, I see no reason to not allow it since i sell a variety of items and very seldom the same thing twice.
do i think it is right for someone to copy or use a picture without permission? absolutely not, that is stealing plain and simple, but to feel all bent out of shape because someone asks makes no sense to me.
