Buyer with 1900 positive fb's and 38 negs purchased an item from me. I offered paypal, check or money order for payment. Buyer said he would send a check. After 20 days and a polite reminder I sent an NPB warning. Following day I get an email stating "I sent a check. If you don't have within 2 days from now let me know and I will send another." I let him know 2 days later that I had not received payment. No answer from him. I waited 18 more days (now 40 days from end of auction) and then filed for FVF and left a neg for non payment. Within hours I get a retaliatory neg from him stating that I was unwilling to work with him. He sends me an email (nasty one) that he has sent a second check and when I receive it he wants the merchandise and the neg removed.

My question is:

Was I being unfair? Would any of you wait longer than 40 days for payment?

BTW - the items are highly collectible and easily resold on ebay.

No. You are OK. If he sent a replacement check he had an obligation to let you know. He should know better than to leave you hanging.

Respond to his neg factually. Just send the check back and move on after you block him.

Maybe I am being unreasonable, but to curb retaliatory feedback I think Ebay should block bidders from leaving feedback for the sellers that give them a legitimate NPBA! I'm willing to bet we'd see more NPBA's being filed and more return of fees. Oh, maybe that's why Ebay doesn't do it.

I, too think you were more than reasonable. I wouldn't have waited so many days. I see the start of that happening on a couple of mine. I cringe when someone says they are sending me a check or money order. That's why I prefer Paypal.

Can I ask a question? Once you file for a FVF isn't the buyers feedback box removed from your feedback area?

The problem is, how can eBay tell if the NPB is "legitimate" or not, assuming payment is sent through something other than eBay payment services? A scamming seller could easily take payments, never ship and then claim NPB, and it would be tough to verify the payments weren't "lost in the mail." (This would work especially well with money orders ... most MO issuers charge a fee to track them.)

Lets get back to basics. Your original statement said nothing about accepting checks. If you do not accept checks, why did you ever let him get away with this?? You have put yourself out on a linb.

Sanmar - The buyer stated that "I sent a check....", not I'm SENDING a check. Unless Capo has the ability to turn back time there wasn't much that could be done to change that. Besides, I have a feeling she could have agreed to take payment in Toasted Marshmellow Jelly Bellys and the Capo wouldn't have recieved those either. Remember, we don't just have one "lost" check, there are two.

Yes, you were being fair. This is just another bidder who doesn't take responsibility for his own actions and then has to blame someone else. Unfortunately it was you.

Respond to his neg, resell the merchandise and block his bids and his e-mails.

I agree with that. Be factual in your response, return voided check (make a copy of VOID) if you get it and don't communicate with this person. It will only get nasty.

He sends me an email (nasty one) that he has sent a second check and when I receive it he wants the merchandise and the neg removed.

Save the nasty email for 6 months!

This buyer is out of line.
