I actually have 2 issues I would like your suggestions for:
1. Sold an item and then no pay, no response to e-mails etc., etc. Finally got an e-mail after I filed NPB saying , "Sorry, but my little brother bid on your item without my permission and neither he or I will be paying for it. His bidding history show only 3 bids ever and he won all 3 and all 3 are the same type of product he won from me. He has zero feedback so far. I contacted the other sellers and only one responded saying she had filed NPB but no neg.
2. Sold an item 6-weeks ago and then no pay, no response to e-mails or NPB alert so I left them a neg. Yesterday I received a check in the mail for the item. Interestingly, the check is dated January, 2002....She has 24 positives and 7 negs(all in the past few weeks).

1. NPB them at the very least. Neg them if you are comfortable with the potential retaliation- they certainly deserve it.
2. You negged them AFTER they mailed the check, but BEFORE you recieved it? That's a little tricky.
If you still have the item, cash the check, AND WAIT FOR IT TO CLEAR, then send the item.
If you don't still have the item, send the check back, or play the "what check?" game with them.

I agree with the answer above. However, I would neg #1 for sure - and please do it for the sake of all of us sellers!

In the first case, file for your FVC and put the bidder on the block list and neg if your comfy. Filing the NPB/FVC will give them a minus.
In the second case, you could do a NPB/FVC and a neg if you are comfortable with that, but, what I do, if I have gone this far and get a payment after the NPB/FVC, (I automatically relist when I do a NPB) I would just send the check back if you want to spend the postage or email them and tell them you voided the check since payment was not made in a timely manner as stated in your tos, after all, when you filed an NPB they received notice from Ebay and received on or will when you file the FVC. I sell low end personal items, and am tired of messing around trying to collect.

Yes, I did neg her after 6 weeks of no response to numerous e-mails including the NPB. I had no idea that she was going to send the check. All of her other negs say the same thing about no response and no e-mails. Of course her check is dated 11 months ago. I would doubt that my bank would accept a personal check this old.
Many thanks for the suggestions. I have had such a rash NPBs lately. I am so tired of dealing with them and playing their silly games.

Dates on a check are meaning less. You can deposit a check even if the date is 11 months ago, or if the date is next week. The date is for the checkwriters records only.

Its too darn bad thag we can't give out the bidders ID. Sounhds like one I had in October. # weeks no correspondence from her & then after I file a NPB she writes & says that she had been in an accidenmt. I checked her feedback & I was the 3rd in less than 3 months to give her a neg.

Some banks will only accept checks that have a date less than 6 months old. You'll definitely want to see if that check clears. If not send it back or give it to the MAD agency and they will hound the buyer and hit him with lots of extra fees.

#1 File npb, Block both email& bidding.
#2 same as above
Once I file npb the deal is over. Would relist and move on. I would think that the only reason she is paying up now is because she is worried about getting the boot.
